Any violation of these terms may be subject to a fine,imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes a maximum of ten boat slips. Utilization of the docking facility by more than , ten boats, even temporarily, will require a closure of open shellfish waters, which would be a violation of T15A:07H.0208(b)(5)(E) of the rules of the Coastal Resources Commission. NOTE: Any future proposal to add one or more additional boat slips to the authorized 10 slip facility will require that the docking facility be classified as a marina under the rules of the Coastal Resources Commission, and will therefore require a review under the N.C. Environmental Policy Act (NCEPA). 2) All portions of the authorized facility shall be located a minimum of 300 feet from the northern edge of the adjacent upland marina basin entrance. Gi , 1 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 6) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 8) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. Shoreline Stabilization 9) The bulkhead shall be placed landward of the mean high water level at the time of construction. 10) The bulkhead shall be located landward of all vegetated wetlands. 11) The alignment of the proposed bulkhead must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 12) The bulkhead must be constructed prior to any backfilling activities. 13) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. Bruce Carlson Permit#56-98 UJ Page 3of3 I FEB 2 12003 ADDITIONAL CONDITIONS DIVISION OF 14) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. This permit does not authorize any excavation waterward of the approved alignment. 15) The back fill material will be clean and free of any pollutants except in trace quantities. 16) All back fill material will be obtained from a highground source and confined behind the permitted bulkhead. 17) The temporary placement or double handling of excavated or fill material within waters or vegetated wetlands is not authorized. Sedimentation and Erosion Control 18) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 19) All disturbed areas shall be properly graded and provided abound cover sufficient to restrain erosion within thirty days of project completion. General 20) The Division of Water Quality is currently reviewing the permit application to determine if the project is in compliance with North Carolina's Water Quality Certification program. The permittee must receive a Water Quality Certification from the DWQ prior to the initiation of any construction activities. 21) No open water areas or vegetated wetlands may be excavated or filled. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. NOTE: Future development of the permittee's property, including any upland development, will require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity to initiate modification of this permit. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. 199800681. PROJECT S0VEVIARY: The applicant is asking to modify and renew existing Major Permit #233-86 to allow for a 37-unit RV Campground. Old Ferry Marina Page 2 9. PROJECT DESCRIPTION Old Ferry Marina is an existing marina development located one quarter mile south of the high rise bridge off of Highway 172. The original Major CAMA Permit was issued in 1986 with subsequent renewals and modifications. The marina is located on a man-made basin bordering the New River. The following features have been constructed: some private roads, dry stack storage building (first phase), townhouse building/office, piers, docks, bulkhead in the upland basin. Work to be done includes the remainder of the dry stack building, 3 more townhouses, additional septic systems, swimming pool, roads, parking, and bulkhead work along the New River. The original CAMA Major Permit ##233-86 allowed for an 8-lot single-family subdivision. The applicant is now making application for 6 of the 8 lots be used for an RV campground. A maximum of 37 RV units are proposed. Waste disposal will be by septic tanks. According to the Onslow County Health Department some septic systems have been installed. However several other systems would have to be installed to accommodate the proposed number of RV campers. A letter specifying details on septic systems is attached to this report. The plan for the project notes that a typical RV unit is 8' by 35' in size. Each unit will be allowed to have an 8' x 12' open deck. No other additions to individual RVs would be allowed. All of these units are proposed to be located more than 75' from the mean high water line. No work being proposed under this modification would be located within an area of environmental concern. The waters of the New River in this area have been classified as SA by the Division of Water Quality. This area is not a primary nursery area, but is open to the taking of shellfish. There are shellfish leases off shore in this general area. A stormwater plan has been submitted to the Division of Water Quality for their review. 10. ANTICIPATED IMPACTS The RV Campground will result in more overall impervious surface coverage than is presently on the site. It will require the installation of additional septic systems. However, no changes are requested for the 75' estuarine area of environmental concern. Janet M. Russell / December 13, 1996 / Wilmington Recommendations for State Permit - OLD FERRY MARINA The Division of Coastal Management recommends that renewal and modification of this permit be granted if the following conditions can be met: 1. RV units are limited in number (37), size (8' x 35') and location as shown on the plans. 2. Additional septic systems must be installed and approved by the Onslow County Health Department prior to more RV units being moved onto the property. 3. No room additions, covered porches, etc. are allowed as accessories to the RVs. 4. Before additional bulkhead work is commenced, the permittee will meet onsite with a representative of Division of Coastal Management so that a bulkhead alignment might be delineated and staked. 5. The bulkhead must be constructed prior to any backfilling activities. 6. No coastal wetlands will be filled and/or excavated. 7. The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. All backfill material will be obtained from a highground source and confined behind the permitted bulkhead. 8. The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 9. Any violation of or deviation from the stormwater plan approved by DWQ will be considered a violation of this CAMA permit. 10. No person shall be allowed to live aboard vessels in the marina. 11. Old Ferry Marina is limited to a total of 32 boats moored at any one time. 12. Any changes in land use or development plans will require modification of this permit. 13. The applicant has modified his proposal by removing one mooring piling at the end of the "T" head and stating that use of the project will be restricted to 10 boats. Based on this modification, and Shellfish Sanitation's determination that no closure will occur, EPA has stated that they no longer object to issuance of the permit. We recommend that the following conditions be included in the State authorization: 1. All work will be performed in strict compliance with the permit plans. 2 . This permit does not authorize any dredging. 3 . No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), Section 401 of the Clean Water Act (as amended), and North Carolina General Statutes(G.S. 113-131 et seq.). The applicant is proposing to build a 185' community pier with 10 boat slips. The structure would have 3 finger piers(3'-6' wide by 35'-40' long). The proposed "T" on the pier would be 6' wide by 80' long. Three separate mooring pilings would be located waterward of the "T". The proposed size and layout of the docking facility appears capable of accommodating more than 10 boats. Construction of a 300' long bulkhead along the shoreline is also proposed. Area waters of the New River are classified SA, but are not designated a Primary Nursery Area. However, these waters are open to shellfishing and 2 shellfish leases are duly recorded. It is our understanding the intensity of slip development proposed would cause the closure of open shellfish waters. To minimise degradation of area estuarine waters, we recommend the project be reduced in scope to the point where no shellfish closure is required. "Expansion of existing facilities shall also comply with these standards for all development other than, maintenance and repair necessary to maintain previous service levels". It is my feeling after reviewing the project that locating additional dockage along the narrow entrance into the upland basin will create a hazard to navigation and would be, in effect, in the "channel" coming into the basin. Others of the proposed pier extensions may also prove to be a hazard to navigation because of the shape of the basin and multiple ownerships along the shoreline. Additionally the County will assist and advise other governmental agencies having jurisdiction over protection of these waters and along adjoining estuarine shorelines.(page 214) Onslow County does not oppose bulkhead installation provided installation is consistent with 15A NCAC 7H. Bulkheads must be constructed landward of significant marshland areas. Installation of bulkheads must not damage marshes. CONSISTENCY OPINION: Implementation of environmental policies in the Onslow County Land Use Plan Update depends largely upon project compliance with existing federal, State and local regulations and ordinances. If this project meets local, State and federal requirements, then it will be consistent with the Land Use Plan. Staff review of the plans and specifications has determined that the development activities proposed will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 214.1000. By copy of this letter, we are informing you that.your project will not require a stormwater management permit. Please keep m mind that this determination does not relieve you of your legal responsibility to obtain other permits which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Areas Management Act, Federal, State, or Local Governments. In addition, any future modifications to the project will require additional review from this Office to assure that stormwater impacts are not an issue. From: Patti Fowler Shellfish Sanitation Section Subject: Old Ferry Marina Site Visit Thank you for meeting Gina Casti and myself at Old Ferry Marina in Sneads Ferry for again another site visit. Again we seem to be in the same position that we encountered over one year ago for this site. From what we determined today, the basin is still exceeding the total number of slips for the current closure of 75 slips. In 1996 during that site visit we determined that Old Ferry Marina was exceeding their permit of 32 slips. Yesterday the three of us counted a total of 44 slips. This total did not include the pier by the launching ramp for the dry stack that could dock another 6 boats. On our return to Morehead City we stopped at the DCM office and looked at 1995 arieal photography and it appeared that 3 boats were docked at the pier. You also stated during the site visit that you had no record of permits for other dockage areas in the basin. Overall there seems to be no changes in dockage in the entire basin since our last site visit in 1996 except for Mr. Karmous removing 5 of his 6 slips. At this point in time until it is determined exactly how many slips have been permitted in the basin there is no way that we can comment on the closure. As the basin stands today additional closure will be necessary.
