This permit, issued on February 25,2003 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the addition to the existing finger pier, and a new boathouse located in or
over the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, may become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) The pier, boathouse and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor.
4) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. Footprint of the boathouse shall not exceed 400 square feet.
5) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
6) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the
public's right to free navigation on all navigable waters of the United States.
7) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
8) The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
9) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
10) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
11) This permit authorizes a maximum of 2 boat slips. At no time shall more than 2 vessels be moored or
docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types,
including but not limited to motorboats, sailing vessels and personal watercraft.
NOTE: The permittee is cautioned that this permit does not authorize the placement of new tie piles in
association with the docking facility.

12) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination.
NOTE: The permittee is advised that any development or land disturbing activity that is considered non-
water dependent is not authorized within 50 feet of the normal high/low water level unless
specifically exempted by Environmental Management Commission (EMC) Neuse River buffer
regulations in place at the time of such development.
NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No.
030062.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No.
200310367.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original(buff-colored form) is retained by you
and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of
appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or 113-
229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on
your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit
within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the
final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out
in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.
Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work
done by a contractor,it would be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit,you will be helping to protect our vitally important coastal resources.

2' edge to the existing 4' by 20' finger pier and construct a 30' by 15' boathouse adjacent to the
existing pier.

Project Setting
The applicant owns a 1.9 acre parcel of land adjacent to Dawson Creek near Arapahoe in
Pamlico County, North Carolina. The property is located off NCSR 1306 at 276 Dawson Creek
Drive.The site is a developed residential lot that is vegetated with a mix of pines,upland grasses and
scattered oaks. The property used to contain a single-wide mobile home that was recently removed
from the lot. Elevation of the property is 10 feet above the normal water level. The water is
approximately 4 feet deep at the end of the pier structure. The applicant has an existing 5'x 80' pier
with a 30'x 9' L-head. Adjacent to the pier is a 15'x30' slip with a 4' by 20' finger pier.
The property is located in a small residential neighborhood on the west shore of Dawson
Creek.The properties to the north and south of the project area are developed lots with single-family
residences.Both properties have private piers with slips for two vessels. The shoreline in this area is
natural and contains several areas of coastal wetlands extending from the creek, landward
approximately 100 to 200 feet.Uplands on the lots are vegetated with landscape plants,mixed pines,
upland grasses and scattered hardwoods.
At this location, Dawson Creek is classified SA HQW NSW by the Environmental
Management Commission.The property is located in the Neuse River Basin. The waters are closed
to the harvesting of shellfish.
Project Description
The applicant proposes to construct a 6' by 10' addition to his existing finger pier and add a
2' edge to the existing 4' by 20' finger pier. The finished dimensions of the finger pier would be 6'
by 30',bringing the total platform square footage to 480 square feet.The applicant also proposes to
construct a 30' by 15' boathouse adjacent to his existing pier. The proposed boathouse would be
placed entirely inside an existing boatslip.
Anticipated Impacts
The project as proposed would impact 670 ft2. The boathouse and finger piers would shade
570 ft2 of creek bottom and would result in the usurpation of an additional 100 ft2.As proposed,the
entire pier structure would provide permanent slips for two vessels. Short-term localized turbidity
would result from construction.

APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Mr. and Mrs. Conkwright:
You have our approval, in accordance with the attached conditions,to shade and usurp 0.01 acre of non-vegetated wetlands in
order to construct an addition to your fishing pier and a boathouse in Dawson Creek on your property in Pamlico County,as described in
your application received by the Division of Water Quality on January 22,2003. After reviewing your application,we have determined that
this fill is covered by General Water Quality Certification Number 3371,which can be downloaded from our web site at
htto://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal
Management. In addition,you should get any other federal,state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Non-Discharge,Water Supply Watershed and U.S.Coast Guard regulations. Also this approval
will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold,the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project(now or in the future)exceed one acre,compensatory mitigation may be required as described in 15A NCAC
2H .0506(h). For this approval to be valid,you must follow the conditions listed in the attached certification and the additional conditions
listed below:
1. You are required to return the attached Certification of Completion form to notify DWO when all work included in the 401
Certification has.been completed;
If you do not accept any of the conditions of this certification,you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing,send a written petition conforming to Chapter 150E of the North
Carolina General Statutes to the Office of Administrative Hearings,6714 Mail Service Center, Raleigh, N.C.27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.

project on January 21, 2003. Staff review of the plans and specifications has
determined that the project, as proposed, consists of activities that will not
pose surface water quality threats from stormwater runoff. The Director has
determined that projects that are reviewed and approved by the Division as not
posing water quality threats from stormwater runoff should not be subject to the
stormwater management permitting requirements of 15A NCAC 2H.1000. For this
} reason, we are informing you by way of this letter that your project will not
require a stormwater management permit.
Please keep in mind that this determination does not affect your legal

Dear Mr. Huggett:
Reference the application of John Conkwright for a Department of the Army permit to
construct a boathouse and expand an existing pier, on property located at 276 Dawson Creek
Drive, adjacent to Dawson Creek, near Arapahoe, in Pamlico County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
permit plans, which are a part of this permit.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters,the
permittee will be required, upon due notice from the Corps of Engineers,to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States. No
claim shall be made against the United States on account of any such removal or alteration.
3. No attempt will be made by the permittee to prevent the full and free use by the public of
all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.

The applicants' property is located in Pamlico County at 276 Dawson Creek Drive, on
Dawson Creek near Arapahoe. The applicant proposes to construct a 6' by 10' addition to
his existing finger pier, add a 2' edge to the existing 4' by 20' finger pier and construct a
30' by 15' boathouse adjacent to the existing pier.
Areas of Environmental Concern (AEC's)impacted by the proposal are Estuarine
Waters, Public Trust Areas. The Waters at the project site are classified as SA HQW
NSW and are not open to the harvesting of shellfish. The area is not a Primary Nursery
Area.
I have reviewed this proposal for consistency with the 1992 Pamlico County Land Use
Plan and offer the following comments.
The general area of the project is classified as Rural With Services, while the AECs
impacted by the work are classified as Conservation.
In general,Pamlico County allows development in Conservation classified AECs which
is consistent with the State's minimum use standards. The Pamlico County Plan contains
some local policies which exceed 7H guidelines including those for Marina and Floating
Home Development. However, none of these more restrictive local standards appear to
be applicable to this project.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the 1992 Pamlico County Land Use Plan.

I have reviewed the application for a CAMA Major Permit submitted to this office by Mr.
John Conkwright in regards to the rules and regulations adopted by the CRC, specifically NCAC
7H.0206, .0207, .0208, and .0209. My review indicates that, overall, the proposal appears to be
consistent with these regulations. I recommend that the permit be issued with the following
conditions:
1) The authorized structure and associated activity must not cause an unacceptable
interference with navigation.
2)The permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this
requirement if he abandons the permitted activity without having it transferred to a third
partY-
3) The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized
facilities. At a minimum,permanent reflectors should be attached to the structure in order
to make it more visible during hours of darkness or inclement weather.
4) No sewage, whether treated or untreated, shall be discharged at any time from boats
using the docking facility. Any sewage discharge at this docking facility shall be
considered a violation of this permit for which the permittee is responsible. This
prohibition shall be applied and enforced throughout the entire existence of the permitted
structure.
5) This permit authorizes only the docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary may become a permanent part of this
docking facility without permit modification.

6) No non-water dependent uses of structures may be conducted on, in, or over public
trust waters without permit modification.
7) No attempt shall be made by the permittee to prevent full and free use by the public of
all navigable waters at or adjacent to the proposed work.
8) In order to protect water quality, runoff from the construction must not visibly increase
the amount of suspended sediments in adjacent waters.
9) Appropriate sedimentation and erosion control devices, measures or structures must be
implemented to ensure that eroded materials do not enter adjacent wetlands,watercourses
and property(e.g. silt fence, diversion swales or berms, sand fence, etc.).
10) This permit authorizes a maximum of two boat slips.
*Note: Future development on the permittee's property may require a modification of this
permit. Contact a representative of this Division at (252) 808-2808 prior to
commencement of any such activity.
*Note:The permittee is advised that any development or land disturbing activity that is
considered non-water dependent is not authorized within 50 feet of the normal high/low
water level unless specifically exempted by Environmental Management Commission
(EMC) Neuse River buffer regulations in place at the time of such development.

On 4 November 2002, this office received the CAMA Major Permit Application filed by
you for the development of the enlargement of a finger pier on an existing pier adjacent to your
property at 276 Dawson Creek Drive on Dawson Creek near Arapahoe, Pamlico County North
Carolina. The following items need to be addressed before the application can be accepted as
complete.
Overall
The permit fee for the proposed development construction as proposed is $250. Please
submit a check for that amount made payable to NC Department of the Environment and Natural
Resources (NCDENR) with the corrected permit application. A copy of the deed for the property
must be included with the application package.
DCM MP-1
• 3.a. The pier and platform are already constructed, so they are not proposed. You might want
to include the boathouse. If you do not complete construction before your General Permit
expires, it would be permitted under the Major permit, if issued.
• 4.m. Should be either septic tank or county sewer, whichever is correct.

• a. The pier and platform are existing. You are only proposing to enlarge the existing finger
pier. Only the dimensions of the proposed development should be included here.
• b. If the permitted boathouse will not be completed prior to the expiration of the General
permit, you may want to include it in your major permit application.

Plats Overall
The plats, drawings, and pictures must contain a title block with the name of the project, the date
the plat was drawn, the name of the person who drew the plat, and the plat number (i.e. Plat 1 of
4). If the survey plats are not the original drawings, they must include a revision date.
"Edge of Water" should be changed to "normal water level" on the plan view drawings. The
shading on the plan view drawing did not photocopy well. You may need to darken it. The
existing banding around the top of the boathouse area should be shown on the sectional drawing.

the necessary corrections have been completed, please resubmit the application, fee, and green

The Division of Coastal Management hereby acknowledges the receipt of the application

time. The projected deadline for making a permit decision is 1 May 2003. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you
have not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-1199b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed, you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: nailing the notice card to a telephone pole or tree along the road right-of-
way where a private road would lead one to your property. Failure to post this notice could result
in an incomplete application.
An on-site inspection will be made, and if additional information is required, you will be
