This permit, issued on July 17,2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the expansion of the existing floating dock and installation of the new boatlift located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 3) The authorized structure and associated activity must n t cause an unacceptable interference with navigation. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Carlson Permit#95-03 Page 2 of 2 ADDITIONAL CONDITIONS 4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The permittee will maintain the authorized work in good condition and in conformapce with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized. 8) This permit authorizes a maximum of 3 boat slips. At no time shall more than 3 vessels be moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. NOTE: With the exception of the pilings for the boatlift structures, the permittee is cautioned that this permit does not authorize the placement of new tie piles in association with the docking facility. The placement of such tie pilings will require a modification of this permit. Furthermore, due to the proximity of the AIWW, boats utilizing the docking facility will be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. General NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 030775. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 197800056 (COE Action Id. No. 200300984) which was issued on 7/11/03. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. PROJECT SUMMARY: The applicant proposes to extend the existing floating dock and construct a new boatlift. V Steven Carlson Page 2 9. PROJECT DESCRIPTION: The project site is located at lots 6A and 6B along Pine Avenue (off of Avalone Drive, which is off of Edgewater Drive), adjacent to Page's Creek and the Atlantic Intracoastal Waterway(AIWW), in Wilmington,New Hanover County. The lot is 140 feet wide and approximately 280 feet in depth from Pine Avenue. The lot averages 15-18 feet above mean sea level. The applicant maintains a single-family residence on the property and vegetation consists of lawn grasses, ornamental shrubs, live oaks and longleaf pines. There is an existing private pier(90' long and 6'wide) located along the center portion of the eastern shoreline. A 20' x 12'platform and a 24' x 8' floating dock are located on the south side of the pier. The existing pier,platform and floating dock are located within a small basin located just to the north of the northern entrance to Page's Creek near the confluence with the AIWW. The New Hanover County Land Use Plan classifies the waters of the AIWW, in the vicinity of the project site as Conservation, and the adjacent high ground area as Developed. The waters in the project area are classified as SA-ORW by the N.C. Division of Water Quality. They are NOT designated as a Primary Nursery Area(PNA)by the N.C. Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish. The applicant proposes to extend the existing floating dock approximately 14' towards the east and construct a new 13'x 13'boat lift. The proposed boat lift will be positioned between the existing platform(to the north) and the proposed floating dock, located to the south. The new construction would incorporate approximately 281 sq. ft. of open waters within the AIWW. The proposed reconstruction/addition would add one (1) new boat slip and approximately 14' of available dockage space to the existing floating dock. Overall, the structure could provide docking space for up to three vessels. Water depths in the vicinity of the project area range from 3', along the western edge of the proposed work, to 4.5'just east of the terminal end of the proposed boat lift, to 18', near the center of the AIWW (approximately 175' from the terminal end of the proposed boat lift) at low tide. 10. ANTICIPATED IMPACTS The proposed construction of the boat lift and the expansion of the floating dock would incorporate approximately 281 sq. ft. of Public Trust Area. Minor turbidity levels can be expected during piling installation, however, no long term adverse impacts are anticipated. The pier and dock addition are within 1/4 width of the channel and no navigational impacts are expected. The work will be performed within the 15 riparian corridor to the north, however the applicant has received approval for the adjoining property owner allowing work within the corridor. Submitted by: J.Dail Date: 6/18/2003 Office: Wilmington Recommendations for State Permit- Carlson 6/18/2003 The proposed expansion of the floating dock and boatlift does not exceed the CAMA regulatory allowance for pier platform and finger pier square footage for a lot this size. The floating dock would provide an additional 14' of dockage area and the boatlift would create one (1) additional slip. I have no objections to the proposed project. Any permit issued should include the following conditions: 1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non-water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation and shall not exceed the Wrightsville Beach Pierhead Line. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. This permit does not authorize the interference with any existing or proposed Federal project, and, the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. We regret that time constraints delayed our response. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act (G.S. 113A-100 through 113A-128). The applicant is seeking authorization to extend an existing floating dock and construct a new boatlift at his residence on the AIWW. A margin of high quality coastal wetlands occurs along the shoreline and area waters are classified SA-ORW. We anticipate some turbidity-related water quality decline from the project as pilings are jetted into bottom sediments. To minimize the impacts of elevated turbidity on sensitive estuarine waters and dependent biota,we recommend that work avoid the April 1 to September 30 period of peak biological activity. This addition will provide dockage for up to three (3) boats. The project site is located in the unincorporated portion of New Hanover County at Lots 6A & 613 of Pine Avenue, and adjacent to Page's Creek and the Atlantic Intracoastal Waterway (AIWW). According to the Division's Field Investigation Report, work will occur within the Public Trust Area and Estuarine Waters Areas of Environmental Concern (AEC). Waters at the site are classified SA-ORW, are closed to shellfishing, and not designated as Primary Nursery Area (PNA). This development proposal has been reviewed for consistency with the Wilmington — New Hanover County CAMA Land Use Plan (LUP) Update and Comprehensive Plan (1997-2010), as amended. The land classifications for this site are Conservation (AECs) and Resource Protection (upland portion of the site). The purpose of the Conservation classification is to provide for effective long-term management and protection of significant, limited or irreplaceable natural resources while also protecting the rights of the property owner. Water-dependent uses, including (but not limited to) docks, are allowed within this classification. The purpose of the Resource Protection classification is to provide for preservation and protection of important natural, historic, scenic, wildlife and recreational resources. This land classification includes lands adjacent to estuarine waters which are classified SA by the NCDENR. LUP Policy 4.9 states, allow uses of estuarine and public trust waters that provide benefits to the public and satisfy the riparian access needs of property owners. In tidal waters, docks shall be limited to the minimum necessary to provide riparian access to waterfront property owners.
