Covered Boat Basin 1) This permit authorizes the roof over the existing basin and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Courie Permit#126-03 Page 2 of 4 ADDITIONAL CONDITIONS The covered basin shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. 4) The authorized roof over the covered basin shall be single story, and shall not be designed to allow for second story use. 5) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity must not cause an unacceptable interference with navigation. 7) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. Boat Ramp 10) This permit authorizes the boat ramp that is expressly and specifically set forth in the permit application. 11) The concrete boat ramp must be poured on high ground and pushed or placed into the water. No live concrete may come into contact with the water. 12) No fill material will be placed at any time in any surrounding waters outside of the alignment of the boat ramp area indicated on the workplan drawings. Shoreline Stabilization 13) The alignment of the authorized bulkhead must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 14) The bulkhead alignment will approximate the mean high water level at the time of construction. 15) The bulkhead must be constructed prior to any backfilling activities. s Tony C. Courie Permit#126-03 Page 3 of 4 ADDITIONAL CONDITIONS 16) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 17) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other r suitable materials approved by department personnel. No excavation is permitted except for that which a may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 18) The backfill material will be clean and free of any pollutants except in trace quantities. 19) All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. Wooden Walkway 20) This permit authorizes the wooden walkway located landward of the permitted bulkhead that is expressly and specifically set forth in the permit application and depicted on the attached workplan drawing. 21) The permitted wooden walkway must not exceed six feet in width and shall be elevated and slatted. Sedimentation and Erosion Control 22) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 23) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 24) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Stormwater Management 25) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW8030506 on 8/28/03. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. General 26) No vegetated wetlands will be excavated or filled. 27) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. ti Tony C. Courie Permit#126-03 Page 4 of 4 ADDITIONAL CONDITIONS 28) The permittee understands and agrees that, if,future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property ,may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 030958. PROJECT SUMMARY: The applicant proposes to install a roof over an existing boat basin, add a boat lift within the basin, construct a boat ramp and boardwalk, and bulkhead the remaining shoreline. PROJECT DESCRIPTION: The project site is located at 471 Crow's Nest Lane, adjacent to a man-made canal off Charles Creek, within the community of Sneads Ferry,in Onslow County. To find the project from the intersection of Sneads Ferry Road and NC Highway 172,travel east on Sneads Ferry Road approximately 1.5 miles to Charles Creek Road. Turn left onto Charles Creek Road and travel approximately 1/8 mile to Crows Nest Lane(dirt road). Follow Crows Nest Lane to the end. The project site is-located on the left side of Crows Nest Lane. The applicant's property is located along a man-made canal which is tributary to Charles Creek and Chadwick Bay. The property encompasses approximately 0.12 acres and has approximately 76 linear feet of frontage along the canal. The property is flat and is vegetated primarily with lawn grasses. There are no existing structures on the highground portion of the property. There is an existing boat basin located approximately 15 feet from the western property line. This boat basin measures approximately 20 feet wide along the canal and extends landward approximately 24 feet. The boat basin is bulkheaded with a wooden bulkhead which is in need of some repair to the tie back system. The portion of the shoreline located to the east and west of the basin consists of an approximately 2 feet high bank which is devoid of costal wetland vegetation. The Onslow County Land Use Plan classifies the upland areas of the project site as Limited Transition.The waters of the man-made canal classified SA by the Division of Water Quality. The area is designated a Primary Nursery Area by the Division of Marine Fisheries and is closed to the harvesting of shellfish. PROPOSED PROJECT The applicant is proposing to add a boat lift within and to roof over the existing boat basin. The applicant is also proposing to construct a boat ramp,construct a wooden walkway along the shoreline and to bulkhead the remaining portion of the shoreline. The proposed boat lift would be located along the eastern side of the basin and would measure approximately 10 feet in length by approximately 13 feet in width. The roof would cover the entire basin and would measure approximately 20 feet by 24 feet.This structure exceeds the size allowance for boat houses under the CAMA General Permit 07H.1200 by 80 sq.ft.,hence the requirement for a CAMA Major Permit. The boat ramp would be located along the western property line and would measure approximately 12 feet wide by approximately 30 feet in width and would extend to approximately 10 feet below the mean high water(MHW)contour. The boat ramp would be constructed of two 15 feet concrete sections. The first section would be poured on high ground and pushed into place. The second section would be poured in place. Landward of the ramp the applicant is proposing an additional 15 feet of gravel drive. The remaining 41 feet of shoreline on the east side of the basin would be bulkheaded along the toe of the bank,approximating the MHW line. The proposed wooden boardwalk would begin approximately 5 feet from the eastern property line. The boardwalk would measure 6 feet in width and would run along the shoreline and around the eastern and northern portions of the basin for a distance of 85 feet, Along the western side of the basin the boardwalk would be 3 feet wide. The proposed boardwalk would be located entirely on high ground. 10. ANTICIPATED IMPACTS: The proposed boat lift and roofed basin area would shade approximately 480 sq.ft.of an existing high ground basin. The proposed boat ramp would result in the filling of approximately 120 sq. ft. of shallow bottom area within the canal. The proposed bulkhead,boardwalk,and upper portion of the boat ramp would disturb approximately 1,035 sq. ft. of high ground. The boat ramp would create approximately 420 sq. ft. of impervious coverage on the lot,or approximately 8.3%of the lot area within the 75'Estuarine Shoreline AEC and 8.0% of the entire lot area. Minor increases in turbidity can be expected during construction of the bulkhead and boat lift. The permittee shall at all times provide adequate erosion control measures in conformance with the approved Erosion Control Plan. 2. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. 3. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. Failure to abide by the conditions and limitations contained in this permit mayy subject the Permittee to an enforcement action by the Division of Water Qualityy, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The i ssuance of t his p ermit does n of p rohibit the Director f rom reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 5. The permit is not transferable except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. The approval of this request will be considered on its merits, and may or may not be approved. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act (G.S. 113A-100 through 113A-128). The applicant is seeking authorization to construct a roof over an existing boat basin and add a boat lift, boat ramp, boardwalk, and bulkhead along a canal leading to Charles Creek and Chadwick Bay. Primary vegetation at the site is mown lawn. Area waters are designated Primary Nursery Area(PNA). We expect jetting of pilings, construction of bulkhead, and installation of the boat ramp to elevate turbidity in a PNA. Mortality of sensitive early life stages of estuarine organisms could result. According to the field investigation report,the following Estuarine System Areas of Environmental Concern (AECs)will be impacted Public Trust Area;Estuarine Waters; and Estuarine Shorelines. Adjacent waters are classified SA, and designated as Primary Nursery Area(PNA). Waters are closed to shellfishing. This development proposal has been reviewed for consistency with the Onslow County 1997 Land Use Plan(LUP). This project is consistent with the LUP provided all local, state and federal regulations are met. The land classifications for this site are Limited Transition(upland area)and Conservation(AECs). The Limited Transition classification allows for controlled development with services. Uses permitted by the policies contained in the LUP and 15A NCAC 7H are allowed within areas designated Conservation. The following LUP policies are applicable: Bulkhead Construction Policy: Onslow County does not oppose bulkhead installation provided installation is consistent with 1 SA NCAC 7H(state guidelines for areas of environmental concern). Bulkheads must be constructed landward of significant marshland areas. Installation of bulkheads must not damage marshes. Estuarine System Policy: Onslow County's overall policy and management objective for the Estuarine System is "to give the highest priority to their protection and perpetuate their biological, social, economic, and aesthetic values, and to ensure that development occurring within these AECs is compatible with natural characteristics so as to minimize the likelihood of significant loss of private property and public resources." (1 SA NCAC 7H at.0203) In accordance with this overall objective, Onslow County will permit those land uses which conform to the general use standards of the North Carolina Administrative Code(1 SA NCAC 7H)for development within the Estuarine System with the exception of those policies contained in this plan which exceed the minimum state standards(see Section V.
