Docking Facility, '1) In accordance with commitments made by the permittee, this permit only authorizes new slips 168, 122A, 165, 15813, 153 and 154, all as depicted on the attached workplan drawings. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. PROJECT SUMMARY: The applicant proposes to construct four additional floating docks/finger piers within the Waterfronte Villas Marina. The additional docks/finger piers would create 10.new slips within the marina. Waterfronte Development,LLC Page Two 9. PROJECT DESCRIPTION The project site is located at the end of Spencer Farlow Drive,adjacent to the Atlantic Intracoastal Waterway and Carolina Beach Yacht Basin, in Carolina Beach,New Hanover County. To get to the site,take Hwy 421 south from Wilmington into Carolina Beach. Turn left onto Lewis Drive and then an immediate left onto Access Road. Turn right onto Spencer Farlow Drive from Access Road and Waterfronte Villas will be located at the end of the Road. The lot averages 6-10 feet above mean sea level. Waterfronte Villas and Marina currently operates as a full- service residential and commercial docking facility. The Waterfronte Marina facility is comprised of approximately 4.37 acres and is located at the far end of the Spencer Farlow Drive.The facility is used to provide marina services to the residents of the Waterfronte Villas,as well as for commercial use. Existing man-made features on the tract include: several town home units, a docking facility, maintenance building, swimming pool,clubhouse and a bulkhead.The tract is developed with very little vegetation. Lawn grasses and ornamental landscaping represent the majority of on-site vegetation. Waterward of the bulkhead adjacent to "C-Dock" exhibits an area of coastal marsh measuring approximately 200' in width by 100' in length consisting primarily of Smooth Cordgrass Marsh(Spartina alterniora)and Black Needlerush(Juncus roemarianus). There also exists an area of coastal marsh measuring approximately 350' in length by 100' in width located at the northern side of"A-Dock"consisting primarily of Smooth Cordgrass Marsh and Black Needlerush. The existing water depths at this location of the marina range from approximately—0.5' to—2.0' @ Mean Low Water(MLW). CAMA Major/Dredge and Fill Permit# 168-96 was originally issued to Snow's Cut Marina Townhouses c/o Northcrest Investment, Co. in December 1996.The permit was transferred to Snow's Cut Marina Townhouses c/o Ellsworth-Sloan, LLC in May of 1999. In July 1999,the permit was transferred to Waterfronte Villas and Yacht Club c/o Ellsworth-Sloan, LLC. The most recently renewed permit expired in December 2003. The previously issued permits included dredging activities in the areas surrounding the floating docks as well as the entrance to the boat basin. The Waterfronte Villas and Marina facility is submitting this major permit application for modification to their existing CAMA Major/Dredge and Fill Permit No. 84-05,which was issued through the Express Program. State Permit No. 84-05 authorized maintenance dredging within the marina basin and the addition of 16 slips creating a total to 169 slips. The Town of Carolina Beach Land Use Plan classifies the area in the vicinity of the project area,as Developed. The waters in the project area are classified as SB by the N.C.Division of Water Quality. They are NOT designated as a Primary Nursery Area(PNA)by the N.C.Division of Marine Fisheries,and they are CLOSED to the.harvest of shellfish. PROPOSED PROJECT The applicant is requesting a Major Modification to existing State Permit# 84-05 to create and additional ten slips by adding four additional floating docks/finger piers. The location of the proposed docks,as indicated on the work plat drawings,are as follows: one 3' in width by 15' in length floating dock(Al)would be located on the southern side of existing"A-dock"extending towards the south. This floating dock would accommodate slip# 173. The applicant is proposing designation of four additional slips on the northern side of existing"A-Dock"without any construction of additional floating docks/finger piers. These slips would be designated as# 174- 177. One 3' in width by 25' in length floating dock(B 1)would be located on the northern side of the gangway ramp leading to existing`B-Dock". The floating dock would run in the same alignment as`B-Dock"and would accommodate slip # 171. An additional slip would be designated without any construction of a floating dock/finger pier,which would be located on the northern side`B-Dock". This slip would be designated as# 172. The application states that these six additional slips would be designated for smaller vessels only,due to the existing water depth. Wattrfronte Development, LLC Page Three The applicant also proposes one 3' in width by 26' in length floating dock(C 1),which would be constructed on the northern side of"C-Dock". This dock would be constructed to accommodate an existing slip# 167 only. One 3' in width by 25' in length floating dock(DI)would extend towards the north from"D-Dock". This floating dock would accommodate an additional slip# 159. Two additional slips on the southern side of"E-Dock"would be located on without any construction of floating docks/finger piers. These slips would be designated as# 154 and # 155. Water depths, in the vicinity of the proposed floating docks/finger piers,range from—0.5' to—4.7' @ Normal Low Water(NLW). 10. ANTICIPATED IMPACTS The previous permit authorized dockage for up to 169 vessels within the marina basin. The proposal to add 10 additional slips would bring the total number of available slips at the facility to 179. The proposed floating docks/finger piers construction would incorporate 273 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposal is within the 25%additional allowance for marinas and would not require the preparation of a NCEPA document. Due to the limited amount of water, approximately—0.5' to—2.0' @ MLW located on the northern side of A-Dock at this location of Waterfronte Villas Marina,there will be potential for bottom disturbance and displacement of the substrate"kicking"by vessel propellers to access the dockage on the northern side of the marina. However,the application states the proposed slips at this location would be envisioned for smaller vessels such as jon boats. The associated CAMA permit request is basically a modification request to a previous and recently approved CAMA Permit. This modification is to request an extension of the total number of slips from 169 slips to 180 slips. The drawings submitted with this permit indicate where the additional slips will be located. The additional slips are primarily located on existing structures requiring little or no construction. The only slip requiring any additional dock fingers or walkways are slip numbers 171, 173, 167, and 159. All other slips are being created on existing structures and may require additional cleats but no structures.
