This 5/88 modification authorizes t ego ow g e elopment:

b) grading of a 75' x 200' sandy beach ab HW.
The following conditions apply to this modifica i
(1 ) All backfill material will come from an upland source.
(2) A representative of the Division of Coastal Management will stake the
bulkhead alignment prior to construction.

All existing work not completed must conform with the application, plats
and conditions as authorized by the 4/22/88 minor modification and renewal .

Dear Mr. Wolfenbarger:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original
(bu` colored form) is retained by you and it must be a-aila;le on-site when the project is inspected
for cctrpIiance. Please sign both the original and the copy and return the copy to this office in the
enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described
below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing mast be filed in accordance with N.C.G.S. Chapter
150B with the Office of Administrative Hearings, P. 0. Drawer 11666, Raleigh, NC 27611 (919) 733-2698
within 20 days of this decision on your permit. You should also be aware that if another qualified
party submits a valid objection to the issuance of this permit within twenty (20) days, the matter
must be resolved prior to work initiation. The Coastal Resources Comm ssion makes the final decision
on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all
work crust be carried out in accordance with your application. Modifications, time extensions and future
maintenance require additional approval. Please read your permit carefully prior to starting work
and review all project plans, as approved. If you are having the work done by a contractor, it would
be to your benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review,
we request that you ccarplete and mail the enclosed Notice Card just prior to work initiation. However,
if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may

Dear Mr. Wolfenbargger:
Reference your State/Federal permit which authorizes
maintenance of channel, canal, basin and marina facilities on the
Neuse River, Minnesott Beach, Pamlico County, North Carolina.
Through coordination with the North Carolina Division of
Coastal Management, we have learned of the modification of your
State permit to authorize the construction and backfill of a
bulkhead and the grading of a sand beach, all work landward of the
normal water elevation contour and any wetland vegetation. This
work is not subject to our regulatory jurisdiction; therefore, the
Federal authorization need not be modified.
You may continue activity in strict accordance with applicable
State authorization and subsquent modifications. If any
additional change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

Enclosed is a request by Minnesott Beach Yacht Basin to construct
500 ' of wooden bulkhead with backfill above MHW and to grade a
75 ' x 200 ' sandy beach area above MHW.
I have no objections to the proposed modification with the
following conditions:
1. All backfill material will come from an upland source.
/2. A representative of the Division of Coastal Management will
stake the bulkhead alignment prior to construction.
/3 . No grading work will be performed below MHW.
