This permit, issued on Inly 17,2003 , is subject to compliance with the application(where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at docking facility shall be considered a violation of this permit
for which the permittee is responsible. This prohibition shall be applied and enforced throughout the
entire existence of the permitted structure.
2) This permit authorizes only the pier replacements and mooring pilings and other structures located in or
over the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, may become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.
4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
6) The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
7) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
8) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
9) All material resulting from the removal of the existing docking facility structures shall be placed on an
approved upland disposal site.
10) This permit authorizes a maximum of seven (7) boat slips
NOTE: Any proposal to add four (4) or more additional boat slips to the authorized 7 slip facility will
require that the docking facility be classified as a marina, and will therefore require a review
under the N.C. Environmental Policy Act (NCEPA).

11) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

placement of any structures within the 15 foot riparian corridor.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No.
197800056 (COE Action Id. No. 200310736) which was issued on 7/7/03.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law,for you to proceed with your project proposal. The original (buff-colored form) is retained by you
and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of
appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or 113-
229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh,NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on
your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit
within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the
final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work'must be carried out
in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.
Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work
done by a contractor,it would be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas,you may contact Department personnel at any time for assistance.By
working in accordance with the permit,you will be helping to protect our vitally important coastal resources.

Project setting
The project site is located at 156 Driftwood Drive, off SR 1192 at Crystal Beach, on the
Pamlico River near the Blount's Bay Community in Beaufort County,North Carolina. The property
is bordered on both sides by developed and bulkheaded lots and is part of the Crystal Beach
subdivision. This section of Crystal Beach is an approximately 30'high bluff along the river with a
narrow sandy shoreline waterward of the existing bulkheads. The property measures t 110' along
the shoreline and is bulkheaded along the entire length with several retaining walls and 2 wooden
groins. An existing modular home with a landscaped lot and access steps down the bluff are present
on the site. Slightly right of center on the property is a existing 5'wide by t310' long pier, with a
10'by 32'L-head, a 12'by 14'uncovered boatlift, a 2'by 24' catwalk for a wet slip, and an t480 ft2
2 stall boathouse. The area is vegetated with lawn grass, hardwood trees, and various landscape
shrubs adjacent the dwelling. The adjacent properties are also bulkheaded and vegetated similarly to
the applicant's property.
The Pamlico River at this site is classified as SB-NSW by the Environmental Management
Commission at the project site. The Pamlico River at the project site is coastal water but is not open
to shell fishing.
Project description
The applicant proposes to construct two t12' by f14' uncovered boatlifts, three wet slips
(f 17' by f24', f 14' 6" by f24', and f 15' 3" by f24% and two single pile j et ski lifts adj scent the
existing pier. The proposed additions will bring the total number of slips to 10.
Anticipated impacts
The project as proposed will result in the additional incorporation of t1,836 ft2 of river
bottom from the additional lifts and slips. The project as proposed will result in localized turbidity
as a result of the construction activities.

This project is subject to the 1997 BEAUFORT COUNTY LAND USE PLAN. The Land Use Classifications for the
project site are Limited Transitional (upland) and Conservation (Areas of Environmental Concern) in the Beaufort
County Land Use Plan.
PROJECT SUMMARY
This proposed project involves the replacement of two existing piers in the same footprint, and adds nine pilings to
create seven fixed slips for day docks. Areas of Environmental Concern impacted by the protect include Public
Trust Areas, and Coastal Shoreline.
APPLICABLE POLICIES
• Residential, Commercial, and Industrial development which meets 15A NCAC 7H use standards will be
allowed in estuarine shoreline, estuarine waters, and public trust areas. In all other areas, development
will be allowed that is consistent with applicable local, state, and federal regulations. (page IV-16)
• Beaufort County supports the use standards for estuarine waters and public trust areas as specified in 15A
NCAC 7H.0207. (page IV-18)
PLAN CONSISTENCY
It is my interpretation that the proposes project appears to be consistent with the 1997 Beaufort County Land Use
Plan, provided that all work is constructed in accordance with applicable local, state and federal rules and
requirements.

The Washington Regional Office received a copy of your CAMA
application for your proposed pier replacement project located at
the Camp Leach Estates Community lot on Mallard Creek on June 9,
2003. Staff review of the plans and specifications has determined
that the project, as proposed, consists of activities that will not
pose surface water quality threats from stormwater runoff since no
significant new impervious area is proposed. The Director has
determined that projects that are reviewed and approved by the
Division as not posing water quality threats from stormwater runoff
should not be subject to the stormwater management permitting
requirements of 15A NCAC 2H.1000 . For this reason, we are informing
you by way of this letter that your project will not require a
stormwater management permit.
Please keep in mind that this determination does not affect your
legal requirements to obtain other permits which may be required by
the Division of Water Quality, the Division of Land Resources,
Coastal Area Management Act or any other Federal, State or Local
Government. In addition, any future modifications to the project
will require additional review from this office to assure that
stormwater impacts are not an issue.
