Dockine Facility
1) All portions of the docking facility constructed within the federal harbor/pier head line, including
pilings, must be removable. If future operations by the United States require removal, relocation, or
other alteration of the structure herein authorized, it will be removed at the owner's expense.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.

existing onsite marine pumpout sewage disposal facility will be operable and maintained for the life

4) The docking facility will display a sign showing the location of the existing on-site pumpout facility,
including other appropriate waste disposal information, at the entrance and exit from the main piers.
5) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether .
floating .or stationary, may become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
6) No attempt will be made by the permittee to prevent the full and free use by the public of:all navigable
waters at or adjacent to the authorized work.
7) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
8) The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
9) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the .United States :in the public
interest.
10) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
11) This permit does not authorize additional boat slips.
NOTE: Boats utilizing the docking facility may be subject to frequent wavewash from passing vessels.
The issuance of this permit does not relieve the permittee from taking all proper steps to ensure
the integrity of the structure and the safety of moored boats. The permittee shall not hold the
State of North Carolina or the United States liable for any damage to the structure or moored
boats.

ADDITIONAL CONDITIONS
General
12) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
13) In order to protect the West Indian Manatee (Trichechus manatus), which is a federally endangered
species potentially occurring in the project area, all work should be done during the period from
November 1 to May 31 of any given year. If work must be done during the period from June through
October, the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May
Be Used by the West Indian Manatee in North Carolina" shall be followed. For additional information
contact the US Fish and Wildlife Service at (919) 856-4520.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.
NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No.
021777.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original(buff-colored form) is retained by you
and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of
appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or 113-
229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 276 1 1-67 14, (919) 733-2698 within twenty (20) days of this decision on
your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit
within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the
final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out
in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.
Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work
done by a contractor,it would be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. By

9.NARRATIVE DESCRIPTION:
The applicant is the Town of Beaufort, through their lessee of the town docks, Mr. Haywood
Weeks. Mr. Weeks proposes to replace fixed docks with floating, requiring an expansion of
the incorporated open water area over that currently incorporated.
The site is the Beaufort waterfront, within the existing public marina located in Taylor's
Creek. Currently there are 81 slips provided to the public within this marina, along a stretch
of leased shoreline of approximately 1350 linear feet. The middle three docks, which are
uniform in design, constitute the subject of this application.
Taylor's Creek is in excess of 800' across at the project location. The Town of Beaufort Land
Use Plan classifies Taylor's Creek as Conservation, by virtue of the fact that it lies within a
CAMA Area of Environmental Concern. The waters carry a Water Quality Classification of SC,
are closed to the taking of shellfish for consumption, and are not designated as Primary Nursery
Area. The area is serviced by municipal water and sewer, and provides a pumpout station for
boaters. Currently, this portion of the marina incorporates approximately 37,100 square feet of
Public Trust Area, and provides 30 slips.
The request is to change the middle three docks from fixed to floating. This will require the
removal of the 24 mooring pilings and the 3 docks from a point approximately 24' offshore to the
end. A floating pier will be replaced for each fixed, 70' x 6'. This is approximately 4' longer
than the existing. Two finger piers of 50' x 4' will be constructed adjacent to the bulkhead at
each dock.intersection, and two more 40' waterward of those, for a total of 12 finger piers. T-
heads will be constructed at the waterward ends of the floating piers, 100' x 5'8" in size. At this
point, Taylor's Creek is 16' deep. There will be 12 new mooring pilings located adjacent to the
36 remaining, to define the same 30 slips. The overall project will extend approximately 10'
further into the creek than the existing, for an overall length of 100'. The submitted plat indicates
that the proposed docks will terminate from 210' to 305' from the federal channel within the
project location. However, Taylor's Creek has a federal harbor/pierhead line that governs the
location of docking facilities in this area. The harbor line is depicted on the plats, and is located
approximately 62' from the bulkhead. The existing docks extend beyond this line approximately
28', and the proposed will encroach approximately 38' beyond the line. The location of the docks
is well within the riparian corridors (> 175') for this stretch of shoreline.
10. ANTICIPATED IMPACTS:
The project as proposed will incorporate approximately 42,400 sf, or 5300 more than the existing
37,100 sf. The area shaded by decking will approximate 2562 sf. Total number of mooring slips
will remain unchanged at 30, for the same types and sizes of vessels. The encroachment into the
federal harbor line will be increased by 10'. Turbidity impacts will be limited to pile driving.

Description of Proposed Proiect
The purpose of this proposed project is to replace three existing fixed docks at the
Beaufort Town Docks with three floating docks. The unusually swift current and strong beam
winds at this location cause continual breaking of free standing pilings. Aside from being very
expensive to replace these pilings when they break, it also removes slips from the use of the
general public visiting Beaufort by boat. Often this removal of slips lasts for lengthy periods of
time, since it requires a large commercial barge with a large crane and trained crew to replace
them, and such a barge is not always available. These pilings are 50 feet long and over a foot in
diameter and can not be manhandled without a large barge and crane. Floating docks would help
alleviate the problem. Additionally, floating docks themselves act as a mitigating factor on the
current and are much safer for boaters to use with our tidal range of 3 '/2 to 5 feet.
We have 30 existing fixed slips that we would like to replace with 30 floating slips.
Although there will be no increase in the number of slips, the width of the slips need to be
increased to accommodate the increased widths of boats now visiting these docks since their
original construction. Additionally, some of the fixed finger piers are only 1 I/2 feet wide at
points, and floating finger piers cannot be stable or safe at these widths and must be increased
significantly. Although the body of water at this location is 850 feet wide and the nearest edge
of the channel at this location is over 300 feet away, we are proposing to keep these floating
docks within the 100 foot distance allowed by CAMA regulations.

Reference the Town of Beaufort's application for a Department of the Army permit to
replace the fixed docks with floating docks and extend 10 feet further into Taylor's Creek, at the
public marina on the Beaufort waterfront, Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
permit plans, which are a part of this permit.
2. This permit does not authorize the interference with any existing or proposed Federal
project, and the permittee will not be entitled to compensation for damage or injury to the
authorized structure or work that may be caused from existing or future operations undertaken by
the United States in the public interest.
3. No attempt will be made by the permittee to prevent the full and free use by the public
of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must
not interfere with the publics right to free navigation on all navigable waters of the United States.
4. It is possible that the authorized structure may be damaged by wavewash from passing
vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to
ensure the integrity of the permitted structure and the safety of moored boats. The permittee will
not hold the United States liable for any such damage.
5. No excavated or fill material will be placed in any location or in any manner so as to
impair surface water flow into or out of any wetland area.
6. The authorized structure and associated activity will not cause an unacceptable
interference with navigation.
7. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
8. This Department of the Army permit does not obviate the need to obtain other Federal,
State, or local authorizations required by law.
9. The permittee understands and agrees that,if future operations by the United States require the
removal,relocation,or other alteration,of the structure or work herein authorized,or if,in the opinion
of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to the free navigation of the navigable waters,the permittee will be required,
upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or
obstructions caused thereby,without expense to the United States. No claim shall be made against the
United States on account of any such removal or alteration.
10. All portions of the structures constructed within the harbor line must be removable(this
includes pilings). If future operations by the United States require removal, relocation, or other
alteration of the structure herein authorized,it will be removed at the owner's expense.
11. The West Indian manatee (Trichechus manatus), which is listed as a federally
endangered species, has been reported in the waters near the Beaufort waterfront. In order to
protect the West Indian manatee all work should be done during the period from November 1 to
May 31. If work must be done during the period from June through October the enclosed
guidelines, entitled"Precautions for General Construction in Areas Which May Be Used by the
West Indian Manatee in North Carolina" must be followed.

The project is located within the town's marina in Taylor's Creek, adjacent to 500 Front
Street in downtown Beaufort. The applicant proposes to replace fixed docks with
floating docks, requiring an expansion of the incorporated open water area at the site.
Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine Waters
and Public Trust Waters. The Waters at the project site are classified as SC and are not
open to the harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1996 Town of Beaufort Land Use
Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation.
In general, the Town of Beaufort allows development in Conservation classified AECs
which is consistent with the State's minimum use standards. The Town of Beaufort Land
Use Plan contains some local policies which exceed 7H guidelines including those for
Marina and Floating Home Development. However, none of these more restrictive local
standards appear to be applicable to this project.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the 1996 Town of Beaufort Land Use Plan.

This letter provides the comments of the U. S. Fish and Wildlife Service (Service) on the
subject application for a Department of the Army(DA)permit. The applicant,theme
1eaufort,proposes to replace fixed docks with floating docks on the town waterfront. The
work would require the removal of 24 mooring pilings and three docks from a point
approximately 24 feet offshore of the existing dock. T-head docks would be construction at the
waterward ends of the floating piers, 100 feet by five feet-8 inches, in water approximately 16
feet deep. Twelve new mooring pilings would be installed. There would be no increase in the
number of boat slips (30). The overall project would extend approximately ten feet farther into
Taylor's Creek. These comments are submitted in accordance with the Fish and Wildlife
Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661-667d) and section 7 of the
Endangered Species Act(ESA) of 1973, as amended(16 U.S.C. 1531-1543). They are to be
used in your determination of compliance with 404(b)(1)guidelines (40 CFR 230) and in your
public interest review(33 CFR 320.4) as they relate to protection of fish and wildlife resources.
The Service recognizes the relatively minor impacts that the proposed work would have on fish
and wildlife habitat in the project area. The permit application notes that the overall project
would incorporate approximately one acre of open water, or 5,300 square feet more than the
existing pier facility. Pile driving would increase turbidity during construction.
The Service has reviewed available information on federally threatened or endangered species
known to occur in Carteret County. We have also reviewed information from the North
Carolina Natural Heritage Program(NCHNP) database on the reported occurrence of these
species in the project area. The NCNHP database shows that the federally endangered West
Indian manatee
(Trichechus manatus) has been reported in the waters near the Beaufort waterfront. Schwartz
(1995)reports several documented occurrences of the manatee in the coastal waters of Carteret
County.
Manatees are seasonal transients in North Carolina,primarily from June through October.
They are aquatic mammals which may use freshwater,brackish, or marine habitats. The
species can move freely between salinity extremes. The species may be found in shallow
coastal waters,bays, lagoons, estuaries,rivers, and inland lakes. Manatees are commonly
found in water three to seven feet deep. Manatees spend much of their time underwater or
partly submerged, and this behavior often makes the species difficult to detect. These mobile
animals may not inhabit a given area for extended periods, and manatees may move into a
given project site where the species has never been reported previously. Therefore,the areas
that may contain manatees cannot be determined by visual surveys that are satisfactory for less
mobile,year-round species. To adequately protect this endangered species,reasonable
precautions must be implemented in areas that could be used by manatees during the warmer
months of June through October.
To address the issue of construction activities in water that could be used by the manatee, the
Service developed guidelines, entitled"Precautions for General Construction in Areas Which
May Be Used by the West Indian Manatee in North Carolina," for activities that do not include
the use of explosives. A copy of these guidelines (updated in June 2002)is attached. The
guidelines are applicable for work only during the months of June through October. These
guidelines address all types of in-water construction, except blasting, and should produce little,
if any, additional expense. The guidelines are intended mainly to ensure that construction
personnel are informed that manatees may occur in the work area, that work should cease if a
manatee approaches the work area,work should not resume until the manatee leaves the work
area, and procedures for reporting the death or injury of a manatee.
We believe that the inclusion of these precautions as a permit condition would result in a
project that is not likely to adversely affect the manatee. As an alternative to these guidelines,
the Corps may require that all work be conducted during the period from November 1 to
May 31. With the inclusion of these guidelines or seasonal work restrictions,we believe that
the Corps' requirements under Section 7(a)(2) of the ESA would be satisfied. We remind you
that obligations under Section 7 consultation must be reconsidered if. (1)new information
reveals impacts of this identified action that may affect listed species or critical habitat in a
manner not previously considered; (2)this action is subsequently modified in a manner that
was not considered in this review; or, (3) a new species is listed or critical habitat determined
that may be affected by the identified action.
With the inclusion of the Service's guidelines or seasonal work restrictions as permit
conditions, we support the issuance of a DA for this project. The Service appreciates the
opportunity to comment on this permit application. Please advise us of any action taken by the

The Wilmington Regional Office received a copy of the CAMA Major Permit
Application for replacing three fixed docks with three floating docks on November 6, 2002. Staff
review of the plans and specifications has determined that the development activities proposed at
this time will not pose a threat to surface water quality from stormwater runoff. The Director has
determined that projects that are reviewed and approved by the Division as not posing a water
quality threat from stormwater runoff should not be subject to the stormwater management
permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are informing you
that your project will not require a stormwater management permit.
If the subject project disturbs five acres or more and has a point source discharge of
stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System
(NPDES) stormwater discharge requirements. You are required to have an NPDES permit for
stormwater discharge from projects meeting these criteria. The stormwater rules require the
Division to permit the common plan of development, therefore, any future development on the
property, regardless of whether a CAMA Major permit is also required, will require a Stormwater
Management Permit application and permit issuance from the Division of Water Quality prior to
any construction.

feet further into Taylor's Creek, at the public marina on the Beaufort waterfront, Carteret County,
North Carolina, indicates it to be a candidate for Federal authorization under this general permit.

If your application must be withdrawn from this general permit process for any reason,

The following are my comments and recommendations regarding the aforementioned proposal:
The extension of the Beaufort docks 10'waterward from their present location in order to increase
the safety of the structure, and convert from fixed to floating design, appears to present no hazard
to navigation. However, extending waterward does increase the facility's encroachment into the
federal setback. According to the applicant, conversations with the US Army Corps of Engineers
have been encouraging, and he is of the impression that the allowance for this proposal will be
made. Assuming that the COE waives a further intrusion into the harbor line setback for the
proposed development, I would find that the proposal meets with all other aspects of the CAMA,
and would recommend the issuance of a permit contingent upon the following conditions:
This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, may become a permanent part of this marina/docking facility
without permit modification. No non-water dependent uses of structures may be conducted on, in
or over public trust waters without permit modification.
No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
The authorized structure and associated activity must not cause an unacceptable interference
with navigation.
This permit does not authorize the interference with any existing or proposed federal project, and
the permittee will not be entitled to compensation for damage to the authorized structure or work,
or injury that may be caused from existing or future operations undertaken by the United States rtt
the public interest.

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on October 24, 2002.
According to said application, Mr. Haywood Weeks, representing the Town of Beaufort,
proposes to replace three fixed docks along the Beaufort waterfront with floating docks.
A copy of the entire application may be examined or copied at the office of Tere Barrett,
NC Division of Coastal Management, located at Hestron Plaza II, 151-B Hwy. 24, Morehead
City, NC, 28557, ph. (252) 808-2808, during normal business hours.
Comments mailed to Donna D. Moffitt, Director, Division of Coastal Management, 1638
Mail Service Center, Raleigh, NC, 27699-1638, prior to November 16, 2002, will be considered
in making the permit decision. Later comments will be accepted and considered up to the time of
permit decision. Project modification may occur based on review and comment by the public and
state and federal agencies. Notice of the permit decision in this matter will be provided upon
written request.

Dear Mr. Weeks:
The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of Town of Beaufort property located at 500 Front Street in Beaufort. It was
received completed on October 30, 2002, and appears to be adequate for processing at this time. The
projected deadline for making a decision is January 12, 2003. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice
card to a telephone pole or tree along the road right-of-way fronting your property, or at a point along
the road right-of-way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
