1) This transfer shall be attached to copies of the following attached permit documents, which includes
all application forms and workplan drawings:
a. Permit 42-05, which was issued on 3/23/05, and
b. the minor modification of 1/21/14.
2) Copies of all referenced documents shall be readily available on site when a Division representative
inspects the project for compliance. In accepting this transfer,the new permittee agrees that all
conditions and stipulations of the active permit remain in force.
This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable,the State Dredge and Fill Law,for you to proceed with your project proposal.The original(buff-colored
form)is retained by you and it must be available on site when the project is inspected for compliance.Please sign
both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229.Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center,Raleigh,NC 27611-6714,(919)733-2698 within twenty
(20)days of this decision on your permit.You should also be aware that another qualified party may submit an
objection to the issuance of this permit within twenty(20)days.
The project plan is subject to those conditions appearing on the permit form. Otherwise,all work must be
carried out in accordance with your application.Modifications,time extensions, and future maintenance requires
additional approval.Please read your permit carefully prior to starting work and review all project plans,as
approved. If you are having the work done by a contractor,it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time,Department personnel will visit the project site.To facilitate this review,we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions,environmental safeguards,or problem areas,you may contact Department personnel
at any time for assistance.By working in accordance with the permit,you will be helping to protect our vitally
important coastal resources.

Richard Mace Watts on behalf of Sunset Beach Holdings, LLC is requesting the transfer of State Permit#42-05 issued
to Tidal Ventures, LLC authorizing the development of the Riverside Drive Subdivision,to include the construction of an access
road, associated grading, utilities and storm water system installation, boardwalk and kayak access pier located on the
peninsula located off North Shore Drive West, adjacent the feeder canal in the Town of Sunset Beach, Brunswick County.
Mr. Watts states that the transferred permit will be used for the same purposes for which it was issued; that there
will be no substantial change in the conditions, circumstances, or facts affecting the project; and the transferred permit will
not result in substantial change or modification of the project as proposed in the original application.
The applicant has submitted a check (ck. #2026) in the amount of$100.00 for the transfer request, as well as a copy
of the deed to the property and a copy of the permit.
This Office has no objection to the permit transfer request.

Modification and Renewal of CAMA Major Permit#42-05
To Whom It May Concern,
CAMA Major Permit #42-05 was issued to Tidal Ventures, LLC for the
development of a residential subdivision located along Riverside Drive adjacent to a man-made
canal within the Town of Sunset Beach. Permit#42-05 authorized the establishment of the
Riverside Drive subdivision,to include the construction of an access road, associated grading;
utilities and storm water system installation, boardwalk, and access pier.
I am requesting that the permit be transferred to the new owner Sunset Beach
Holdings LLC. Attached are copies of the closing statement showing the new party having the
right to develop the project. The applicant transferee will use the permit for the purpose for
which it was issued. There will be no substantial change in conditions, circumstances, or facts
affecting the project.

additional land disturbing activities and/or construction, including but not limited to single family home
construction, shall be evaluated on a case-by-case basis by a representative of the Division of Coastal
Management (DCM) to determine additional permit requirements. Contact a representative of the }'

2) The Division of Water Quality's approval of this project under stormwater management rules of the <
Environmental Management Commission is covered by way of Stormwater Permit No. SW8040740,
which was issued on 5/16/07. Any violation of the permit approved by the DWQ shall be considered a
violation of this CAMA permit.

Sedimentation and Erosion Control
3) In order to protect water quality,runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
4) Appropriate sedimentation and erosion control devices,measures or structures (e.g. silt fence, diversion
swales or berms, etc.) shall be implemented to ensure that eroded materials do not enter adjacent
wetlands, watercourses and/or properties.
t NOTE: The permittee has received a Sedimentation and Erosion Control Plan for the Riverside Drive
Subdivision from the NC Division of Land Resources (Project No. Bruns-2005-160). Should the
permittee choose to modify/amend the existing permit,he or she should contact the Department
of Environment and Natural Resources; Land Quality Section, at 127 Cardinal Drive Extension,
Wilmington,NC 28405. x

5) Any portion of the permitted boardwalk built over Coastal Wetlands shall not exceed six feet in width
t and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of
the decking.

f6) This permit does not authorize the excavation or filling of any wetlands or open water areas, even f
temporarily.
7) The permittee shall contact the Department of Transportation to determine if permits are required for
x driveway connections or encroachments to N. Shore Drive or Riverside Drive.
} 8) If a court of competent.jurisdiction determines that a party other than the permittee has legal title to any
part of the'area approved for development under this permit, this permit shall be null and void as to the
area the court determines is not owned by the permittee. This condition shall take effect on the date
# such court judgment becomes final. In such event, the permittee shall consult DCM prior to initiating or
t continuing any further development under this permit.

This permit, issued on March 31, 2005 , is subject to compliance with the application (where consistent with the
permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to fines,imprisonment or civil action;or may cause the permit to be null and void.
Upland Development
1) This permit authorizes only the land disturbing activities associated with establishment of the Riverside
Drive subdivision, to include the construction of an access road and associated grading, bulkhead and
utilities installation, all as expressly and specifically set forth in.the permit application and depicted on
the attached workplan drawings. Any additional land disturbing activities and/or construction, including
but not limited to single family home construction, shall be evaluated on a case-by-case basis by a
representative of the Division of Coastal Management (DCM) to determine additional permit
4 requirements. Contact a representative of the Division at (910) 395-3900 prior to the commencement of
any such activity for this determination.The permittee is further advised that many non-water dependent
activities are not authorized within 30 feet of the normal high water level.

Stormwater Managemment
2) The Division of Water Quality's approval of this project under stormwater management rules of the
Environmental Management Commission is covered by way of Stormwater Permit No. S W8040740,
which was issued on 2/10/05 Any violation of the permit approved by the DWQ shall be considered a
violation of this CAMA permit.
Sedimentation and Erosion Control
3) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
4) Appropriate sedimentation and erosion control devices,measures or structures(e.g. silt fence,diversion
swales or berms,etc.)shall be implemented to ensure that eroded materials do not enter adjacent
wetlands,watercourses and/or properties.
NOTE: The permittee has received a Sedimentation and Erosion Control Plan for the Riverside Drive
Subdivision from the NC Division of Land Resources(Project No.Bruns-2005-160). Should the
permittee choose to modify/amend the existing permit,he or she should contact the Department
of Environment and Natural Resources;Land Quality Section,at 127 Cardinal Drive Extension,
Wilmington,NC 28405.
Shoreline Stabilization
5) The alignment of the permitted bulkhead shall be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of any construction. Failure to initiate
construction within 30 days,or erosion of the shoreline by adverse weather conditions,will require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction
6) The bulkhead shall be constructed landward of all vegetated wetlands.
7) The bulkhead shall be constructed prior to any backfilling activities.
8) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
9) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation is permitted except for that which
may be required for the construction of the retaining wall,riprap,deadmen cables,etc. This permit does
not authorize any excavation waterward of the approved alignment.
10) The fill material will be clean and free of any pollutants except in trace quantities.

11) All backfill material will be obtained from a high ground source and confined behind the permitted
retaining wall.
12) No backfill material is to be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
General
13) This permit does not authorize the excavation or filling of any wetlands or open water areas,even
temporarily.
14) The permittee shall contact the Department of Transportation to determine if a permit is required for
driveway connection to N. Shore Drive.
15) If a court of competent jurisdiction determines that a party other than the permittee has legal title to any
part of the area approved for development under this permit, this permit shall be null and void as to the
area the court determines is not owned by the permittee. This condition shall take effect on the date
such court judgment becomes final.In such event,the permittee shall consult DCM prior to initiating or
continuing any further development under this permit.
