Core Sound, at end of SR 1364, near Davis community , as requested in the permittee's application dated 1/10/02, including attached the workplan drawings (1), dated revised 6/14/02. This permit, issued on January 13,2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Access Road and Culvert Installation 1) The access road and bridge construction as well as the culvert installation shall be conducted as depicted on the attached workplan drawings. 2) No excavated or fill material will be placed at any time in any vegetated wetlands outside of the alignment of the fill area indicated on the workplan drawing. 3) In accordance with the 401 Certification issued by the NC Division of Water Quality, at least one culvert must be located within the road crossing site at its lowest point, and the culvert must be placed below the elevation of the streambed to allow for low flow passage of water and aquatic life. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Si ature of Permittee Core Banks Club, LLC Permit#2-03 Page 2 of 5 ADDITIONAL CONDITIONS Residential Structure and Storage Building 4) This permit authorizes only the construction of the residential structure and storage building that is expressly and specifically set forth in the permit application and depicted on the attached workplan drawing. 5) Prior to the commencement of the construction of the hunting lodge authorized by this permit, the permittee shall provide the Division of Coastal Management a copy of the Authorization for Wastewater System Construction issued by the Carteret County Health Department for the installation of the septic system. NOTE: In order to avoid unreasonable danger to life and property, all development should be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100 year storm. Any building constructed should comply with the North Carolina Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. The building code or flood damage prevention ordinance may impose additional more restrictive requirements than the Division's standards for development in areas of environmental concern (AECs). Basin and Channel Excavation 6) Excavation will not exceed -3 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 7) No excavated material resulting from the channel and basin excavation will be placed at any time in any vegetated wetlands or waters. 8) The permittee shall comply with the attached list of United States Coast Guard Regulations. Spoil Disposal 9) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 10) No spoil material is to be placed within 30 feet of the normal water level. 11) The disposal area will be located a sufficient distance from the mean high water level or any marsh to eliminate the possibility of eroded materials entering into surrounding wetlands or waters. Docking Facility 12) This permit authorizes only the docks, piers, and other structures located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non- water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. � f Core Banks Club, LLC Permit#2-03 Page 3 of 5 ADDITIONAL CONDITIONS 13) Any portion of the permitted access pier and docking facilities built over coastal wetlands and submerged aquatic vegetation (SAV), must not exceed four, feet in width and must be elevated a minimum of three feet over the wetland substrate and the mean high water level as measured from the bottom of the decking. 14) To minimize impacts to SAV habitat a representative of the Division of Coastal Management must stake the final location of the permitted docking facility. 15) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 16) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 17) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 18) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 19) This permit authorizes a maximum of 2 boat slips. At no time shall more than 2 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with the docking facility. 20) Dredging in any manner, including "kicking" with boat propellers, is not authorized adjacent the permitted docking facility. Sedimentation and Erosion Control 21) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 22) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 23) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Core Banks Club, LLC Permit#2-03 Page 4 of 5 ADDITIONAL CONDITIONS Water Quality 24) The NC Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3371 (DWQ Project No. 021042), which was issued on 7/5/02. Any violation of the certification issued by the DWQ will be considered a violation of this CAMA permit. 25) When dredging the basin, turbidity must be controlled so that turbidity does not exceed 25 NTUs outside the project area. The use of turbidity curtains may be required if the turbidity exceeds this threshold. The permittee should contact the NC Division of Water Quality at (910) 395-3900 regarding turbidity problems. Stormwater Management 26) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW8020620 on 12/6/02. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. General 27) No coastal wetlands will be excavated or filled. 28) All fill material will be clean and free of any pollutants except in trace quantities. 29) All fill material will be obtained from a high ground source and confined by an appropriate erosion control device until the material is sufficiently stabilized. 30) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 31) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. NOTE: The permittee is advised that this is a mosquito breeding area. Construction plans and operations should include an awareness of this. The permittee is urged to contact the Public Health Pest Management at (252) 726-8970 and/or Carteret County Mosquito Control at (252) 728-8595. to arrange for a site visit or to obtain information to help prevent the creation of more mosquito habitat. PROJECT SUMMARY: Applicant proposes to utilize this tract for the construction of a private hunt club facility, involving a road through wetlands, a basin and canal extension, a pier into Core Sound, a boat shed, and a residence with associated septic tank and well. Field Investigation Report: Core Banks Club, LLC Page 02 --------------------------- 9.NARRATIVE DESCRIPTION: The project site is a vacant ten-acre tract(two tracts of 6 and 4 acres)bordering Core Sound in the Township of Davis, Carteret County. Access to this property is via Highway 70 East to Davis,taking Community Road into the west end of Davis, to Mollie Lewis Road and SR 1365. While the application states that the property is located at the end of SR 1364, this road will not lead into the portion of the property being developed. The property elevation varies, but averages +4' msl. Soils on site are sandy in characteristic, but approximately '/2 are classified as hydraulic. Much of the vegetation on the property has been cleared due to hurricane damage to trees. Presently,there are pines,several of them dead,with an understory of Wax myrtle, Hollies, Red cedar, Cat briar, Poison ivy, Dewberry, Grape, Marsh elder, and Groundsel tree. While the ground surface is typical of a pine forest surface,there are areas of Black needlerush, Salt meadow hay,Switch cane, and Common reed. This property is located at the southern tip of Davis, which continues through one other tract and into coastal marsh heavily riddled with mosquito ditching. The east side of the property fronts Core Sound,while the south side borders another vacant tract. The west and north sides of the property abut residential property,with a ditch separating the north side from a property known as Knake Landing. An artificial canal intersects the property along the south side, which continues to Core Sound off of the subject property. The far west side of the property, across the canal, has a pre-existing boat ramp and camper trailer. The federal wetlands on the site have been delineated and approved by the US Army Corps of Engineers. According to the survey of the Section 404 Wetlands,this area constitutes more than half of the site. The entire west,south, and eastern borders are designated wetland areas. The Carteret County Land Use Plan classifies this area as Community, with all AEC's classified Conservation. The waters of Core Sound are open to the taking of shellfish for consumption, are not designated as Primary Nursery Areas, and are classified as SA- ORW. Core Sound at the project site is in excess of 2 miles across. The applicant is the Core Banks Club, LLC, an entity formed around providing hunting and fishing access to several private individuals. This group lost entitlements to their previous encampment on Core Banks,and have consequently purchased this property on which to construct a small camp. The project will entail an access road with culverts, an extension of an artificial canal connecting to a new boat basin, a boat shed, a residence with well and septic, and a pier. The road will commence at the end of SR 1365, with a 25' x 18" culverted crossing of the ditch. The roadway will be 15' in width, and will extend approximately 290' through the wooded Section 404 Wetlands. Approximately 170' into this system, there is a concrete culvert proposed, 16' x 18", to allow for hydrologic now. The disturbance required for this culvert will be 20' x 20'. Within this particular wetland pocket,there is an area of Juncus roemerianus(approximately 70 sf)that does not fall within coastal wetland jurisdiction,as it is not connected to surface waters. The road continues for another 444' x 15' through high ground, terminating in a cul-de-sac, approximately 40' x 75'. While the roadway is 15' in width, this allows for 2:1 sloping shoulders of 2.5'to either side, with a 10' travel way. The center 10' of the proposed roadway will be gravel. The applicant has re-designed this road from the original request in order to minimize the amount of wetlands filled. The residence is to be located at the end of the cul-de-sac. This will be a two story, pile supported dwelling, with a first floor elevation of 9'. The footprint of the residence is proposed for 30' x 60', requiring a 40' x 70' area of ground disturbance. A catwalk for pier access is proposed from the porch of the residence. This structure will be elevated, and 4' in width. The catwalk will extend 17' from the residence before intersecting the federal wetland line. It will continue approximately 45' across federal wetlands, and another 45' across coastal marsh, before entering the body of Core Sound. The coastal marsh at this location consists of Juncus roemerianus and Spartina patens with intermittent Iva frutescens and Baccharis halimifolia. Some Cladium jamaicense exists in localized spots. The waterward edge of the coastal marsh is eroding,as is evidenced by an Core Banks Club, LLC Page 03 8"to 10" escarpment. The pier will extend approximately 125'into the body of water,terminating in-2' nlw, and providing temporary dockage for 2 small vessels. The substrate of Core Sound is very sandy in this area. The pier will be located several hundred feet from either riparian corridor. No permanent mooring is proposed. The well and septic are proposed for installation immediately west of the road. The approved septic area is 100' x 100' in size. Between and to the west of the septic and well lies the proposed pile supported shed. This structure has dimensions of 12'x 24'and is intended for boat equipment storage. The proposed boat basin will begin on the high ground immediately west of the shed, but will be located mostly within the federal wetland area. Approximately 40' x 30' of this feature will be in wetlands, with the remaining 10' x 40' in the high ground. The basin will connect to the existing channel with 25'x 16' of new canal continuing through the pre- existing basin for another 25' x 16' to the existing 30' wide canal. The existing canal has a normal low water depth of-3' (recently excavated under GPC 27987),and the applicant is proposing the connecting features to be excavated to-3.5'nlw. Approximately 100 cubic yards will be removed to a 60'x 60'high ground disposal area on property for which permission is on file. This proposal in its entirety lies within the 575' ORW area. The finished project will result in 2.5%impervious coverage within this area. A stormwater plan for this project was submitted on June 03,2002. No Sedimentation/Erosion Control Plan is required. The septic system and well have received approval. 10. ANTICIPATED IMPACTS: As proposed, the project will require the filling of 4348 sf of federal wetlands for the construction of the roadway; another 1600 sf of this same system will be excavated for the basin and access channel. The catwalk will shade approximately 180 sf each of federal wetlands and coastal marsh. The pier will incorporate 492 sf of open water area, also shading this shallow habitat,and will provide for temporary mooring of two shallow-draft vessels. Approximately 400 sf of previously excavated shallow bottom habitat within the existing canal will be excavated, as will 400 sf of high ground for the east end of the basin. The road and septic will require the grading and filling of approximately 16660 sf of high ground. Another 2336 sf of high ground will be covered and incorporated by the shed and residence. The catwalk will be shade 68 sf of high ground. In total, the proposal will require the disturbance of 26,596 sf of area, resulting in a 2.5%built-upon area within the AEC. The proposed use of this project is private, and will serve as seasonal housing for members of the Core Banks Club, LLC. The applicant proposes to utilize this tract of land for the construction of a private hunt club facility with pier into Core Sound and a residence. Areas of Environmental Concern(AEC's) impacted by the proposal include Coastal Shoreline, Estuarine Waters, Public Trust Areas and Coastal Wetlands. Waters at the project site are classified as SA ORW and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 1999 Carteret County Land Use Plan Update and offer the following comments. The general area of the project is classified as Community, while the AECs impacted by the work are classified as Conservation. In general, Carteret County allows development in Conservation classified AECs which is consistent with the State's minimum use standards. However, the following concerns and comments are provided for DCM. Comments: A site visit was conducted on July 24, 2002. Inspection of the shallow bottom area under the proposed pier revealed patches of submerged aquatic vegetation (SAV). SAV has been shown to provide high quality nursery habitat for fishes and crustaceans (Heck and Orth 1980). Specific design characteristics for the proposed pier should be considered before the permit is approved. In cases from Florida as an example, guidelines have been placed on potential dock construction to minimize impacts to SAV, including minimum dock width, height, deck-plank spacing, and total square footage standards. In particular, seagrass presence was strongly correlated with dock height for docks ranging between 0 —5.5 ft. above mean high water (mhw) (Beal 1999). In an effort to provide adequate light for SAV, the proposed 4 ft. wide pier should maintain an elevation over mhw similar to the CAMA rule for minimum elevation over wetland substrate (> 3 ft.). Deck plank spacing (--0.5') could also allow light to reach beneath the pier. The cumulative impact of shading from increasing pier construction is a DMF concern. Also, since there are areas of patchy SAV and bare sand, the pier could be placed in the area with the least amount of SAV. Another concern is the impact from boating activity in the shallow water depths (-2 nlw) surrounding the pier. Turbidity and siltation over SAV and other sessile marine life will likely occur from dragged motor propellers. Extending the pier into deeper water is an option; however DCM should give serious consideration to existing fishing activity (gillnetting, skimmer trawling, crabbing, and long haul seining (the proposed area is used as a long haul seine footing area)) in that location. Stagnant, poor quality, subtidal habitat is a likely result from the dredging for the proposed boat basin. The boat basin should not be allowed to be dredged deeper than the connecting channel as per CRC rules. P.O. This region of Core Sound is open to shellfish harvest and is classified by the Environmental Management Commission as SA-ORW. As proposed, the camp includes a road access, a lateral canal extension and basin off a man-i>>ade canal, a residence, a boatshed, and a pier. The road will require tilling of 4384 square feet of wetlands and the excavation for the basin will affect 1600 square feet of wetlands. A 18 inch diameter culvert pipe wil l be placed under the roadway to maintain hydraulic connectivity of the wetlands on site. The canal extension and basin will be excavated to between 3.0 and 3.5 feet below the normal water level (NWL). The proposed pier is 4 feet wide and will shade wetlands and coastal marsh for a total of 90 linear feet and open water for 125 linear feet. Extensive beds of submerged aquatic vegetation(SAV) occur in the region of Core Sound along the project property. As proposed, the project may impact fish and wildlife resources in the area by reducing or degrading wetlands and aquatic habitat. A variety of juvenile fish and other aquatic organisms common in nearby marsh areas also utilize the man-made canal. Therefore, the NCWRC will not oppose issuance of a permit for this project if the following conditions, which we believe will minimize the project impacts, are attached to the permit: 1. The pier is elevated at least 3 feet above the marsh substrate and NWL to limit shading effects on the wetlands and SAVs. Water depth information was not provided on the project plat, so it is unclear whether 125 feet of over water pier is required to reach adequate water depths for boat dockage. Near-shore areas in this region of Core Sound are relatively shallow for an extensive distance from shore. Consequently, the NCWRC questions the length of the pier and the incremental gain in water depth provided by a 125 foot long pier. 2. Visible reflectors are placed on the waterward extent of the pier to minimize the navigation hazard posed by the structure. 3. Cutting of the marsh grasses or removal of other wetland vegetation, exclusive of the direct impacts from excavation and road construction, are prohibited. 4. The canal extension and basin should be segregated from the existing man-made canal with a berm or curtain during all excavation activities to minimize off-site turbidity and sedimentation. The final depth of the extension and basin should not exceed the depth of the man-made canal depth of—3.0 NWL to prevent areas of water stagnation in the basin. The use of the federal wetland area has met with positive comments from the US Army Corps of Engineers. Consequently, I think this is an appropriate use of the site.
