Additional Mooring Pilings 1) This permit authorizes the installation of seven (7) additional mooring pilings located in or over the water that are expressly and specifically set forth in the permit application, unless modified herein. No other structure, whether floating or stationary, may become a permanent part of this commercial docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) The mooring pilings shall have a minimum setback distance of 15 feet from the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel or deep water that intersects with the shore at the point where the upland property line meets the water's edge. Signature of Permittee 3 Bruce Carlson Permit#59-03 Page 2 of 3 ADDITIONAL CONDITIONS 3) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 5) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) The commercial docking facility is currently permitted for 10 slips. This permit does not authorize the creation of additional slips. NOTE: Any proposal to add one or more additional boat slips to the authorized 10 slip facility will require that the docking facility be classified as a marina, and will therefore require a review under the N.C. Environmental Policy Act (NCEPA). NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards,thereby violating state law. NOTE: Boats utilizing the docking facility may be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. Easement 9) Prior to construction of any new boat slips or other docking facilities under this permit, the permittee must apply for and receive an Easement from the Department of Administration's State Property Office as required under N.C.G.S. 146-12(e). r Bruce Carlson Permit# 59-03 Page 3 of 3 ADDITIONAL CONDITIONS General 10) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No.030383. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit No. 28 (COE Action Id. No. 200300654) which was issued on 4/25/03. PROJECT SUMMARY: The applicant proposes to install seven (7)additional mooring pilings at an existing 10 slip commercial dock. Bruce Carlson Page Two 9. PROJECT DESCRIPTION: The project site is the existing 10 slip commercial dock located at 158 Old Ferry Road, adjacent to the New River, in Sneads Ferry, in Onslow County. The property is located between Old Ferry Marina and Sneads Ferry Marina, just downstream from the NC Highway 172 Bridge. On April 28, 1998,CAMA Major Permit No. 56-98 was issued to Mr.Carlson for the construction of the subject 10 slip docking facility. All work authorized under this permit was completed and the permit expired on December 31, 2001. The docking facility consists of a 5 ft. wide access pier which extends approximately 185 ft. into the New River,terminating in a 6 ft.wide by 80 ft. long"T"head. The "T"head,along with four finger piers extending from the main walkway and 13 mooring pilings create a docking arrangement for 10 vessels.(See work plan drawing sheet 1 of 2) The Onslow County Land Use Plan classifies the upland areas of the project site as Limited Transition. The waters of the New River are Classified SA by the Division of Water Quality. The area is not designated a Primary Nursery Area by the Division of Marine Fisheries and is open to the harvesting of shellfish. The applicant is proposing to add seven(7)additional mooring pilings to the existing facility. The mooring pilings would be located ten feet beyond the existing "T" head, finger piers, and/or mooring pilings. A line of four piles would be located on the north side of the structure between slips 6 and 7,7 and 8,8 and 9,and 9 and 10. On the south side of the structure,the pilings would be located between slips 10 and 1, 1 and 2,and 2 and 3. The pilings would provide additional mooring attachment points within the existing slips and would not result in an increase in the total number of slips. 10. ANTICIPATED IMPACTS: The proposed mooring pilings would result in the incorporation of an additional 1,200 sq.ft.public trust area between the new pilings and the existing dock. Minor increases in turbidity can be expected during piling placement. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 2. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without having the permit transferred to a third-party. 3. Installation of the mooring pilings will provide additional attachment points and not increase the total number of slips at the facility. The project site is located in Sneads Ferry at 158 Old Ferry Road, and adjacent to the New River in the unincorporated portion of Onslow County. According to the Division's Field Investigation Report, the Public Trust Area and Estuarine Waters Areas of Environmental Concern(AECs) will be impacted. Waters at the site are classified SA, and are open to shellfishing. Waters at this site are not designated as Primary Nursery Area(PNA). This development proposal has been reviewed for consistency with the Onslow County 1997 Land Use Plan (LUP). The land classifications for this site are Limited Transition and Conservation. The Limited Transition classification applies to the upland portion of the site. The purpose of this classification is to provide for controlled development with services. The Conservation classification applies to Public Trust Area and Estuarine Waters. Uses permitted by the policies contained in the LUP, and 15A NCAC 7H are allowed within areas designated Conservation. According to the LUP's Estuarine System policy, the County allows water- dependent uses within the Estuarine System AEC that conform to the general use standards of 1 SA NCAC 7H.
