Dear Mr. Rubino:
This letter of refinement is in reference to your 23 April 2013 correspondence (attached), requesting a
modification of Major CAMA Permit No. 176-05. This permit was originally issued to Innsbrook, for the Rial
Corporation, on 9 November 2005 for the development of a new subdivision with 399 single family lots, a golf
course with clubhouse, shoreline stabilization, access roads, and parking areas adjacent the Chowan River. A
Major Modification was issued on 9 December 2010 to Rial Corporation for the development of a 107-slip marina
and associated boat ramp, parking areas, roads, ship store and pool adjacent to Salmon Creek. The authorized
development, formerly known as Innsbrook, at Scotch Hall Preserve is located on the Chowan River and Salmon
Creek, near the Merry Hill Township, at the end of SR 1502 in Bertie County, North Carolina. The permit has been
refined on several occasions and currently has an expiration date of 22 January 2015 under the name of Rial
Corporation referred to as Scotch Hall Preserve.
Your 23 April 2013 correspondence was a request to amend the permit to allow for the two vinyl sheet pile
jetties on each side of the boat ramp to be constructed with 30" wide cap boards atop each jetty, rather than the
authorized width of 24" cap boards (reference Letter of Refinement dated 12 March 2013), to serve as a catwalk
for launching boats. A 30" wide cap on each jetty that extends ±33' below normal water level (NWL) of Salmon
Creek will result in an increase of±165 ft2 shaded impact over Public Trust'Area, Area of Environmental Concern
(AEC) of Salmon Creek, rather than the previously authorized increase of±132 ft2 of additional shaded impact by
24" wide cap boards. A 6" increase in width of cap boards on the two jetties, from 24" to 30", to stabilize the boat
ramp and provide boat launch access in association with the Phase 1 manna construction, is hereby authorized.
All permit conditions including the 22 January 2015 expiration date still apply and remain unchanged.

Dear Ms. Hedrick,
The purpose of this correspondence is to request a Letter of Refinement to CAMA Major Permit 176-05 in
association with the boat ramp that has been constructed. The boat ramp construction included bulkheads along
both sides of the concrete ramp which extend above water and act as jetties. This was permitted through a prior
Letter of Refinement. Also permitted, on top of the bulkhead/jetty structures, is a cap board decking (24"wide) to
be utilized as a catwalk for launching boats and is shown on our structural design sheet. Upon inspections of
boat ramp area after construction, it was observed that the catwalk was actually constructed 30" wide instead of
24" (6"' wider than permitted). The purpose of this letter is to request a Refinement for the additional 6" catwalk
on each of the jetties.
