This permit, issued on December 1,2017 , is subject to compliance with the application(where consistent with the permit), all applicable regulations, special conditions and notes set forth below.Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This renewal shall be attached to Permit No. 176-05, which was issued to the permittee on 11/9/05, as well as all subsequent modifications, refinements, and renewals, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 2) All conditions and stipulations of the active permit remain in force under this renewal. NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 05-1871 V2. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No. 2006-10026 and 2010-00731. NOTE: A permit renewal application processing fee of$100 was received by DCM for this project. This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. The Permit was originally issued on 11/09/2005 for a new subdivision, golf course with clubhouse, shoreline stabilization, access roads and parking areas. Since then, Quible & Associates, P.C. (Quible) was engaged to assist with permitting of a marina on Salmon Creek and a Major Modification to permit #176-05 was issued on 12/09/2010 for a 92 slip marina on Salmon Creek. Based on the applicable permit extension acts, the expiration date was 1/22/2015. On 12/30/2014, Quible requested what constituted the first renewal of the marina permit which was granted on 3/3/2015, with an expiration date of 1/22/2017. This is a broad CAMA Major Permit that has been relied on for many facets of the development with the intent of being able to utilize this for future work and modifications thereof. The tract is bound on 3 side by water bodies, including the Albemarle Sound and Salmon Creek. The following is a summary of work completed and ongoing: ■ On 5/03/2012, a Letter of Refinement was issued for fencing, pool patio and associated grading in the Clubhouse area at Scotch Hall Preserve. This work has been completed. • On 2/27/2013, a Minor Modification was issued for shoreline stabilization bulkhead and associated grading in the vicinity of what is referred to as Lot 158-160. These are Albemarle sound-fronting lots. This work has been completed. ■ In 2012-2013, a portion of the marina was constructed which is limited to Pier #3 with associated boat slips and the boat ramp area. In association with this activity: ■ On 1/14/2013, a Letter of Refinement was issued for constructing rectangular finger piers instead of triangular (on Pier 3), addition of 63 ft to Pier 3 in a landward direction to provide upland access, 22 ft long extension to the Pier 4 (boat ramp staging pier). This work has been completed. ■ On 3/12/2013, a Letter of Refinement was issued to allow vinyl sheet piling with cap boards to prevent underwashing of the ramp. This work has been completed. ■ On 4/29/2013, a Letter of Refinement was issued for an increase of the width of the sheet piling cap boards from 24" to 36". This is to be used as a catwalk on each side of the boat launch ramp. This work has been completed. ■ On 12/9/2015, SHP coordinated with NCDCM and the HOA to include the addition of provisions for private docks by individual homeowners on waterfront (amendment to HOA covenants). ■ 8/1/2016— 10/1/2016, Comprehensive planning and pricing associated with the permitted fuel system at the existing marina. Quible worked closely with SHP and OESSCO to develop a plan for this component. The capital expenditure to complete that effort was not financially feasible, but there are plans to accomplish this in the future. In the marina area, none of the remainder of the piers, slips and boardwalks have been constructed at this time and neither has the parking area and ship store. Rial has undertaken substantial development activity in reliance upon the Permit as described above. Rial remains committed to the marina and other development activities at Scotch Hall Preserve, as permitted. As regional economic conditions have begun gaining momentum and new markets are realized, SHP is ready to continue developing the permitted project. I have enclosed the $100 renewal processing fee along with (3) full sized copies of the marina area CAMA plan which was last updated on 3/06/2013 in association with the last Letter of Refinement. On 9 December 2010 a Major Modification was issued for the development of a 92 slip marina with 3 piers and associated boat ramp,parking areas,roads, ship store and pool adjacent to Salmon Creek. There has been multiple Letter of Refinements and a Minor Modification to the original Major CAMA permit. This is the second renewal, The permit was last renewed on 3 March 2015 with an expiration date of 22 January 2017 The shoreline stabilization, boat ramp, one of the piers, pool and pool patio have been completed. The docking facility is partially complete. Therefore, I recommend the renewal of this permit. The $100 fee to cover the cost of the renewal has been deposited in the Department's account.
