Box 128 Arapahoe, NC 28510 BILL HOLMAN Dear Mr. & Mrs. Wolfenbarger: SECRETARY This letter is in reference to your application submitted to this office for State approval for a sand by-pass system adjacent to your property on the Neuse River, off Bennett Road, in DONNA D.MOFF,TT the Town of Minnesott Beach, Pamlico County. Unfortunately, there are some glaring DIRECTOR omissions in the application package that must be provided before it can be accepted as complete and circulated to the other review agencies for comments and processing. Perhaps the most obvious omission is the lack of any detail of the proposed sand by-pass system. Before a proposed project can be evaluated on its merits and its consistency with the rules, there must be some tangible "development" to evaluate. Your proposal essentially includes only a concept of a sand by-pass system and a rough location for the project. I recognize the fact that this is a difficult proposal but again, I must emphasize the need for a professional engineer or consultant with expertise in such types of development. Although RJ, Mr. Spencer Rodgers with NC Sea Grant may not be able to design your project, I do think he may be able to provide you with individuals schooled in the field who can. Specifically, there are numerous items that need addressing before the application can be considered complete and the full agency review can begin. Please address the following and P then return the completed application to this office. 1) On DCM-MP-1 under 3. a. This must be more project specific with a z description of development activities proposed. 2) Under 4. a. What is the size of the jetty and the beach area in front of your property as well as in front of MG&CC property? 3) Please provide a recent letter from MG&CC authorizes you to undertake development on their property. Also, please notify both adjacent riparian ". property owners via certified mail, return receipt requested. These two must be addressed in the proposal stage, not at a later time or undetermined. 7) Also, a project description of the proposed project should be provided. This narrative should discuss the character and purpose of the proposed development, construction methodologies and any other special or relevant considerations. 8) The one plat submitted is unacceptable. The workplat must show the development proposed. Please note that the plats must be neat and clear. If oversized plats are used please provide the Division with 25 copies. Each drawing must have a title block and be dated. The workplans must be accurately drawn to scale (1"=200' or less). You must submit a Location Map and a Cross-Sectional Drawing. This Cross-Sectional Drawing should include depth and elevation of jetty and proposed work relative to the existing ground and the normal water level must be on the plat. 9) If any filling activities are proposed in open water, then the application fee would be $400.00 (if under an acre). This fee amount is the combined CAMA/401 permit fee for both DCM and the Division of Water Quality. I strongly suggest that you get assistance from a professional consultant, engineer, etc. to design the project and address the concerns stated above. I have enclosed a CAMA Major Development Permit Application Checklist for your use. I am also returning the entire application along with the $250 application fee. Once you have made the above changes, please resubmit the application with appropriate plats, appropriate application fee, and green cards for agency review. This permit authorizes routine maintenance excavation of the existing access channel. The marina is currently in the process of removing spoil from the existing dredge spoil impoundment in anticipation of dredging in April. The renewal request meets the criteria established in T15A: 07J .0407. The project remains consistent R with both the 07H Guidelines for maintenance dredging of existing navigation channels and the Pamlico County Land Use Plan. Therefore, I have no objections to the request and recommend renewing the permit for a five year maintenance period. Should you have any questions regarding this matter, please contact me. The renewal is necessary to perform routine maintenance/excavation of the existing access channel, that we have performed since 1980. There are no planned changes for this project. We plan to perform the work as permitted previously. Since the maintenance/excavation of this area is required frequently, and an adequate spoil disposal area exists on the property, we request that another five year permit be issued for this work.
