Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) This permit authorizes excavation necessary to construct the authorized concrete boat ramp as depicted on Sheet 4 of 4 dated 2/10/03. 2) Excavation will not exceed -3 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. Signature of Permittee Henn Carroll Permit#58-03 Page 2 of 4 ADDITIONAL CONDITIONS 4) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawings. Spoil Disposal 5) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 6) No spoil material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the bulkhead. 7) The disposal area will be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters. 8) The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. Bulkhead 9) The authorized alignment of the proposed bulkhead must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 10) The authorized bulkhead will not extend waterward more than 2 feet from the normal water level at any point along its alignment at the time of construction. 11) The bulkhead must be constructed prior to any backfilling activities. 12) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 13) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. 14) The backfill material will be clean and free of any pollutants except in trace quantities. Docking Facility 15) The authorized structures and associated activity must not cause an unacceptable interference with navigation, and shall not exceed '/a the width of the waterbody. 1 H. Glenn Carroll Permit#58-03 Page 3 of 4 ADDITIONAL CONDITIONS 16) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 17) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 18) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 19) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 20) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 21) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 22) This permit authorizes a maximum of three boat slips. At no time shall more than three vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. NOTE: Should the adjacent property be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. Concrete Boat Ramp 23) The concrete boat ramp must be poured on high ground and pushed or placed into the water once hardened. No live concrete may come into contact with the water. 4', H. Glenn Carroll Permit#58-03 Page 4 of 4 ADDITIONAL CONDITIONS General 24) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 33400 (DWQ Project No. 030346), which was issued on 4/21/03. Glenn Carroll(Steve Antinori, Agent) Page Two 9. PROJECT DESCRIPTION: The applicant's property is located at 7065 7 h Street within the Town of Surf City, in Onslow County. The project is located on a man-made canal off Topsail Sound and the Atlantic Intracoastal Waterway(AIWW)and is located in an area locally known as Old Settler's Beach. This man-made canal is the fifth canal in a series of seven canals which start just north of the Pender/Onslow County line. To get to the site go to Surf City and take NC Hwy 210 north (North New River Drive). Go to the Pender/Onslow county line within Surf City. The numbered streets start just past the Friendly Mart(located on the left). Turn right onto 7t' Street and the project site will be on the left. The highground property is a residential lot. The property survey shows that the lot measures 140 feet long and 55 feet wide. The elevation for the property is approximately 2 feet above normal high water. The lot is flat and currently has a mobile home and a dog pen located on it. The vegetation of the site consists of mostly lawn grasses and landscaping. The property has 55 feet of shoreline along the man-made canal that has not been previously bulkheaded. The easternmost section of the shoreline has the remnants of an old boat ramp(no concrete is evident). The area of the boat ramp now contains coastal marsh. An approximate five foot wide expanse of Black Needle Rush (Juncus roemaranus)is located at the waterward section of this old boat ramp. Salt Meadow Hay(Spartina patens),Spike Grass(Distichlis spicata)and Sea Oxeye(Borrichia frutescens)are found in the more landward section. A ribbon of Coastal Marsh including Salt Meadow Hay(Spartine patens)and Sea Oxeye(Borrichia frutescens)and Salt Marsh Cordgrass(Spartina alterniora)ranging from three feet to approximately five feet in width grows along the remainder of the shoreline(158 sq ft). The width of the man-made canal in front of the applicant's property is approximately 98 feet in width. The Division of Water Quality has classified the waters of the canal as"SA". The area within the man-made canal is NOT designated a Primary Nursery Area(PNA) by the Division of Marine Fisheries and is CLOSED to shellfishing. Surf City's Land Use Plan(LUP) classifies the upland areas as developed(DEV). PROPOSED PROJECT The placement of the mobile home on the property prohibits the vehicular access to the old boat ramp at it's present location, therefore the applicant is proposing to construct a 10' X 10' boat basin within the area of the old boat ramp. The new proposed boat ramp would be located on the western corner of the property which would allow vehicular access. A 12' X 18' boat ramp is being proposed on the westernmost portion of the property line. A proposed 6' X 10 ` pier would be adjacent to the boat ramp (located 12' inside the westernmost property line). The proposed dock would "L" towards the east and is proposed to be 12' X 18' in size. A proposed 2'X 22' finger pier would be adjacent to the boat basin on the western side(approximately 4' from the eastern end of the proposed dock).The water depth at the end of the proposed dock and finger pier would be approximately—6'MLW.The applicant also proposes to bulkhead the entire shoreline which would encompass approximately 75 linear feet(including the boat basin and boat ramp area). The bulkhead would be positioned approximately 12`waterward of the coastal wetland line at the 10'X 10' boat basin section within the old boat ramp area. The remaining bulkhead would be located landward of all coastal wetland. Lastly,a 10'X 10'boat basin is proposed to be dug within the existing footprint of an old boat ramp on the easternmost corner of the property. A 12' X 12' boatlift is proposed in line with and just waterward of this basin. The outside pilings of the boat lift would be located approximately 20'waterward of the bulkhead and would be in line with waterward end of the proposed dock. The dredged spoil from the boat H. Glenn Carroll(Steve Antinori, Agent) Page Three basin is proposed to be placed on the property behind the proposed bulkhead work.Once the material has dried it would be used to backfill the bulkhead. 10. ANTICIPATED IMPACTS The proposed project would result in the impacting of approximately 395 square feet of mixed coastal marsh vegetation. Of this, 100 square feet of coastal marsh will be impacted by the digging out of the old boat ramp area for a boat basin. The basin would be dug to an elevation of—3.0(MLW)resulting in the removal of 15 cubic yards of material. The grading of the area and the placement of the concrete boat ramp would impact an additional 65 square feet of coastal marsh. Lastly, the proposed bulkhead around the old boat ramp basin would impact the remaining 230 square feet of coastal marsh due to the placement of the bulkhead tie back rods, supports and backfill. Approximately 902 square feet of high ground would be impacted due to the spreading of the dredge spoil across the lot as well as the placement of tie back rods and supports for the proposed bulkhead. The shoreline length at the start of this project is 55 feet,due to the digging and bulkheading of the boat basin, the ending shoreline measurement would be approximately 75 feet. 15A NCAC 07H.1205 (g)states: "T"s, finger piers,platforms,and decks of piers on lots with shorelines 100 less than 100 feet shall not exceed four square feet per linear foot of shoreline." The proposed project would have approximately 284 square feet of dock and finger piers which is within the allotted square footage for the property. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 4. No excavated or fill material will be placed at any time,in any marsh or surrounding waters,outside of the alignment of the fill area indicated on the workplat(s). 6. The permitee must install and maintain, at his expense, any signal lights and signals prescribed by the US Coast Guard through regulations or otherwise,on authorized activities. 8. The alignment of the proposed bulkhead must be staked by a representative of the Division of Coastal Management(DCM)within a maximum of thirty(30)days prior to the start of construction. Failure to initiate construction within thirty(30)days,or erosion of the shoreline by adverse weather conditions,will require the alignment to be re-staked by DCM within a maximum of thirty (30) days prior to the new expected start of construction. 9. All unconsolidated material resulting from associated grading and dredge spoil placement shall be retained on site by effective sedimentation and erosion control measures. Prior to any land-disturbing activities,a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas,until such time as the area has been properly stabilized with a vegetative cover 10. The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within thirty(30) working days of project completion. 11. Future development on the permittee's property may require a modification of this permit. Impact 395 square feet of coastal wetlands associated with the construction of a 10' x 10' boat basin where the old boat ramp was, a dock and finger pier, and a 12' x 1 S' boat ramp; 2). Construct a bulkhead 12' waterward of coastal wetlands in the 10' basin area, and landward of coastal wetlands along the rest of the property; 3). The purpose of the Developed land classification is to allow for residential development where urban services are provided. The purpose of the Conservation classification is to provide for effective long-term management and protection of significant, limited or irreplaceable areas. The following LUP policies are applicable to this project: Coastal Wetlands—suitable land uses include those giving highest priority to the protection and management of coastal wetlands; Estuarine Waters—activities shall be restricted to those which do notpermanently or significantly affect the function, cleanliness,salinity and circulation of estuarine waters; Estuarine Shorelines—residential land uses are appropriate along estuarine shorelines provided that. (a) a substantial chance of pollution occurring from the development does not exist,(b)natural barriers to erosion are preserved, (c)impervious surfaces are limited, (d)standards of the NC Sedimentation and Pollution Control Act are met,and, (e) development does not significantly interfere with existing public rights of access to or use of navigable waters; Public Trust Areas—suitable land or water uses include those which protect public rights for navigation and recreation and those which preserve and manage the public trust areas in order to safeguard and perpetuate their biological, economic, social and aesthetic value, such as dredging and bulkheading, Damaging of Existing Marshes by Bulkhead Installation—the Town permits bulkhead installation provided construction is consistent with 1 SA NCAC 7H.
