Summarily, the rock must be clean and sufficient in size not to move in the system; no excavation is allowed; no backfill or other fill (except for the rock) is allowed in any wetlands, submerged aquatic vegetation, waters, or high ground; the rock must be placed immediately waterward of the erosion escarpment, not to exceed a maximum of 5' waterward of the escarpment; and the height of the rock must not exceed 6" above the elevation of the adjacent marsh substrate. I have determined that the development proposed is consistent with the general and specific use standards found in 15A NCAC 07H .0208 and in keeping with the original intent of your permit. Please consider State Permit#2-03 refined by way of this letter, as depicted on the plats dated received December 15, 2006. Note that this refinement must be attached to the original permit for Division inspection, and all other conditions of the original permit still apply. We have noticed substantial shoreline erosion since the property was surveyed six years ago. I have included one of the signed riparian permits from our neighbor to the north, and I will forward the permit from the neighbor to the south as soon as I receive it. A copy of the tax map showing the site is included for your reference. The intent of the appointment was to determine the necessary restoration as described in Notice of Violation#06-20C. To summarize, we visited five (5) sites that had received spoil from the dredging project authorized under the Core Banks Club, LLC Permit#2-03. None of these sites were approved for the placement of spoil material. In order to fully comply with the restoration plan, you must: 1) Receive and submit permission from Mr. John Nelson for the placement of the spoil at 631 Hwy 70, Davis. 2) Receive and submit permission from Mr. Phillip Smith for the placement of the spoil on his property, as well as obtaining the site address. 3) Receive and submit permission from Mr. Jim Murphey for the placement of spoil at 170 Mollie Lewis Lane. Install silt fencing around the spoil. Submit signatures of no objection from or certified mail return receipts indicating notification of the spoil placement from the adjacent riparian property owners. Obtain a Minor CAMA Permit from Carteret County to grade the spoil into the lot. 4) Receive and submit permission.from Mr. Jack Gonsoulin for the placement of spoil at 141 Murphy Road. Install silt fencing around the spoil. Submit signatures of no objection from or certified mail return receipts indicating notification of the spoil placement from the adjacent riparian property owners. Obtain a Minor CAMA Permit from Carteret County to grade the spoil into the lot. 5) Receive and submit permission from Mr. Jeff Schmitz for the placement of the spoil at 291 Community Road. Mr. Schmitz must not move the spoil beyond its present perimeter without approval from the USACE. With this information in hand, I should be able to consider restoration complete, and close the case. This permit was originally issued to the Core Banks Club, c/o Mr. John Hagan, on January 13, 2003, to expire on December 31, 2006. The permit authorized a roadway, residence, basin, channel, bulkhead, and docks adjacent to Core Sound, located at the end of SR 1364 in the community of Davis, Carteret County. The current request is for the maintenance excavation of the canal for a width of 15' and a distance of 950' within the 30' x 1450' total dimensions of the canal. Current soundings in the canal average -.6' n1w, and the proposed excavation depth is -3' n1w, connecting to -3.5' n1w. This should generate approximately 1320 cubic yards of spoil material, which must be placed on high ground, a minimum of 30' from the normal high water contour line. Additionally, you propose to place granite rock as a groin structure extending for a distance of 25' offshore of the northern tip of the mouth of the canal. This was reduced from the original request of 120' to keep the proposal within the refinement authorization process. This structure cannot exceed a bottom width of 10', and must not exceed 2' above the normal high water contour line. Rock used for this purpose must be clean, free of debris, and large enough to sustain the energy of the system without moving in wave and current action. I have determined that the development proposed is consistent with the general and specific use standards found in 15A NCAC 07H .0208 and in keeping with the original intent of your permit.
