Wolfenbarger Permit #109-84 ADDITIONAL CONDITIONS For Maintenance Work With Hydraulic Dredge (1 ) All excavated materials must be confined on highground behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. (2) The disposal area effluent must be contained by pipe, trough or similar device to a point at or below the mean low water mark to prevent gully erosion and resultant unnecessary siltation. (3) The terminal end of the pipeline must be positioned at or greater than 50' from any part of the dike and a maximum distance from spillways to allow adequate settlement of suspended solids. (4) A water control structure must be. ilnstal l ed at the intake end of the effluent pipe so as to assure compl wi1rM condition No. 5. Box 1507 Washington, NC 27889 (2) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. (3) In the event that archaeological materials are encountered during excavation or any other ground disturbing activities, work shall cease and a representative of the Department of Cultural Resources, Division of Archives and History (telephone 919-733-4763) must be contacted immediately. (4) A pumpout facility will be provided for boats with holding tanks. (5) All floating structures, other than boats, used for habitation or commerce (as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations for onshore sewage treatment. (6) The marina shall prominently post and enforce a locked-head policy for boats without holding tanks. (7) No septic tank systems may be placed in filled areas. NOTE: Approval for all septic tank systems must come from the local health department. Keith A. Box 128 Arapahoe, NC 28510 Dear Mr. Wolfenbarger: The enclosed permit is the State's authorization under the D-Euce and Fill Law (Re: N.C.G.S. 113-229) for you to carry out the excavation and fill work for your proposed project. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work crust be carried out in accordance with your application. Modifications, time extensions and future maintenance, not covered herein, require additional approval. The original (yellow form) of the permit is retained for your files and must be available on-site for inspection. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit as conditioned, you may request an appeal hearing before the Coastal Resources Can-aission as provided in G.S. 113-229. Your request must be directed to this office within twenty (20) days of receipt of the permit. Please read your permit carefully prior to starting work and review all project plans, as approved. If�ou are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you crnplete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, contact Department personnel at any time for assistance. Wolfenbarger Minnesott Beach Yach Basin Pamlico County This office has received a request from Mrs . Wolfenbarger to renew and modify the referenced permit, previously issued to them on June 18, 1984 . The work was in addition to work that was authorized under the old Dredge & Fill Permit No. 114-73 which had expired on January 31, 1980. Prsently the work authorized by both of these permits is essentially complete. The new excavation has been finished and the spoils are being stabilized. The applicant now proposes that this permit be modified to allow the remaining pier construction in the interior basin and long term (five year) maintenance excavation of all areas previously ex- cavated under Permits 114-73 and 109-84. I have no objections to this arrangement with the existing permit conditions, and have no objections to a five year permit for this maintenance. It is my understanding that you will let me know right away how many more copies you will need and whether or not we need them reduced in size ---so that we can move along on these permit renewals. Ref. my letter to Mr. Pate of 2/5 85, paragraph 3. . . .I will not need an extension of permit 19-82 which expires 12 85 (for further construction of the jetty). ..I was in error on that.. . .all we need is a maintenance permit if that is necessary. . . C. 28510 Dear Mrs. Wolfenbarger: This letter is to confirm our February 19, 1985, telephone con- versation concerning your recent request to renew State Permits Nos. 114-73; 109-847 and 19-82 issued to your husband, Dr. Keith A Wolfenbarger for work at the Minnesott Beach Yacht Basin. These permits were formerly issued to allow construction of the yachting facility which has been essent vto ation. ially completed, and your desire is maintain these permits to facilitate maintenance repair and exca- va Permit No. 114-73: We we discussed, this permit has expired and Permit No. 109-84 was issued to authorize the most recent excava- tion that essentially completes the basin dimensions. All the work has been completed except for the landscaping and erosion control activities being undertaken on the high ground. Permit No. 19-82: This -permit is for the jetty on the western side ' of the access channel extended into the Neuse River. Work under this' permit has not been completed as onl,T the shoreward one-half of the structure has been constructed. To process this request, our office will need for you to provide the following materials: (1) A letter requesting the minor modifi- cation and renewal of Permit 109-84. Permit modification will be from a new permit to a maintenance permit and the renewal should be requested for a period up to five years. (2) New drawings showing the existing marina facility and access channel into the Neuse River. These drawings should indicate the areas to be maintained, designated spoil areas, existing highground structures and facilities, along with existing piers and docks. This drawing should also show the proposed docks and piers on the east side of. the basin which have not yet been constructed. As of this writing, a full ten months of working time is available on this permit, and since renewal is a simple administra- tive matter for this office, check your progress on the structure in early December. If necessary at that time, send our office a renewal request. Renewals granted under such requests will only be I good for one year. Once the jetty structure is complete, mainte- nance and repair can be undertaken without a permit so long as the structure is maintained in. good condition.
