Upland Development 1) No excavation and/or land disturbing activities shall be undertaken outside of the areas noted on the attached workplan drawings or outside of the permittee's property. NOTE: The location of the extrapolated first line of stable natural vegetation (FLSNV) is subject to change, and as such shall be restaked by a representative of the Division of Coastal Management prior to the commencement of any new development on this property in the future. 2) The permitted frontal dune will be aligned with the existing, adjacent frontal dunes to the greatest extent possible. Signature of Pe ee Sea Spray Motel, LLC Permit#103-03 Page 2 of 2 ADDITIONAL CONDITIONS 3) The permitted frontal dune shall be vegetated and stabilized immediately upon the completion of all grading activities authorized by this permit. 4) Sand used to construct the dune must be brought in from an outside source and must be of the same nature as the existing sand in the area where it is to be placed. This permit does not authorize the removal of sand from the site. 5) All debris resulting from the demolition of existing structures shall be disposed of at an approved upland disposal site. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed with the Town of Nags Head at least thirty (30) days prior to the beginning of any land disturbing activity. A copy of the approved Erosion and Sedimentation Control Plan must be submitted to the Division of Coastal Management prior to the commencement of any land disturbing activities. 6) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 7) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). Stormwater Management 8) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW7030414 on 7/16/03. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. PROJECT SUMMARY: The applicant's propose to remove all buildings, foundations, parking surfaces, and waste treatment system(s) associated with the Sea Spray Motel for the purpose of redeveloping the property as residential building sites. Sea Spray Motel LLC ' Field Report Page 2 PROJECT SETTING The Sea Spray Motel is currently owned by the applicant Shirley Bellamy, and is located at 3529 Virginia Dare Trail (NC12), Nags Head, Dare County. The Sea Spray Motel is on an oceanfront lot that was previously subdivided into more than twelve individual building lots; however, erosion has reduced the number of buildable lots to six. Structures on the property included the main rental units that form a "U" around a parking area with a living quarters/office on the southern property line. According to the site plan and application, the total area of the applicant's ocean front lot consists of 3.073 acres. Actual developable area, based on an extrapolated First Line of Stable Vegetation (FLSNV), is approximately 2.1 acres (91,322sf). The applicant's calculations appear to include the area seaward of the FLSNV to Mean Low Water. Vegetation on the property was primarily limited to domestic yard grasses and ornamentals around the hotel itself. Little to no dune or dune vegetation exists on the property. Located immediately seaward of the motel is a gentle rise in the beach profile that tapers to the surf zone. The rental units open directly to the beach and years of human impact has prevented the natural development of vegetation or the collection of sand on the site. Based on aerial photographs, the beach profile and vegetation around the motel appears to have experienced little change over the past twenty-five years. The property falls into three separate Flood Zones, on the seaward side of the motel, paralleling the beach, the Flood Zone is a VE (EL 13'). The area paralleling the beach where the motel is currently located falls within a VE (EL10') Flood Zone,and the remainder of the lot, extending to the west to NC 12, is in an AE (EL 10') Flood Zone. According to the Erosion Rate Maps, the erosion rate for the property is 2'-0" per year, with a 30 recession line, for an Area of Environmental Concern (AEC) that extends 150' landward of the FLSNV,or in this case the measurement line. The Division of Environmental Management's water quality classification for the waters of the Atlantic Ocean, contiguous to that portion of the Pasquotank River Basin that extend from the North Carolina-Virginia State Line to the northeast tip of Ocracoke Island, is SC (fish propagation). Review of available information suggests that there are no known archeological sites or unique geological formations associated with the immediate area. PROJECT DESCRIPTION The applicant, Sea Spray LLC, is preparing to sell the land upon which the motel currently sits. All buildings and associated infrastructure will be removed and the individual lots will be redeveloped for residential structures. Prior to undertaking any work on the site a silt fence system will be installed along the perimeter of the property and held in place with a fabric anchor and compacted backfill. Existing concrete drives will be used to access the site during demolition of the buildings, to remove debris, and will be the last structures removed from the property. In conjunction with the demolition work, the applicant is proposing to construct a dune along the alignment of the old motel. The finished elevation will only be two to three feet higher than the current (pre-demolition) grade, for an average elevation of 18'. Once grading is complete, the dune will be plugged with grass, and excelsior matting will be placed over the vegetation to protect it duringits initial phase of stabilization Sea Spray Motel LLC Field Report Page 3 The total area of proposed land disturbance associated with the demolition of the buildings and infrastructure is 1.983 acres. The plan actually indicates a slight encroachment onto adjacent properties; however, the placement of the silt fence will be within the property and should confine all activity to the applicant's property. Upon completion of the land clearing activities, the applicant will vegetate the site for erosion control ANTICIPATED IMPACTS • Approximately 1.983 acres of sand will be displaced within the Ocean Hazard AEC, from land clearing activities. • If approved, development of the individual properties may actually increase the density of the property. • If in keeping with the current trend, the redevelopment of the motel property will probably result in the development of six individual lots with six large rental dwellings and associated swimming pools. • If approved, the removal of the structures, the re-construction of the dune system and re- vegetation may improve the protective capabilities of the shoreline along the Sea Spray property. The following criteria are approved as meeting the stormwater rules for this project: a. The total area for this project is 3.17 acres. b. Total impervious area proposed for this project site is 0.68 acres. C. Total number of lots is six. d. Allowable built-upon area must be consistent with proposed plans and restrictions submitted in the application by the permittee. 3 2. The overall tract built-upon area percentage or lot sizes for the project must be maintained at levels at least as stringent as the low density levels specified in the stormwater rules. 3. The development must demonstrate that no areas within the project site are of such high density that stormwater runoff threatens water quality. 4. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. 5. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum side slopes of 3:1 (H:V) or curb outlet systems as defined in the stormwater rules and approved by the Division. 6. No piping shall be allowed except: a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road. b. That minimum amount needed under driveways to provide access to lots. 7. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all impervious areas and surface waters. 8. No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any vegetative practices (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 9. Each of the lots in the subdivision will be limited to the amount of built-upon area indicated in the approved plans and consistent with item 1 above. 10. The permittee is responsible for verifying that the proposed home plans do not exceed the allowable built-upon area. Once the lot transfer is complete, the home plan may not be revised without approval from the permittee, and responsibility for meeting the built- upon area limit is transferred to the individual homeowner. 11. The Engineer/Owner/Developer/Permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. 12. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office of Register of Deeds. A copy of the recorded restrictions must be received by this Office within 30 days of the date of recording. Recorded deed restrictions must include, as a minimum, the following statements related to stormwater management: 4 a. A statement of the allowable built-upon area per lot in the following form: "The allowable built-upon area per lot shall not exceed 4,590 square feet for lotl64R and shall not exceed 4,974 square feet for lots 1651?, 166R, 167R, 168,R, and 169R; inclusive of that portion of the right-of-way between the front lot line and the edge of the pavement, structures, pavement, walkways of brick, stone, slate, not including wood decking." b. Items related to stormwater management must remain in the deed restriction, and this is to be indicated by including the following: "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State." C. To assure that vegetated conveyances are not piped (in accordance with item 5) deed restrictions must indicate that: "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the development except for average driveway crossings, is strictly prohibited by any persons." 13. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size b. Project name change C. Transfer of ownership d. Redesign or addition to the approved amount of built-upon area e. Further subdivision of the project area. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee shall comply with the following schedule for construction and maintenance of the Low Density Option stormwater systems: a. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built-upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 5 2. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b. Sediment removal C. Mowing, and revegetating of the side slopes d. Immediate repair of eroded areas e. Maintenance of side slopes in accordance with approved plans and specifications. 3. The permittee shall submit recorded deed restrictions limiting built-upon area per lot in accordance with Part I, item 9, within 30 days of the date of recording. 4. The Permittee shall submit the Engineer/Owner/Designer/Permittee Certification in accordance with Part I, item 12,within 30 days of completion of the project. 5. The permittee shall submit all information requested by the Director or his representative within the time frame specified in the written information request. M. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et.al. 5. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for those revisions under any of the following conditions: a. The property will be sold for redevelopment, and it will be the responsibility of the individual purchasers to obtain future CAMA Permits. The total area of disturbance anticipated in association with the demolition work is 1.982 acres. Prior to that work, a silt fence will be installed around the perimeter of the property. Once all of the structures have been removed,the property will be re-vegetated. A review of the North Carolina Administrative Code subchapters 07H .0309 and .0308, fail to provide any clear direction regarding the activity being proposed. However, traditionally the removal of structures and their infrastructure have been permitted. I would like to recommend approval of the applicant's request and offer the following conditions: 1) No excavation or fill activity shall be undertaken outside of the applicant's property. 2) The proposed frontal dune will be re-vegetated and stabilized immediately upon the completion of all grading. 3) No heavy equipment will be permitted on the beach, seaward of the FLSNV (extrapolated line), between May 1" and November 15`h of each year without authorization from the Town of Nags Head and the U.S. Army Corps of Engineers. 4) The location of the extrapolated First Line of Stable Natural Vegetation(FLSNV) is subject to change, and as such is subject to a determination prior to any new development. 5) NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty-days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources Land Quality Section. 6) NOTE: The permittee will maintain the work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he/she abandons the project without having the permit transferred to a third party. 7) NOTE: Future development of the permittee's property may require a modification of this permit.
