Therefore, in accordance with 5 :07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. New dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted project. 6) The permittee shall comply with the attached list of United States Coast Guard Regulations. Spoil Disposal 7) The size and location of the spoil disposal area must be inspected and approved by a representative of the Division of Coastal Management. The site must be flagged by a Division field representative for wetlands and buffer requirements prior to the reconstruction of containment dikes, and again inspected by a Division field representative prior to the commencement of any dredging activities. 8) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. .9) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or beyond the mean low water level to prevent gully erosion and unnecessary siltation. 10) The terminal end of the pipeline will be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended sediments. 11) A water control structure will be installed at the intake end of the.effluent pipe to assure compliance with water quality standards. 12) The diked disposal area will be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters. 13) The disposal area will be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 14) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 15) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. .le Cedar Creek Dredging Association Permit#9-03 Page 3 of 3 ADDITIONAL CONDITIONS 16) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, - diversion swales or berms, sand fence, etc.). General 17) The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity outside of the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant. 18) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 19) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 20) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3371 (DWQ Project No. 021838), which was issued on 12/12/02. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. 200300175. COAST GUARD REGULATIONS APPLICABLE TO DREDGE OPERATIONS Below is a list of regulations which are applicable to dredge operations in the COTP Wilmington zone. This list is not all inclusive. We encourage dredge companies to schedule a meeting with members of the USCG staff, in order to be provided amplifying information or answers to any questions that may exist. We also strongly encourage all Uninspected Towing Vessels (UTV) associated with each dredging operation to participate in the USCG's Voluntary Commercial Dockside Examination program. PROJECT SUMMARY: The applicants are requesting a permit to re-authorize the maintenance dredging of the Cedar Island Basin and entrance channel. Cedar Creek Dredging Association Page Two 9. PROJECT DESCRIPTION The project site is located at the end of Old Military Road, off Greenville Loop Rd., adjacent to the Cedar Island Basin and entrance channel (Cedar Creek), in Masonboro Sound, in New Hanover County. The Cedar Island entrance channel and boat basin were originally permitted and dredged in 1969 (Federal Permit #26-69 & State Permit #184). Maintenance dredging was performed in 1977 and again in 1989. Since the original permits had expired, the project was reviewed and updated prior to the work in 1989 (State Permit # 208-89). From the Atlantic Intracoastal Waterway (AIWW), the 1800' entrance channel winds through the adjacent Smooth Cordgrass (Spartina alterniflora) marsh on the southeast side of Cedar Island, before turning west and then north into the man-made boat basin on the backside of the island. The basin provides riparian access to both Cedar Island and mainland property owners. In the project area, the waters of Masonboro Sound are classified as SA-ORW (Outstanding Resource Water), by the NC Division of Water Quality, and they are OPEN to the harvest of shellfish. These waters are designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The applicants are a group of riparian property owners that are interested in obtaining the re- authorization to maintain the navigable water depths within their entrance channel and boat basin. The application proposes to dredge the 1800' entrance channel to a width of 30' and a depth of-6' at mean low water (MLW). The width of the entrance channel would fan out, from 30' to 60', over the last 300' of the channel as it intersects the AIWW. The project also proposes to maintain the 30' wide channel for approximately 400' into the boat basin. Current soundings in the project area indicate that existing water depths average -4' at MLW. The dredging is to be accomplished hydraulically. The material will be pumped to an existing spoil island, located just north and across the AIWW from the project site. The applicant has received approval from the property owner to use the site. The spoil area is rectangular in shape, approximately 300' long and 200' wide. Reconstruction of containment dikes, as well as, a water control structure, with adjustable flashboards, and an effluent pipe to carry the effluent to the mean low water line would be required prior to spoil deposition. 10. ANTICIPATED IMPACT This project would create the disturbance of approximately 70,500 square feet of shallow, sandy bottom. Approximately 6,500 cubic yards of material would be removed from the channel system, and placed on high ground on the spoils disposal island. The spoil area highground disturbance would be approximately 60,000 square feet. Temporary turbidity increases are to be expected during the dredging activity. Submitted by: E.F. The previous project was authorized at a 40' width and a depth of up to 7' at MLW, including a terminal flare to 200' in width. The site must be flagged by a DCM Representative, for wetlands and buffer requirements prior to the reconstruction of containment dikes, and again inspected by DCM prior to the beginning of any dredge activity. In order to protect juvenile shrimp and finfish populations, no excavation or filling will be permitted between April 1 st and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. 3. Michael Conard contacted you verbally regarding shifting the approved channel. The sole purpose for shifting the proposed channel was to provide additional separation between the proposed channel and Mr. Dan Flohr's existing bulkhead that is already in failure mode. Shifting the channel to the location indicated in McKim-Creed's Pre-hydrographic Survey dated May 13, 2003, would add 693 cubic yards of material which needs to be removed. We initially negotiated a contract with Carolina Marine to remove 6572 cubic yards of material from the channel shown in McKim-Creed's pre-hydrographic survey plan dated June 2002; plus the additional 693 cubic yards that resulted by shifting the channel further away from Mr. Flohr's failed bulkhead. The total amount of dredged material we have funds for totals 7265 cubic yards. McKim-Creed's Pre-hydrographic Survey dated May 13, 2003 indicated a total cut volume in the designed channel path to be 9010.6 cubic yards. We request our major dredging #9-03, be amended to allow a total of 9010.6 cubic yards of material to be removed. However, only 7265 cubic yards will be removed at this time. Carolina Marine's dredging log indicates that 93 barge loads of dredged material has been deposited on property owned by Mr. Charles Link, Dr. Joe James, Dr. Tom Pottle, Mr. Gene Willets and Quail Woods Boating Facility's property. Verbal approval was obtained prior to placing the material. None of this material has been spread. The.total amount of material equals 2790 cubic yards based upon the dredgers estimated average barge capacity of 30 yards per load. We request our spoil area location be amended to include the areas indicated on the aerial photograph that is made a part of this letter. The space available is noted on the aerial photograph. According to our post hydrographic survey, the contractor has removed 5358.5 cubic yards of material from the prescribed channel path. An additional 1886.6 cubic yards needs to be removed from the prescribed channel width and depth to meet the contract yardage of 7245.1 cubic yards. Dr. Bill Eakins and Dr. Tom Pottle have space on their property to accept the material. We request the approved spoil area be modified to include these areas. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters. 9. No vegetated wetlands will be excavated or filled. 10. Excavation will not exceed 6 feet below the elevation of mean low water(MLW). 11. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 12. Dredged spoil material will be deposited on an existing spoil island located just north of the project site, and east of the AIWW. According to the DCM Field Investigation Report, maintenance dredging has been historically conducted, and was previously permitted under State Permit#208-89 (issued 1989). The project site is located at the end of Old Military Road, off of Greenville Loop Road within the unincorporated area of New Hanover County. Cedar Island Basin and the associated entrance channel are located adjacent to Masonboro Sound. The DCM Field Investigation Report states that Estuarine Waters and Public Trust Area Areas of Environmental Concern(AECs)will be impacted by the proposed project. Waters at the site are classified SA-ORW, and are open to shellfishing. Waters at the site are designated as a Primary Nursery Area(PNA). This development proposal has been reviewed for consistency with the Wilmington—New Hanover County CAMA 1997-2010 Land Use Plan Update and Comprehensive Plan(LUP), as amended. The purpose of the Conservation classification is to provide for the effective, long- term management and protection of significant, limited or irreplaceable natural resources while also protecting the rights of the property owner. L UP Resource Protection Policy 4.9 states, allow uses of estuarine and public trust waters that provide benefits to the public and which satisfy riparian access needs ofprivate property owners. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. By copy of this letter,we are informing you that your project will not require a stormwater management permit. If the subject project disturbs five acres or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. The stormwater rules require the Division to permit the common plan of development, therefore, any future development on the property, regardless of whether a CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Water Quality prior to any construction.
