Additional Boat Slips 1) This permit authorizes only the addition of one boat lift and one jet ski lift to the existing docking facility that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2) The boat lift, jet ski lift and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. Signatur f ermittee Linda Armstrong Permit#150-03 Page 2 of 3 ADDITIONAL CONDITIONS 3) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) The authorized structures and associated activity must not cause an unacceptable interference with navigation. 5) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) This permit authorizes two additional slips for a maximum of four boat slips. NOTE: Boats utilizing the docking facility may be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. General 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. Linda Armstrong Page Two 9. PROJECT DESCRIPTION The applicant's property is located at 1120 Channel Blvd.,in the Town of Topsail Beach,in Pender County. The property is located adjacent to Banks Channel/Topsail Sound. From the Topsail beach Town Hall;travel 0.4 miles down South Anderson Blvd. (Hwy 50)to Scott Avenue. Turn right onto Scott Avenue,left onto Channel Blvd. and go approximately 0.1 mile, 1120 Channel Blvd. will be on the right. The highground property consists of a single-family-residential lot measuring approximately 80 feet deep and approximately 80 feet wide. Existing highground development on the property includes a single-family dwelling and driveway. The yard is landscaped with turf grass and ornamental shrubs. Adjacent to the bulkhead,there is a border of coastal wetlands approximately 66 feet wide. This area is vegetated primarily with Smooth Cordgrass(Spartina altern fora)within the first 24 feet from the bulkhead. Waterward of this area is a sand/shell berm, which has formed along the edge of the channel. This berm's elevation is above normal high water(NHW)and supports high marsh vegetation including:Salt Meadow-Hay(Spartina patens), Sea Oxeye(Borrichia frutescens)and Suaeda(Suaeda linearis). There are breaks in the berm,both north and south of the project,which allows tidal flow to the extensive marsh landward of the berm. Waterward of the berm, the high marsh transitions to a low marsh with approximately a 13 feet span of Smooth Cordgrass (Spartina alterniflora)marsh on both sides of the pier. The average elevation of the highground property is approximately 10 feet above normal high water. The property shoreline is stabilized with approximately 80 feet of vertical wooden bulkhead. The applicant has an existing 6 feet wide walkway extending from the bulkhead,approximately 92 feet to a 16 feet X 16 feet platform. From the platform the applicant has a 6 feet by 16 feet float extending waterward into Banks Channel. The water depth at the end of the floating dock is approximately 7' at NWL. Currently,this structure could provide docking space for up to two vessels. The waters adjacent to the project are classified"SA"by the Division of Water Quality. The area is not designated a Primary Nursery Area and is open to the taking of shellfish. The applicant is proposing to add a 12 feet X 12 feet boatlift to the northernmost side of the existing platform. In addition,a second boatlift(single pole jet ski lift)is proposed along the north side of the pier, approximately 8 feet landward of the platform. 10. ANTICIPATED IMPACTS The proposed boatlift and jet ski lift would result in the incorporation of an additional 169 square feet of public trust area. The project as proposed would provide docking space for up to four vessels. Minor increases in turbidity can be expected during construction. This permit authorizes only the addition of the 12' by 12' boatlift and a single pole jet ski lift. No other structures, whether floating or stationary,may become a permanent part of the structure without permit modification. No non-water dependent uses of structures may be conducted on; in, or over public trust waters without permit modification. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structure and associated activity must not cause an unacceptable interference with navigation. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard,through regulations or otherwise, on authorized facilities. 5. In order to protect water quality,runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. Future development on the permittee's property may require a modification of this permit. The construction of the proposed project shall be in compliance with all local, State and Federal regulations and associated permit conditions. 8. The proposed project will be located at 1120 Channel Blvd,and adjacent to Banks Channel and Topsail Sound. Development will impact the following Estuarine System Areas of Environmental Concern(AECs): Public Trust Area, Estuarine Waters and Estuarine Shorelines. Waters are classified SA, and open to shellfishing. The Primary Nursery Area(PNA)designation does not apply. The permit application was reviewed for consistency with the Land Use Plan 1990 Update for the Town of Topsail Beach, North Carolina. The Developed—Low-Density ResidentiaUSupporting Services classification applies to the upland portion of the site. The Conservation-Marshlands classification applies to AECs. This project is consistent with the LUP provided all local,state and federal regulations are met. The following policies are applicable: Estuarine Waters--Appropriate uses may include simple access channels, structures which prevent erosion, navigational channels, boat docks, marinas,piers and mooring pilings. Public Trust Area— Uses that may be allowed in public trust areas shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Examples of such uses include the development of navigational channels or drainage ditches, the use of bulkheads and groins to prevent erosion, the building of piers, docks or marinas. Estuarine Shorelines—Suitable land uses within the estuarine shoreline AECs are those compatible with both the dynamic nature of estuarine shorelines and the values of the estuarine system. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. The stormwater rules require the Division to permit the common plan of development, therefore, any future development on the property, regardless of whether a CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Water Quality prior to any construction.
