This permit, issued on September 1,2020 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) This renewal shall be attached to Permit No. 176-05, which was issued to the permittee on 11/9/05,
as well as all subsequent modifications, refinements, and renewals, and copies of all documents shall
be readily available on site when a Division representative inspects the project for compliance.
2) All conditions and stipulations of the active permit remain in force under this renewal.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No.
05-1871 V2.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No.
2006-10026 and 2010-00731.
NOTE: A permit renewal application processing fee of$100 was received by DCM for this project.
This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

Cultural artifacts at the site. A renewal has been requested for the project and we are circulating the renewal request to
our agencies to determine if any changes to the site or rules for any agencies would prohibit the renewal from being
authorized. So if you have any questions or concerns let me know and I can make sure DCM staff is aware.

1 just didn't see her name.The site is/was an excellent Indian and colonial site that should have had more stops to it
during initial development. So much pottery, pipes, etc.They should have been pulled in more earlier and with the Lost
Colony efforts since 2005, 1 didn't know.

FYI this is a 3 part email.
Please refer to the above attachment(s) for materials associated with a renewal request for an active CAMA
permit. It has been determined that "no substantial development" has occurred on site since the last permit
action. Due to this determination, the active permit cannot be renewed under CRC rule, but the rule does allow
for circulation of the request to resource agencies to provide comment to any changes in circumstances or
site conditions, or changes in your agency's rules or development standards that warrant a new
application and CAMA major permit review.
Therefore, DCM is requesting that your agency review the above materials to determine if site conditions or
circumstances, or agency rules would prohibit DCM from issuing a renewal of the CAMA permit. Please provide
comment within 21 days of receipt of this email to any changes in site conditions or rules that would prohibit
DCM from issuing a permit renewal. If no reply is provided within 21 days of receipt, then DCM will assume

RE: Renewal of CAMA Major 138-06
Dear Ms. Roundtree:
I am writing to request the renewal of CAMA Major #176-05 (the"Permit'), issued to Rial
Corporation. The Permit was originally issued on 11/09/2005 for a new subdivision, golf course
with clubhouse, shoreline stabilization, access roads and parking areas. Since then, Quible &
Associates, P.C. (Quible) was engaged to assist with permitting of a marina on Salmon Creek
and a Major Modification to permit #176-05 was issued on 12/09/2010 for a 92 slip marina on
Salmon Creek. Based on the applicable permit extension acts, the expiration date was
1/22/2015. On 12/30/2014, Quible requested what constituted the first renewal of the marina
permit which was granted on 3/3/2015, with an expiration date of 1/22/2017. The second
renewal was issued on December 1, 2017. Therefore, this constitutes the third renewal request.
This is a broad CAMA Major Permit that has been relied on for many facets of the development
with the intent of being able to utilize this for future work and modifications thereof. The tract is
bound on 3 side by water bodies, including the Albemarle Sound and Salmon Creek. The
following is a summary of work completed and ongoing:
• On 5/03/2012, a Letter of Refinement was issued for fencing, pool patio and associated
grading in the Clubhouse area at Scotch Hall Preserve. This work has been completed.
• On 2/27/2013, a Minor Modification was issued for shoreline stabilization bulkhead and
associated grading in the vicinity of what is referred to as Lot 158-160. These are
Albemarle sound-fronting lots. This work has been completed.
• In 2012-2013, a portion of the marina was constructed which is limited to Pier #3 with
associated boat slips and the boat ramp area. In association with this activity:
• On 1/14/2013, a Letter of Refinement was issued for constructing rectangular finger
piers instead of triangular (on Pier 3), addition of 63 ft to Pier 3 in a landward direction to
provide upland access, 22 ft long extension to the Pier 4 (boat ramp staging pier). This
work has been completed.

■ On 3/12/2013, a Letter of Refinement was issued to allow vinyl sheet piling rnliT ' p1;
boards to prevent underwashing of the ramp. This work has been completed.
• On 4/29/2013, a Letter of Refinement was issued for an increase of the width of the
sheet piling cap boards from 24" to 36". This is to be used as a catwalk on each side of
the boat launch ramp. This work has been completed.
■ On 12/9/2015, SHP coordinated with NCDCM and the HOA to include the addition of
provisions for private docks by individual homeowners on waterfront (amendment to
HOA covenants).
■ 8/1/2016— 10/1/2016, Comprehensive planning and pricing associated with the
permitted fuel system at the existing marina. Quible worked closely with SHP and
OESSCO to develop a plan for this component. The capital expenditure to complete
that effort was not financially feasible, but there are plans to accomplish this in the
future.
■ On 6/22/2020, Quible and representatives from SHP met with Cynthia Rountree of DCM
to discuss CAMA Major renewal and also to visually review and discuss future repair and
maintenance for portions of the soundfront bulkhead.
In the marina area, none of the remainder of the piers, slips and boardwalks have been
constructed at this time and neither has the parking area and ship store. Rial has undertaken
substantial development activity in reliance upon the Permit as described above. Rial remains
committed to the marina and other development activities at Scotch Hall Preserve, as permitted.
As regional economic conditions have begun gaining momentum and new markets are realized,
SHP is ready to continue developing the permitted project.
I have enclosed the $100 renewal processing fee, a copy of the permit modification and
renewals, and a copy of the marina area CAMA plan which was last updated on 3/06/2013 in
association with the last Letter of Refinement.

9) Prior to the initiation of any land-disturbing activities authorized by this modification, the permittee
shall, in coordination with the N.C. Department of Cultural Resources (NCDCR),develop and
implement an archaeological survey of the propbsed project area. Initiation ol'permitted land-disturbing
activities shall not begin unti I written approval i i obtained from NCDCR,and a copy of such approval
has been received by the Division of Coastal Management.
10) This minor modification shall be attached to the original Permit No. 176-05, which was issued on
1 1/9/05, as well as Al subsequent modifications and refinements,and copies of all documents shall be
readily available on site when Division personnel inspect the project for compliance.
