C/o Mr. Chuck Bissette PO Box 650 Morehead City,NC 28557 Re: Request for Letter of Refinement, State Permit#168-05 Dear Mr. Bissette: This letter is in response to your request, as agent for Spooner's Creek Partners,LLC, for a refinement to State Permit#168-05, issued on November 15, 2005. The request was submitted to Mr. Ryan Davenport on January 18, 2006. The permit was originally issued for the replacement of the existing 2776' bulkhead along Bogue Sound. The new bulkhead as applied and permitted was to be located landward of the existing bulkhead. The permit was issued in accordance with associated plats depicting the proposal as such. Permit conditions require that the bulkhead be constructed landward of nhw and of coastal wetlands. You have now requested to remove the existing bulkhead in sections and construct the new bulkhead in the same footprint. Careful construction methodology must be employed to prevent the disturbance or sedimentation of the marsh adjacent to the bulkhead. I agree with the assessment made by Mr. Davenport that the proposal remains consistent with the applicable rules found in 15A NCAC 07H .0208. Please be advised that through this Letter of Refinement,DCM conveys its determination that the request as submitted on January 18,2006, is consistent with existing DCM rules and regulations and is in keeping with the original purpose and intent of the CAMA/Dredge and Fill permit.
