(1 ) No marsh grass will be excavated and/or fled/

(2) All excavated materials will be confined ve n high water and landward
of regularly or irregularly flooded mars h' d adequate dikes or other
retaining structures to prevent spillover o s ids into any marsh or surroun-
ding waters.
(3) Silt fences and/or other erosion and ' sediment control devices must be utilized
throughout active construction to minimize sediment from entering into adjacent
creeks, streams, properties, basins, waters, wetlands, etc.
(4) Slopes created by excavation of the basin must be left at an angle which
can be provided with a vegetative cover.
(5) All slopes, whether cut and/or filled, must be adequately stabilized by vege-
tative cover within 30 working days of any phase of such activity.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee Signed by the authority of the Secretary of DNRCD and
or other qualified persons within twenty (20) days of the the Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
For Maintenance Work With Hydraulic Dredge
(1 ) All excavated materials must be confined on highground behind adequate dikes
or other retaining structures to prevent spillover of solids into any marsh
or surrounding waters.
(2) The disposal area efflebhe

mean high water line or any marshland to eliminate the possibility of dike
erosion into or upon the adjacent waters and/or marshland. 0
General
(1 ) An erosion/sedimentation control plan must be submitted and must contain
all temporary and permanent measures to be utilized during construction.

(2) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-related
discharge.
(3) In the event that archaeological materials are encountered during excavation
or any other ground disturbing activities, work shall cease and a representative
of the Department of Cultural Resources, Division of Archives and History
(telephone 919/733-4763) must be contacted immediately.
(4) A pumpout facility will be provided for boats with holdinq tanks prior to
Ceptemue, 3C, i 988.
(5) This permit authorizes only the docks, piers, and other structures and uses
located in or over the water that are expressly and specifically set forth
in the permit application. No other structures, whether floating or stationary,
may become a permanent part of this marina without permit modification.
No non-water dependent uses or structures may be conducted on, in, or over
public trust waters without permit modification.

(6) The marina shall prominently post and enforce a "no sewage discharge" policy
for boats without holding tanks.
(7) No septic tank systems may be placed in filled areas. NOTE: Approval for
all septic tank systems must come from the local health depar ment.
NOTE: Any future development or harbor expansion as indicated on the plan
view dated 3/85 will require a modification of this permit.

original plat.

Dear Sir:
The enclosed permit constit4es authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original
(buff colored form) is retained by you and it must be available on-site when the project is inspected
for cmpliance. Please sign both the original and the copy and return the copy to this office in the
enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described
below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with N.C.G.S. Chapter
150E with the Office of Administrative Hearings, P..O. Drawer 11666, Raleigh, NC 27611 (919) 733-2698
within 20 days of this decision on your permit. You should also be aware that if another qualified
party submits a valid objection to the issuance of this permit within twenty (20) days, the matter
must be resolved prior to work initiation. The Coastal Resources Cormnission makes the final decision
on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all
work must be carried out in accordance with your application. Modifications, time extensions and future
maintenance require additional approval. Please read your permit carefully prior to starting work
and review all project plans, as approved. If you are having the work done by a contractor, it would
be to your benefit to be sure that he fully understands all permit requirements.
Fran time to time, Department personnel will visit the project site. To facilitate this review,
we request that you complete and mail the enclosed Notice Card just prior to work initiation. However,
if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit,
you will be helping to protect our vitally important coastal resources.

Dear. Mr. wolfenbarger:
Reference your State/Federal permit which authorizes you to maintain a
channel, canal and basin and construct marina facilities on the Neuse River,
Minnesott Beach, Pamlico County, North Carolina. Through coordination with
the North Carolina Division of Coastal Management, we have learned of the
renewal of your State permit.
Your work continues to be consistent with the provisions and objectives of
general permit No. CESAW-CO80-N-000-0291 . Therefore, you may continue work in
strict accordance with your renewed State authorization. Failure to comply
with the State authorization or conditions of the general permit could result
in a violation of Federal law.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

In reference to our phone conversation of this date, I wish to renew our state
permit for new work at the yacht basin (permit number 109-84)
The intended work is the construction/ relocation of our fuel dock, to (a.) make
it more accessible and (b) to get the fuel pumps et.al. removed from the center
of the marina
Because of limits of personnel and lack of time to work on this project, we
would request at least 15 months from date of issuance to complete this project.
I will appreciate your forwarding this request to the Department of Natural
Resources and Community Development in Raleigh.

SUBJECT: MINOR MODIFICATION - MAJOR PERMIT #109-84 - K. A.
WOLFENBARGER, PAMLICO COUNTY
DATE: FEBRUARY 26, 1988
The permittee is proposing to relocate their fuel dock by digging
into a 100 ' x 30 ' highground area to construct a dock and move
their fuel tanks adjacent to the new dock. The spoils from
excavation will be placed on highground. The applicant is also
proposing to construct 100 ' of bulkhead at the proposed fuel
dock.
John, I have no objections to the proposed modification.
However, their original permit #109-84 expired on December 31,
1987 for new work but is good for maintenance through 1990 .
Also, please note that this action was initiated January 11,
1988 .
Sorry for the delay but the file was difficult to locate.

Dear David:
Per our phone conversation of last week, please find attached a scale
drawing of our proposed new fuel dock area.
The only digging involved would be with drag line and involve only pulling
back the bank involved. The bulkheading will be capped with a walkway
and the W- will not be a pier as such being built out into the basin.
As I stated, our present fuel dock is almost inaccessible to larger
vessels and causing alot of congestion. Further I am eager to get
the fuel pumps out and away from the center of the basin.
Our plans regarding exact placement of the new fuel tanks is uncertain
but we will work on that aspect when ready.
I will appreciate your attention to this as we'd like to get started
soon on the project. . .but because of our shortage of help and the
lack of time to work at various projects, I would request the permit
allow us at least 15 months from time of issuance to complete the project.
Please give me a call before you come over to look at this proposed
project. . .so I will be here, or ask for "Paul" , my dockmaster who has
done the drawing, etc. and will basically be in charge of the construction.
