PROJECT SUMMARY: The applicants propose to construct an R/V park with 28 spaces for seasonal rental use. Field Investigation Report: Cape Lookout R/V Park C/o Mr. Ron Loftis and Mr. Harold Gurganus Page 02 --------------------------- _ 1 9.NARRATIVE DESCRIPTION: This property is a 3.12 acre tract previously occupied by a single residence and mobile home. The site is located on the north side of Island Road (SR 1335) on Harker's Island, Carteret County. Harker's is bound by West/East Mouth Bays on the north side, and Back Sound on the south side. The island is primarily residential in nature, with small family businesses supporting the local economy. The subject property has recently undergone clearing that is statutorily exempt from permitting requirements. That is to say, trees have been cut with minimal ground disturbance. On the south and north sides of the property, the elevations are low, and conducive to ponding. Mr. Mickey Sugg with the US Army Corps of Engineers has made the determination that any wetlands present are isolated and non jurisdictional (on file). The soils on site are sandy, primarily vegetated with pines and oaks. Toward the north end of the property in the area of the isolated wetlands, the vegetation expands to White Bay, Fetterbush, American Holly, and Sassafras. The waters of Back Sound carry a DWQ classification of SA-ORW; the area is open to the taking of shellfish for consumption, and is not designated as Primary Nursery Area. The Carteret County Land Use Plan classifies this area as Limited Transition, with all AEC's classified as Conservation. The applicant has applied for and received Sedimentation/Erosion Control approval (CA 02204), Stormwater approval(#SW8-020432), approval to tie into the municipal water supply (04-16-025) and a CAMA General Permit to install same (33164-C), Driveway access authorization from NC DOT (D-2202029), and septic approvals dated 8/06/02. The proposal at hand is to clear, grade, and develop the infrastructure for an R/V Park. Approximately 2.75 acres will be graded, and a loop road installed with asphalt surface. The entrance road will be 25'-30' in width, with a 20' improved travel way. The remainder of the loop will be 14' of improved surface within a 16' right of way. Infiltration basins, 200' in length, are proposed for the east and west sides of the loop road. Road shoulders will slope (1:3) into these features. Two septic treatment facilities will be installed within the area proposed for disturbance in the center of the loop road. Sites are designated for 28 campers, and water will be. provided through the municipal water supply. Finished impervious area shown on the submitted plats is approximately 23% within the 575' AEC. The existing residence is intended to be converted into a park store and bathhouse. 10. ANTICIPATED IMPACTS: The project will require the grading of approximately 2.75 acres of high ground and isolated wetlands for commercial use. The greatest impact will be the result of having a higher density use than is typical for the island. Odom, P.L.S., Prestige Land Surveying as my agent to provide any needed information and submit C.A.M.A. application for above project. on oft' Cape Lookout RV Park April 22, 2002 Harkers Island, North Carolina NARRATIVE: Cape Lookout RV Park is a proposed development planned on SR 1335 (Harkers Island Road). The size of the tract of land is 3.12 acres. There is an existing residence on the property which will be used as an office and a bath house for residents. The proposed street system will be one way traffic on a 16 foot wide right-of-way. The proposed street will be constructed in the shape of an inverted crown. The pavement width will be 14 feet. The tract of land is situated on the north side of SR 1335. The water course located to the south is Back Sound, classified as SA-ORW. There is no outlet drainage on this tract. There will be one way traffic on the street. The street system is set at .5% grade, with a high point located at the north quadrant point of the street, set at + 10.5 feet. The adjoining land is higher at this point with spot elevations exceeding +11 on Lots 11 & 12. Lots 7, 8, 9 & 10 require fill, but less than a foot in all places. Fill for the development is available on-site in two areas which will collect the storm water runoff and treat it with infiltration. The sewer system requires two parcels be cleared and low pressure lines installed. Only those two land masses will be cleared, the remaining will be left undisturbed. See map for masses notes. Each infiltra ion basin has been sized to accept the flow of a 3 inch event. The western basin is 30 feet wide and 190 feet long. The eastern basin is 30 feet wide and 200 feet long. The volume for storage is based on equal flow to the basins, and each has a bottom elevation of 8.95 feet. This can vary as required for more or less storage. The bottom elevation is 9 inches lower than the inlet elevation. The overall storage is slightly more than required for the 3 inch event. The bottom of the infiltration basin shall remain with no silt, no topsoil, only native sand. It is imperative that the bottom of each basin be left without sealing from ability to infiltrate. At the entrance of both basins, on both ends of both basins, a temporary sediment basin has been designed to handle 1,800 cf/acre disturbed in the construction. The temporary basins are 25 feet square, 2 feet deep. These temporary sediment traps will eventually be filled when construction is complete and vegetation has been established. A topographic survey has been prepared by Prestige Surveying. The FEMA classification for flood hazard is shown on the attached map. ADJACENT PROPERTY: The property on the west has been cleared and a residence has been built. On the north and east side there are native woodlands (not cleared). SOIL CONDITIONS: The property has been evaluated by Land Management Group, Inc. (Larry Baldwin, CPSS. A copy of his report has been included herein. Soil types Seabrook and Mandrin-dry phase were identified in an area planned for infiltration basin # 1 (West). Mandrin and Leon-dry phase were identified for infiltration basin # 2 (East). The seasonal high water table was identified as being from 35" to 55" below the surface of the ground. Permeability has been set at 2-6 inches per hour. DEVELOPMENT NOTES: The owner intends to obtain Carteret County Planning Board Approval in May. There will be no work done until DENR permits are obtained from Land Quality and Water Quality. The Carteret County Environmental Health Division has evaluated the land for septic permits. There will be two large systems which collect the effluent and dispose of it through low pressure pipe systems. A DOT entrance permit will be obtained for access to SR 1335 across an existing driveway to the existing residence which will be used as an office and bath house. Water supply for the Cape Lookout RV Park is being requested from Harkers Island Water Corporation. The owners plan to selectively clear for RV sites. Although clearing is necessary for the street, the owners plan to save as may oak trees as they can be carefully selecting sites. The septic system requires two active sites and two repair sites. The repair sites will NOT be cleared, but left with a canopy from existing trees as much as possible. Excavation, Filling and Roadway construction. As much as possible, all material to be excavated will be used in areas noted on plans to build up adjoining lots. The owners have been extremely cautious with respect to wholesale clearing. All work will be monitored carefully to ensure no clear cutting is done. The construction of the infiltration basins will be monitored to make certain no topsoil or silt is allowed to be placed in the basins. It is imperative that sandy soil is the medium in the bottom of the basins. PLANNED SEDIMENTATION & EROSION CONTROL PRACTICES: 1. Construction Entrance See detail on drawing. Clean washed rock will be used in the entrance. 2. Temporary Sediment Retention Basins (4) See details on drawing. There is at least one basin at each corner of each infiltration basin. The Temporary Basins are to be 2 feet deep, 25 feet square. 3. Rock Check Dams Rock check dams are provided at the four corners of the infiltration basins as detailed on the drawings. 4. Silt Fences A silt fence will be used to protect adjoining property. It will be erected as shown on the drawings. 5. Driveway pipe: None. The DOT has no roadside ditch along SR 1335. MAINTENANCE MEASURES: The rock check dams require monitoring for sediment accumulation. If evidence of silt is found at the check dam areas it shall be removed. Grass is a critical measure for all sediment control. If grass is found to be ineffective, other temporary measures shall be used to control sediment. These additional temporary measures could be more check dams or additional silt fence. When ground cover is established, the siltation will be controlled. It is equally important to monitor the temporary sediment basins for accumulation of sand/silt. When it becomes obvious that at least 20% of the temporary basins are filled, they will be excavated and graded to original construction conditions. NAME OF RECEIVING WATERS There is no outlet from this project to adjoining wetlands, marsh, water, streams, etc. TEMPORARY BENCH MARK There shall be a temporary bench mark set in each basin at the north and south end with the elevation of +9.5 clearly marked. When this elevation is reached, it is time to remove the sediment. This project was originally permitted on July 24, 2002, for 26 RV spaces, an office & bathhouse, a 16' wide inverted crown road, and 2 infiltration basins, each with a proposed bottom elevation of 8.95 FMSL. On or about February 13, 2003, the Division of Water Quality received a copy of a CAMA Major Permit application for the Cape Lookout RV Park. This application indicated that there were 28 proposed RV spaces, which was 2 more than the Division had permitted. On February 14, 2003, the Division sent Mr. Loftis a letter informing him that a modification to the stormwater permit was required to address this discrepancy. This letter was copied to Ms. Tere Barrett in the Morehead City office of the Division of Coastal Management. On March 12, 2003, the Division received the permit modification package for Cape Lookout RV Park. While the modification is in review, the conditions of the original permit remain in effect. In the meantime, CAMA continued its review of the CAMA Major application. It is not unusual for CAMA to issue its permit with conditions that require approvals/permits from all other agencies to be in place before the permitted work can begin. Additionally, only work within 575' of the ORW AEC is covered by the CAMA permit. This may help explain why the construction was continuing in other parts of the project while the CAMA Permit was in process. On July 1, 2003, 1 inspected the project. My comments regarding this inspection are included in an email I sent to Mr. McLean on July 2, 2003, copy enclosed. This is the only documentation of this inspection. To summarize, I saw an earthern berm located along the lower edge of the road adjacent the infiltration basins, which forced the runoff from the site to enter the infiltration basins at specific points, vs. the swale and sheet flow condition shown on the revised plans. I also saw that the low area, which is shared with the adjacent property, had not been filled in as shown on the revised plan, but instead, Mr. Loftis installed a pump in that area, and told me he intended to install a catch basin in the low spot and pump everything into the infiltration basins. Both basins were dry. The plans were revised to remove the earthen berms and to fill in the low spot. I do not recall any of the particulars regarding Mr. Loftis' decision to fill the low spot rather than install a catch basin and pump, however, had a catch basin been proposed, I would have told Mr. Loftis that it would be necessary to increase the size of Basin #2 in order to account for the offsite runoff that would enter the catch basin from any of the adjacent properties. Basin #1 increased its treated built-upon area from 16,750 ft2 to 19,548 ft2, while Basin #2 decreased its treated built-upon area from 18,250 ft2 to 16,608 ft2. The bottom elevation of Basin #1 was also deepened from 8.95 FMSL to 8.75 FMSL. Calculations submitted by Mr. McLean indicate that the basins are sized to provide sufficient volume to meet the 1.5" design rainfall requirements of infiltration. Gary Beecher's June 7, 2005, inspection, copy enclosed, was conducted only a day or two after a 6-8 inch rain, and indicated that the infiltration basins were full. It was decided that another inspection would occur after 5 straight days without rain, in order to determine if the basins are drawing down within the required 5 day time frame. The infiltration basins were designed and permitted to handle the State-required minimum of 1.5" of rain, so it was not unexpected that the basins were full. On November 20, 2003, John McLean, P.E., certified to the State that the project had been built within substantial compliance of the permit conditions and the approved plans. Until the re-inspection of the basins occurs after the next 5 rain-free days, the Division is unable to make a determination as to the project's compliance status. The stormwater application for this project indicates that there is no offsite drainage. The plans prepared by Mr. McLean and submitted to the Division show only that a low spot existed on the Loftis property at elevation 7.7. Based on the scant topographic information on the approved plans, it appears that a low area may have straddled both the Wall property and the Loftis property. It also appears that the filling of the low spot on the Loftis property is keeping the runoff generated by the Wall property from draining onto the Loftis property. Flooding is an issue that is not addressed in the stormwater permit, and which the Division has no jurisdiction over. If flooding is to be regulated, it must be done at the local government level. The NC Legislature has neither formulated flood control rules nor charged the Division with the responsibility of reviewing plans to make sure adjacent properties are not being flooded by the development of the permitted property. The road adjacent the infiltration basins will NOT be sheet-flowing into the basins. There is a 1.5' high earthen berm that is preventing sheet flow from entering. All runoff appears to be directed to the ends of the basin. Additionally, the lot area beside the house, where there was supposed to be about 2' of fill, will be left alone. Mr. Loftis has installed a pump, and wants to construct a catch basin in the low area and pump all the runoff into the infiltration basin. The revised plans you worked on are no longer the proposed condition. Please talk to your client, visit the site, and get everything straight. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. At least 30 days prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name,mailing address and phone number of the purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be granted iri favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 13. The permittee must maintain compliance with the proposed built-upon area and ensure that the runoff from all the built-upon is directed into the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 15. The permittee must maintain the current permitted drainage area. No additional runoff from outside of the permitted drainage area boundary may enter the permitted stormwater facilities without first applying for and receiving a permit modification. III. GENERAL CONDITIONS I. This permit is not transferable except after notice to and approval by the Director. In the event of a change of owership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The applicant has met stormwater and sedimentation/erosion control requirements, and has received authorization for the installation of septic, water, and driveway access. The fact that a portion of the tract falls within 575' of the ORW waters of Back Sound, and that DWQ and DLQ permits are needed, necessitates review under the CAMA Major Permit process. Assuming that the proposed methodology is implemented, only short-term direct impactsshould be noticed from the development. Long-term impacts are in the form of the changing ambiance of the island. I recommend the project be authorized as proposed, contingent upon the following conditions: 1) This development was approved and authorized under Sedimentation/Erosion Control Permit #CA02204.
