Drawer 870 DCM-MHD c1TY Kitty Hawk, NC 27949 Dear Mr, Rubino; This letter of refinement is in reference to your 9 January 2013 correspondence (attached), requesting a modification of Major CAMA Permit No. 176-05. This permit was originally issued to Innsbrook, for the Rial Corporation, on 9 November 2005 for the development of a new subdivision with 399 single family lots, a golf course with clubhouse, shoreline stabilization, access roads, and parking areas adjacent the Chowan River. A Major Modification was issued on 9 December 2010 to Rial Corporation for the development of a 107-slip marina and associated boat ramp, parking areas, roads, ship store and pool adjacent to Salmon Creek. The authorized development, formerly known as Innsbrook, at Scotch Hall Preserve is located on the Chowan River and Salmon Creek, near the Merry Hill Township, at the end of SR 1502 in Bertie County, North Carolina, The permit has been refined on several occasions and currently has an expiration date of 22 January 2015 under the name of Rial Corporation referred to as Scotch Hall Preserve. Your 9 January 2013 correspondence was a request to amend the permit to allow for (1)the eight finger piers on"Pier 3"to be constructed in a rectangular rather than tapered design, resulting in an increase of a total of 76 ft2 of shaded impact over Salmon Creek; (2) the addition of a 63'long by 8'wide landward extension of'Pier 3" to provide upland access, resulting in an additional 85 ft2 shaded impact over Salmon Creek and 418 ft2 over uplands; (3) and a 22' long by 6'wide extension to the existing boat launch "Pier 4," resulting in an increase of 132 ft2 of shaded impact over Salmon Creek, The aforementioned three items result in a total of 293 ft2 of additional shaded impact over the Public Trust Area, Area of Environmental Concern (AEC) of Salmon Creek, all in association with the Phase 1 marina construction, is hereby authorized. All permit conditions including the 22 January 2015 expiration date still apply and remain unchanged. Your plat sheet 1, titled Scotch Hall Preserve Marina, dated revised 9 January 2013, will become a permanent part of the file. Please be reminded that in accordance with condition No. 13 of State Permit No. 176-05 MM, railing shall be constructed along the shallow water portions of the piers. Therefore, during Phase 1 of the marina construction, the railing shall be constructed on"Pier 3"from normal water level (NWQ of Salmon Creek and extend waterward up to the first set of finger piers adjacent slips 76 and 92, Thank you for your time and cooperation in this matter. As we have discussed, the owners are pursuing a portion of the marina at this time which includes the smallest of the three marina piers (Pier 3) and the boat ramp and Pier 4 (the staging pier). This work is being referred to as Phase 1 Marina Construction and includes the items listed on the attached plan with modification date 1/9/13. 1 have also included a copy of the permitted plan. Project#1 of the Phase 1 marina includes Pier 3 and Project #2 includes the ramp and staging pier(Pier 4) During our pre-construction meeting on 1/8/2013 we discussed some minor items that will require a documented refinement including: 1. Finger Piers: Instead of 13 ft long finger piers as permitted, we are requesting that 14 ft long rectangular pier be constructed 3 ft wide). There are a total of 8 finger piers. This rectangular construction will add 9.5 sq.ft. of shading impacts per pier (76 sq.ft. total). 2. Pier 3 access: Since the shoreline-parallel walkway will not be built at this time, Pier 3 will be a stand- alone marina pier at this time. Therefore, a landward extension of this pier is required for access. This extension is a total of 63 additional If (85 sq.ft. over water and 418 sq.ft. over land). 3. Pier 4 extension: This pier for staging and boat access is proposed to be extended in a waterward and a landward direction The pier is proposed to be extended 22 ft waterward (132 sq ft over water) and 20 ft over land (120 sq.ft.). As we discussed on site, the Phase 1 Marina Construction project is being initiated at this time, with the goal of installing all in-water piles prior to the DMF moratorium. Please note that no fueling system is proposed at his time, but the owners would like to reserve the ability to construct this in the future along with other phases of the marina.
