This permit, issued on June 27, 2007 is subject to compliance with the application (where consistent with the
permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein, this permit authorizes only the land disturbing activities associated
with establishment of the Riverside Drive subdivision, to include the construction of an access road,
associated grading, utilities and stormwater system installation and boardwalk, all as expressly and
specifically set forth in the permit application and depicted on the attached workplan drawings. Any
additional land disturbing activities and/or construction, including but not limited to single family home
f construction, shall be evaluated on a case-by-case basis by a representative of the Division of Coastal
Management (DCM) to determine additional permit requirements. Contact a representative of the
Division at (910) 796-7215 prior to the commencement of any such activity for this determination.

ADDITIONAL CONDITIONS
Stormwater Management y
2) The Division of Water Quality's approval of this project under stormw•ater management rules of the
Environmental Management Commission is covered by way of Stormwater Permit No. SW8040740,
which was issued on 5/16/07. Any violation of the permit approved by the DWQ shall be considered a
violation of this CAMA permit.
Sedimentation and Erosion Control
3) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
4) Appropriate sedimentation and erosion control devices, measures or structures (e.g. silt fence, diversion
swales or berms, etc.) shall be implemented to ensure that eroded materials do not enter adjacent

wetlands, watercourses and/or properties.
NOTE: The permittee has received a Sedimentation and Erosion Control Plan for the Riverside Drive
Subdivision from the NC Division of Land Resources (Project No. Bruns-2005-160). Should the
permittee choose to modify/amend the existing permit,he or she should contact the Department
t of Environment and Natural Resources; Land Quality Section, at 127 Cardinal Drive Extension,
Wilmington, NC 28405.

5) Any portion of the permitted boardwalk built over Coastal Wetlands shall not exceed six feet in width
and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of
the decking.

8) If a court of competent jurisdiction determines that a party other than the permittee has legal title to any
part of the area approved for development under this permit, this pen-nit shall be null and void as to the

area the court determines is not owned by the permittee. This condition shall take effect on the date
such court judgment becomes final. In such event, the permittee shall consult DCM prior to initiating or

ADDITIONAL CONDITIONS

9) In accordance with T15A:07H.0306(l). the authorized structures within the Ocean Hazard AEC shall be
relocated or dismantled when thev become imminently threatened by changes in shoreline configuration. `.
The structures shall be relocated or dismantled within two years of the time when it becomes imminently
threatened, and in any case upon their collapse or subsidence. However, if natural shoreline recovery or
beach renourishment takes place within two years of the time the structures become imminently
threatened, so that the structures are no longer imminently threatened, then they need not be relocated or
dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of
temporary protective measures allowed under Rule T15A:07H.0308(a)(2).
10) This Major Modification shall be attached to the original of Permit No. 42-05, which was issued on
3/31/05, and copies of both documents shall be readily available on site when a Division representative
inspects the project for compliance.
11) All conditions and stipulations of the active permit remain in force under this major modification unless
specifically altered herein. `
NOTE: All construction shall comply with the NC Building Code and all other Federal, State, and Local
regulations, including the local flood damage prevention ordinance as required by the National
Flood Insurance Program. The applicant should be aware of the requirement for CAMA Minor 3
Permits from the Town of Sunset Beach, for subsequent development of individual lots within
the 75' Estuarine Shoreline AEC. To obtain any minor permits please contact the Town of Sunset s
Beach, at 220 Shoreline Drive West, Sunset Beach, NC 28459.
NOTE: This permit does not eliminate the need to obtain an additional state federal or local permits,

approvals or authorizations that may be required.
NOTE: This permit does not convey any rights or privileges, either in real estate or material.
NOTE: The permittee is advised that any development or land disturbing activity that is considered non-
water dependent is not authorized within 30 feet of the normal high water level unless
specifically exempted by Coastal Resource Commission (CRC) regulations in place at the time
of such development.
NOTE: The building code or flood damage prevention ordinance may impose additional more restrictive
requirements than the Division's standards for development in Areas of Environmental Concern y

8. PROJECT SUMMARY: The applicant is proposing to expand the access road, install utilities and constrict a
stormwater infiltration system along Riverside Drive. Additionally,the application proposes to construct a 6' x 230'
boardwalk to access a hummock on the northern side of the peninsula.

9. PROJECT DESCRIPTION
Please refer to the Field Investigation Report(FIR)for Tidal Ventures,LLC C/o Sammy Vamum,prepared by Jason Dail and
circulated on 2/07/05.
CAMA Major permit#42-05 was issued to Tidal,Ventures,LLC,authorizing the construction/installation of an access road,
bulkhead and utilities.Following pen-nit issuance, the permittee constructed the approved bulkhead,however no subsequent
development has taken place.
The waters of Jinks Creek are classified as SA HQW by the North Carolina Division of Water Quality and are open to the
harvest of shellfish. The man-made canal on the south side of the property is closed to shellfishing.The project site is located
within the Ocean Hazard Area(as designated by the North Carolina Coastal Resources Commission)based on the most recent
FEMA Flood Insurance Rate Maps(FIRM).
PROPOSED PROJECT;
The permittee is proposing to expand the access road, install utilities and construct a stormwater infiltration system.
Additionally, the application proposes to construct a 6'x 230' boardwalk to access a hummock on the northern side of the
peninsula.
As stated in the previously circulated field investigation report,the permittee proposes to develop the property into a 68-lot
residential subdivision.Development would include the initial grading and filling of approximately 10 acres to allow for
proper drainage,road construction and utilities installation.
Beginning at the entrance to the property(Riverside Drive),the applicant proposes to construct a marl road spanning
approximately 3,750 feet to the east, terminating along the western side of lot 94.The modification request includes the
expansion of the permitted road from approximately 12 feet to 16 feet in width with a 25 to 40-foot right-of-way(width
varies due to road contour).Additionally,a stormwater infiltration system(trench system)would be installed along the
southern side of Riverside Drive,within the right-of-way.The trench would average 13 feet in width and span nearly the
entire road length. Overflow catch basins would be installed south of the infiltration trench and discharge overflow through
vegetated swales.The proposed swales(10' wide x various lengths greater than 75')would be located between every other
lot and would drain to the south towards the man-made canal. Lastly, the permittee is requesting approval to construct a 6'
x 230' boardwalk to access a nearby hummock located on the northern side of the peninsula.According to the deed
documentation and the Brunswick County tax office,the hummock is located within the permittee's property boundary.
The walkway would originate along the bulkheaded shoreline,north of Lot 46,and span approximately 230' feet to the
north across mixed coastal wetland vegetation.The walkway would terminate on high ground located on the southern side
of the hummock. Property owners would be able to access the backwaters of the sound from the hummock.
The applicant has indicated that individual septic systems would be installed to collect wastewater.The systems,including
the drain fields,would be located in what is listed on the drawings as the"common areas".According to the applicant,the
wastewater collection systems have been authorized by Brunswick County.Municipal water would be provided by Sunset
Beach.
According to the Division of Water Quality, the applicant has submitted,but has not yet obtained a High-den sity
stormwater permit for the proposed development. Currently,a low-density permit is active and the project is covered under
DWQ Stormwater Permit SW8040740,issued 2/10/05.Additionally, the applicant has received an approved Sedimentation
and Erosion Control Plan from the Division of Land Resources(Bruns-2005-160), issued on 11/30/04.

10. ANTICIPATED IMPACTS:
The initial grading of the property,including road construction,utilities and stormwater system installation,board%valk/access
' pier construction,would result in the disturbance of approximately 10.0 acres ofhighground and roughly 1,380sq.ft.ofcoastal
wetlands(shaded only),The proposed roadway extension would result in the creation of approximately 57,946 square feet of
impervious surface. Several sections of the road would be located within the 75'Estuarine Shoreline AEC,beginning at lot 76
and running east towards lot 94.Subsequent individual lot development would create additional impervious surface area and
would require individual lot owners to obtain CAMA Minor Development Permits from the Town of Sunset Beach,if located
within a CAMA AEC.

Recommendations for State Permit—Tidal Ventures, LLC C/o Sammy Varnum
It is recommended that a permit be issued subject to the following conditions:
• In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
• All structures shall be located landward of the 30' Coastal Shoreline Buffer.
• All construction shall comply with building requirements of the N.C. Building Code, and the local flood
damage prevention ordinance as required by the National Flood Insurance Program. If any provision of
the building code or a flood damage prevention ordinance is inconsistent with any AEC standards,the
more restrictive provision shall apply.
• Appropriate sedimentation and erosion control devices,measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands,watercourses and property(e.g. silt fence,
diversion swales or berms, sand fence, etc.).
• A ground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30
calendar days of completion of any phase of grading on cut or filled slopes.
• Permit shall be conditioned to include gravel removal following permit issuance.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local
permits, approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this
permit. Contact a representative of the Division at(910) 796-7215 prior to the commencement of any
such activity for this determination.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the
Division prior to project initiation.

PROJECT NARRATIVE

Riverside Drive
Sunset Beach,Brunswick County,NC
Tidal Ventures is proposing to develop property located on the east end of Sunset Beach as a 68 lot
residential subdivision. The property consists of 38-acres upland of mean high water with 10-acres of
that landward of coastal vegetation. The property is currently an undeveloped beach tract, consisting
mostly of beach vegetation. There is an existing dirt road and a bulkhead that was permitted under the
Coastal Resource Commission Permit for Major Development,42-05,on March 31,2005. The proposed
development includes the construction of a marl road, installation of waterline, and a stormwater trench
system to serve the residential lots. The water will be provided by the Town of Sunset Beach. Individual
on-site septic systems approved by the Brunswick County Health department will be utilized until such
time that County sewer is available,at which time a sewerline will be installed.
There is an existing Stormwater Permit (SW8 040740) that was issued for this property February 10,
2005. The permit was approved assuming that the property will be less than twenty-five (25) percent
impervious and the stormwater from these impervious areas will sheet flow off the property. The
developer proposed to modify the existing SW permit to a high density permit. The stormwater will be
directed to an infiltration system designed to collect the first 1%z"of rain.
Tidal Ventures already has an Erosion Control Permit,dated November 30,2004(Bruns-2005-160).

The Department of Environment and Natural Resources hereby gives public notice as required by
NCGS 113A-119(b) that application for a development permit in an Area of Environmental Concern as
designated under the CAMA was received on 5/17/07.
According to said application, Tidal Ventures, LLC c/o Sammy Varnum for Riverside Drive
proposes to expand the access road, install utilities, construct a stormwater infiltration system, and a 6' x
230' boardwalk to access a hummock on the northern side of the peninsula at Riverside Drive, adjacent
to an unnamed canal and Jinks Creek, in Sunset Beach, Brunswick County.
A copy of the entire application may be examined or copied at the office of Jason Dail at N.C.
Environment and Natural Resources, Division of Coastal Management, 127 Cardinal Drive Extension,
Wilmington, North Carolina 28405, (910-796-7215) during normal business hours.
Comments mailed to Charles S. Jones, Director, Division of Coastal Management,400 Commerce
Avenue, Morehead City, NC 28557, prior to 6/11/07, will be considered in making the permit decision.
Later comments will be accepted and considered up to the time of permit decision. Project modification
may occur based on review and comment by the public and state and federal agencies. Notice of the
