This permit, issued on May 19, 2003 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Upland Development 1) This permit authorizes only the filling of 404 wetlands, construction of a single-family residential structure, installation of the associated septic system and construction of a gravel driveway that is expressly and specifically set forth in the permit application and depicted on the attached workplan drawings. 2) In accordance with T15A:NCAC.07H.0209(d)(2), "Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively demonstrate, through design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation." Therefore, any redesign of the permitted development that would increase the impervious surface coverage will require a modification of this permit. The permittee shall contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Isbrecht Permit#66-03 Page 2 of 3 ADDITIONAL CONDITIONS 3) The installation of the septic system shall be done in accordance with the Improvement Permit (71602- 3) issued by Hyde County Health Department on 7/16/02. 4) No fill material will be placed at any time in any vegetated wetlands outside of the alignment of the fill area indicated on the workplan drawings. 5) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 6) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. NOTE: In order to avoid unreasonable danger to life and property, all development should be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100 year storm. Any building constructed should comply with the North Carolina Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. The building code or flood damage prevention ordinance may impose additional more restrictive requirements than the Division's standards for development in areas of environmental concern (AECs). Sedimentation and Erosion Control 7) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 8) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 9) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Water Quality 10) The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3400 (DWQ Project No. 030303), which was issued on 4/7/03. Any violation of the water quality certification issued by the DWQ will be considered a violation of this CAMA permit. 11) The N.C. Division of Water Quality has authorized the proposed project under an Approval of Tar- Pamlico River Riparian Buffer Protection Rule Minor Variance (DWQ Project No. 030101), which was issued on 2/5/03. Any violation of the conditions of the approved minor variance, including the mitigation requirements, issued by the DWQ will be considered a violation of this CAMA permit. f Celia E. Isbrecht Permit#66-03 Page 3 of 3 ADDITIONAL CONDITIONS 12) In accordance with the requirements of the DWQ Minor Variance, the permitee is required,to mitigate for impacts to 1,080 square feet of riparian buffer. Prior to the initiation of construction activities, the permitee shall provide a copy of the compensation approval letter from the NC Wetland Restoration Program (NCWRP) to the Division of Coastal Management. NOTE: The permittee is advised that any development or land disturbing activity that is considered non- water dependent is not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission (EMC)Tar-Pamlico River buffer regulations in place at the time of such development. General NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit No. 18 (COE Action Id. No. 200310457) which was issued on 4/7/03. PROJECT SUMMARY: Applicant proposes to fill and grade an area of 404 wooded wetlands±30' x 50' for the purpose of constructing a 32' x 40' pile supported single family residence. The applicant also proposes to construct an±8' x 40' gravel driveway and install a septic tank system. Donna Boor Ocracoke Island Hyde County Project Seiting The project site is located off SR 1375 (Cuttin Sage Lane) on the east side of Ocracoke Island on a man made canal (locally known as Oyster Creek) off the Pamlico Sound on lot number 39 of the Oyster Creek Banks subdivision in Hyde County, North Carolina. The site is an undeveloped 53' wide (along canal) x 100' deep residential lot. The vegetation on the lot consists mainly of live oak and eastern red cedar. The neighboring lot on the south side is developed with a single-family residential structure while the adjacent lot on the north side is undeveloped and similarly vegetated. The project site is ±4' above the normal water level (NWL) with the exception of an area of low elevation with sloping sides, nearly bowl shaped, located 40' landward of the NWL. This area has been delineated as section 404 wetlands by the U.S. Army Corps of Engineers (USACOE). This delineated wooded 404 wetland is 30' wide and runs the entire width of the lot extending across the property line on the north side and across the other undeveloped lot. The wooded 404 wetland area is vegetated predominately with yaupon, red bay, palmetto, wax myrtle and eastern red cedar. The area delineated as wooded 404 wetlands on the undeveloped lot to the north has been recently cleared. The depression appears to have resulted from the removal (borrowing) of fill material possibly to construct the adjacent subdivision road due to its somewhat uniform shape and juxtaposition to the surrounding topography. The grade transitions back to highground before reaching SR 1375. CAMA/Dredge and Fill General Permit No. 32667-B issued on 8 January 2003 authorized the construction of a bulkhead and a 6' wide x 50' long dock at the project site. As of 5 March 2003 only the bulkhead had been constructed. Pamlico Sound on the east side of Ocracoke Island is classified as SA Waters by the Environmental Commission and is open to shell fishing however the canal system of the Oyster Creek Banks subdivision is closed. Project Description The applicant proposes to fill the 404 wetlands, approximately 30' x 50% on the lot to level the grade for the purpose of constructing a pile supported 32'x 40' single-family residence. The residence is to be constructed 30' landward of the normal water level. There will be an 8' x 32' covered porch on the waterward/canal side of the house. The applicant has a Minor Variance to the Tar-Pamlico River Riparian Buffer Rules for the construction of the home. A septic system is to be located between home and SR 1375. The applicant has received approval for the system from the Hyde County Health Department. The applicant is proposing to fill an ±8'wide x 40' gravel driveway to facilitate parking underneath the proposed residence. Project Impact The project as proposed will result in the filling of±1,500 ftz of 404 wooded wetlands within the 75' Estuarine Shoreline. The installation of the Qravel driveway and septic system will result in the disturbance of±1,520 ft' of uplands. The project as proposed will result in ±36.5% impervious surface coverage within the 75' Estuarine Shoreline. Per North Carolina Administrative Code 15A NCAC 07H.0209(d)(2), impervious surfaces shall not exceed 30 percent of the Estuarine Shoreline AEC area of the lot, unless the applicant can effectively demonstrate through design that the protection provided by the design would be equal to or exceed the protection provided by the 30 percent limitation. Division policy is to require certified engineered storm water management plans for projects exceeding the impervious surface standard in the Estuarine Shoreline AEC. In order to resolve this, there are two options: reduce the size of the proposed home to comply with the 30 percent impervious standard, or submit a certified engineered storm water management plan. This issue needs to be resolved as soon as possible to prevent delay in issuance of the permit, and/or could result in permit denial for the proposed home construction. The project will require the filling of±1,500 ft2 of wooded 404 wetlands within the Estuarine Shoreline AEC thus has tripped the major permit trigger. This lot is adjacent to lot 40 subject of the major permit application submitted by Celia E Isbrecht. The USACOE has delineated the site and has indicated to me that the project will qualify for a nationwide permit. A review of the proposed home construction indicates to me that she exceeds the 30%impervious surface standard (36.5%). As discussed on 10 March 2003,I will notify Ms.Boor in writing of the Division policy to require storm water management plans for projects exceeding the impervious standard in the Estuarine Shoreline(see Attached Letter). She will have two options,either submit a revised project proposal reducing the amount of impervious surface coverage or submit a engineer certified storm water management plan. If Ms.Boor fails or refuses to comply with either option I recommend that we condition the home construction out of the permit. I will copy you with this letter for your file. Ms. Boor has received a Minor Variance from the Division of Water Quality for the construction of the home in Zone II, the home will setback off the canal 30'. The applicant has mailed the application package to the adjacent property owners certified mail return receipt requested and has indicated that she will send the signed green cards upon receipt. Diffuse Flow Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as identified within 15A NCAC 2B .0259(5). Roof drainage from the new addition shall be directed to vegetated areas at non-erosive velocities prior to entering the protected riparian buffers. No new direct discharges of stormwater(i.e., piping, ditching, etc.) through the buffers is allowed. 4. Deed Notifications Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate.
