Box 2188 1424 Carolina Ave Washington, NC 27889-2188 Dear Mr. Moye, I have been authorized to act as the agent for Beaufort County to apply for a major CAMA permit to install poles and signs for a No Wake Zone in state waters near the mouth of Blount's Creek. It includes the waters from the mouth of the creek, proceeding 900' to the bridge (SR1 112), and through the bridge another 150' to 300.' The reason a No Wake Zone is necessary is due to the increased boating traffic this narrow portion of the creek has incurred during the last five years. The mouth of the creek is very narrow and is a choke point for boating traffic, especially on weekends and holidays. Though it widens as one moves toward the bridge, the pilings of the bridge create another choke point for boaters. Another reason for the No Wake Zone is a general lack of courtesy and respect for the `Rules of the Road' boaters must show one another. Speeding boats from 15' to 40' come through at full throttle with little consideration shown to fishermen anchored near the banks. They will not even slow down for those who have fallen from skis, knee boards and float tubes. If a No Wake Zone is not designated and properly marked for this narrow and heavily traveled stretch of water, it will only be a matter time before a serious accident will occur. And that is why the citizens of this area have joined together to pursue this course of action. It will not only serve to protect those who are considerate and obey the rules, but also those who are inconsiderate and must be protected from themselves. Thank you for your assistance in acquiring the permit necessary to install the poles and signs for this No Wake Zone. We believe it will not only help prevent accidents but may also save a life. le - - DIVISION OF COASTAL MANAGEMENT APPLICATION TRANSMITTAL AND PROCESSING RECORD A) APPLICANT: County of Beaufort County: Beaufort LOCATION OF PROJECT: At the SR 1112 bridge crossing of Blounts Creek near the Community of Blounts Creek in Beaufort County DATE APPLICATION RECEIVED COMPLETE BY FIELD: 11 September 2003 FIELD RECOMMENDATION: ATTACHED CONSISTENCY DETERMINATION: No FIELD REPRESENTATIVE: David Moye DISTRICT OFFICE: Washington DISTRICT MANAGER REVIEW: B) DATE APPLICATION RECEIVED IN RALEIGH: — ''''}'FEE REC'D: 250.00 PUBLIC NOTICE REC'D: ✓ / END OF NOTICE DATE: (p/lY(u3 ADJ. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing you by way of this letter that your project will not require a stormwater management permit. Please keep in mind that this determination does not affect your legal requirements to obtain other permits which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Area Management Act or any other Federal, State or Local Government. In addition, any future modifications to the project will require additional review from this office to assure that stormwater impacts are not an issue. This letter also confirms my phone conversation on 9 September 2003 with Mr. Paul Boone with the Natural Resource Conservation Service and subsequent meeting with Mr.Boone on 15 September 2003 concerning the aforementioned application package. I also refer you to my 28 August 2003 letter reference the application package deficiencies. In order for this Division to accept your application package as complete and initiate agency review I will need for you to address the issues raised in the 28 August 2003 letter, which are summarized again in this letter, as well as issues apparent after reviewing the written application forms. Overall The plats and site maps must have a title block that includes a date and title. The cross section drawings need to also indicate the scale, for example, 1"=50'. The cross sections should show the normal water level. If graph paper is to be used, the original copy is preferred as lines become unclear when trying to make copies. A typical plan view and cross section is needed for the proposed inlet pipe replacement. A table in support of your plan view containing data collected at each station including existing water depth, proposed project depth, depth of material to be removed, width of canal, width and height of existing spoil berm, if present, is needed to provide reviewing agencies a tool to make informed comments. Cross sections 1287+64 and 824+01 are missing. The application package will need to be sent certified mail return receipt requested to the adjacent riparian property owners on the upstream and downstream end of the project. The cover letter should instruct the adjacent property owner to respond to this office in writing within thirty days of receipt. This most likely will be the North Carolina Department of Transportation. A statement of compliance with the N.C. O. Box 1027 County Courthouse Washington,North Carolina 27889-1027 RE: Blount's Creek No Wake Zone Dear Mr. Richardson: I have been contacted recently by Mr. Richard Folsom, a citizen of Beaufort County, regarding a no-wake zone at Blount's Creek in Beaufort County. As you know, Mr. Folsom has been working with the county and interested citizens in an effort to get the zone properly marked so that it may be enforced by the Wildlife Resources Commission [WRC]. Unfortunately, the location of the zone confers concurrent jurisdiction with the Division of Coastal Management [DCM],which requires a CAMA permit for the placement of markers. Therefore, the CAMA permit is prerequisite to the marking of a no-wake zone in the waters of Blount Creek in Beaufort County. The purpose of this letter is to assist Beaufort County in its application to the Division of Coastal Management for a CAMA permit. I understand from conversation with Mr. David Moye, Division of Coastal Management, that the county's application must specify coordinates for the area to be marked. Sergeant Conley Mangum of WRC has taken GPS readings for the zone as described by rule 15A 10F .0303(a)(6) of the North Carolina Administrative Code. I am providing you a document [enclosed] created by the WRC Enforcement Division that shows the boundaries of the no wake zone and the coordinates that represent those boundaries so that you may include this information in the county's CAMA permit application. If DCM requires coordinates for the specific placement of the markers themselves, WRC enforcement staff will work with Beaufort County and DCM staff to designate specific placement and provide coordinates for each marker site. Please let me know whether this is required. In any case, WRC would like to help ensure that the CAMA permit and Mailing Address: 1701 Mail Service Center• Raleigh,NC 27699-1701 Office Location: 512 N.Salisbury Street 0 Raleigh,NC 27604-1188 • Telephone: (919) 733-3391 the rule that was adopted by WRC are consistent in their respective descriptions of this zone and its markers. North Carolina Department of Environment and Natural Resources Division of Coastal Management Michael F. Easley, Governor Donna D. Moffitt, Director William G. Ross, Jr., Secretary September 16, 2003 Mr. Paul Spruill, County Manager County of Beaufort Post Office Box 1027 Washington,North Carolina 27889 Dear Mr. Spruill: The Division of Coastal Management hereby acknowledges receipt of an application for State approval for development of property located at the SR 1112 bridge crossing of Blounts Creek near the Blounts Creek Community in Beaufort County,North Carolina. It was received on 11 September 2003 and appears to be adequate for processing at this time. The projected deadline for making a decision is 25 November 2003. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will also serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. Should there be any questions on this procedural change, do not hesitate to contact me. N.C.G.S. 113A-119(b) requires that notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along the property where it can be observed from a public road. Some examples would be: nailing the notice card to a telephone pole or tree along the road right-of-way fronting the property, or at a point along the road right-of-way where a private road would lead one into the property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made and if additional information is required, you will be contacted by the appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of my field report and/or comments from reviewing agencies. Sincerely, David W.
