This permit, issued on .Tune 9,2006 , is subject to compliance with the application(where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action;or may cause the permit to be null and void.
Docking Facility,
'1) In accordance with commitments made by the permittee, this permit only authorizes new slips 168,
122A, 165, 15813, 153 and 154, all as depicted on the attached workplan drawings.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.
3) No attempt shall be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.

ADDITIONAL CONDITIONS
4) The permittee shall maintain the authorized work in good condition and in conformance with the terms
nd conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
5) This permit does not authorize any excavation or filling of coastal wetlands or open water areas,
including kicking with boat propellers.
6) This major modification shall be attached to the original of Permit No. 84-05, which was issued on
3/7/88, as well as all subsequent modifications, refinements, renewals and the Settlement-Agreement
dated 3/20/00, and copies of all documents shall be readily available on site when Division personnel
inspect the project for compliance.
7) All conditions and stipulations of the active permit remain in force under this major modification unless
specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state,federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.

dependent activities are not authorized within 30 feet of the normal high water level.

State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff-

the permit and proceeding means you have waived your right of appeal described below. Please retain the original
(buff-colored form),as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, [phone] within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty(20)days, the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel

8. PROJECT SUMMARY: The applicant proposes to construct four additional floating docks/finger piers within
the Waterfronte Villas Marina. The additional docks/finger piers would create 10.new slips within the marina.

9. PROJECT DESCRIPTION
The project site is located at the end of Spencer Farlow Drive,adjacent to the Atlantic Intracoastal Waterway and
Carolina Beach Yacht Basin, in Carolina Beach,New Hanover County. To get to the site,take Hwy 421 south
from Wilmington into Carolina Beach. Turn left onto Lewis Drive and then an immediate left onto Access Road.
Turn right onto Spencer Farlow Drive from Access Road and Waterfronte Villas will be located at the end of the
Road. The lot averages 6-10 feet above mean sea level. Waterfronte Villas and Marina currently operates as a full-
service residential and commercial docking facility.
The Waterfronte Marina facility is comprised of approximately 4.37 acres and is located at the far end of the Spencer
Farlow Drive.The facility is used to provide marina services to the residents of the Waterfronte Villas,as well as for
commercial use. Existing man-made features on the tract include: several town home units, a docking facility,
maintenance building, swimming pool,clubhouse and a bulkhead.The tract is developed with very little vegetation.
Lawn grasses and ornamental landscaping represent the majority of on-site vegetation. Waterward of the bulkhead
adjacent to "C-Dock" exhibits an area of coastal marsh measuring approximately 200' in width by 100' in length
consisting primarily of Smooth Cordgrass Marsh(Spartina alterniora)and Black Needlerush(Juncus roemarianus).
There also exists an area of coastal marsh measuring approximately 350' in length by 100' in width located at the
northern side of"A-Dock"consisting primarily of Smooth Cordgrass Marsh and Black Needlerush. The existing water
depths at this location of the marina range from approximately—0.5' to—2.0' @ Mean Low Water(MLW).
CAMA Major/Dredge and Fill Permit# 168-96 was originally issued to Snow's Cut Marina Townhouses c/o
Northcrest Investment, Co. in December 1996.The permit was transferred to Snow's Cut Marina Townhouses c/o
Ellsworth-Sloan, LLC in May of 1999. In July 1999,the permit was transferred to Waterfronte Villas and Yacht
Club c/o Ellsworth-Sloan, LLC. The most recently renewed permit expired in December 2003. The previously
issued permits included dredging activities in the areas surrounding the floating docks as well as the entrance to the
boat basin. The Waterfronte Villas and Marina facility is submitting this major permit application for modification
to their existing CAMA Major/Dredge and Fill Permit No. 84-05,which was issued through the Express Program.
State Permit No. 84-05 authorized maintenance dredging within the marina basin and the addition of 16 slips
creating a total to 169 slips.
The Town of Carolina Beach Land Use Plan classifies the area in the vicinity of the project area,as Developed.
The waters in the project area are classified as SB by the N.C.Division of Water Quality. They are NOT
designated as a Primary Nursery Area(PNA)by the N.C.Division of Marine Fisheries,and they are CLOSED to
the.harvest of shellfish.
PROPOSED PROJECT
The applicant is requesting a Major Modification to existing State Permit# 84-05 to create and additional ten slips
by adding four additional floating docks/finger piers. The location of the proposed docks,as indicated on the work
plat drawings,are as follows: one 3' in width by 15' in length floating dock(Al)would be located on the southern
side of existing"A-dock"extending towards the south. This floating dock would accommodate slip# 173. The
applicant is proposing designation of four additional slips on the northern side of existing"A-Dock"without any
construction of additional floating docks/finger piers. These slips would be designated as# 174- 177. One 3' in
width by 25' in length floating dock(B 1)would be located on the northern side of the gangway ramp leading to
existing`B-Dock". The floating dock would run in the same alignment as`B-Dock"and would accommodate slip
# 171. An additional slip would be designated without any construction of a floating dock/finger pier,which
would be located on the northern side`B-Dock". This slip would be designated as# 172. The application states
that these six additional slips would be designated for smaller vessels only,due to the existing water depth.

The applicant also proposes one 3' in width by 26' in length floating dock(C 1),which would be constructed on the
northern side of"C-Dock". This dock would be constructed to accommodate an existing slip# 167 only. One 3'
in width by 25' in length floating dock(DI)would extend towards the north from"D-Dock". This floating dock
would accommodate an additional slip# 159. Two additional slips on the southern side of"E-Dock"would be
located on without any construction of floating docks/finger piers. These slips would be designated as# 154 and
# 155. Water depths, in the vicinity of the proposed floating docks/finger piers,range from—0.5' to—4.7' @
Normal Low Water(NLW).
10. ANTICIPATED IMPACTS
The previous permit authorized dockage for up to 169 vessels within the marina basin. The proposal to add 10
additional slips would bring the total number of available slips at the facility to 179. The proposed floating
docks/finger piers construction would incorporate 273 sq. ft. of Estuarine Waters and Pubic Trust Area. The
proposal is within the 25%additional allowance for marinas and would not require the preparation of a NCEPA
document. Due to the limited amount of water, approximately—0.5' to—2.0' @ MLW located on the northern side
of A-Dock at this location of Waterfronte Villas Marina,there will be potential for bottom disturbance and
displacement of the substrate"kicking"by vessel propellers to access the dockage on the northern side of the
marina. However,the application states the proposed slips at this location would be envisioned for smaller vessels
such as jon boats.

Project Narrative
Project Name: Waterfronte 2
This project is to add slips to an existing marina at Waterfronte Villas & Yacht Club. The
associated CAMA permit request is basically a modification request to a previous and
recently approved CAMA Permit.
This modification is to request an extension of the total number of slips from 169 slips to
180 slips. The drawings submitted with this permit indicate where the additional slips
will be located.
The additional slips are primarily located on existing structures requiring little or no
construction. The only slip requiring any additional dock fingers or walkways are slip
numbers 171, 173, 167, and 159. All other slips are being created on existing structures
and may require additional cleats but no structures.
Slips 171, 172, 174, 175,and 176 are envisioned as slips for smaller watercraft such as
jon boats, or personal watercraft.

activity in strict accordance with the attached special conditions and the State authorization and

the general permit could result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason,plans revised to show the change must be sent promptly to this office and the

Reference the application of Waterfronte Development, LLC for a Department of the Army
permit construct four additional floating docks/finger piers with in the Waterfronte Villas
Marina, located at the end of Spencer Farlow Drive, adjacent to the Carolina Beach Yacht Basin,
Carolina Beach,New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE)prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land-clearing activities shall take place at any time in the construction or

maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at(919) 733-5083,
Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
6. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
7. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at(910) 772-2191.
8. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
9. Approval of the structure was based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.
10. The permittee shall advise the Corps in writing at least two weeks prior to beginning
the work authorized by this permit and again upon completion of the work authorized by this
permit.
11. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide

each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
12. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
13. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
14. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre-project condition.
15. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
13. The activity will be conducted in such a manner as to prevent.a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management(NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
14. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre-project condition.
15. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Contractors, to modify State Permit # 84-05. State Permit No. 84-05 authorized maintenance dredging
within the marina basin and the addition of 16 slips creating a total to 169 slips. State Permit# 84-05
was issued through the Express Program on July 8, 2005 and is due to expire on December 31, 2008.
The action proposed in your submittal consists of allowing annual maintenance to the entrance channel
and within existing slips of the Waterfronte Villas and Yacht Club marina by mechanical means. The
initial maintenance would be a one-time event with approximately 2,000 cubic yards of excavated
material utilized on an upland area located at the Aqua Vista Farms location off Masonboro Loop
Road, adjacent to Myrtle Grove Sound. The existing permitted spoil island (Fred Graham Island)
adjacent to the AIWW would remain as the primary site for future maintenance.
Upon review of the proposed plat submittal, I, in conjunction with Doug Huggett with the Division of
Coastal Management Permitting Section, have determined that the proposed action is consistent with
existing State rules and regulations and is in keeping with the original purpose and intent of the
permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit #84-05,
as described in your transmittal letter and plans dated 5/4/06, which was received in our office on
5/7/06.

I am requesting a refinement to the Waterfronte Marina/Villas Major Permit to
allow annual mechanical (bucket & barge) dredging in addition to the permitted
hydraulic dredging. This mechanical dredging will be used to maintain slips
within the marina as well as the entrance channels to the slips. The excavation
will allow for a depth of -6'MLW. It will typically not exceed 2,000 cubic
yards. The location of the spoil deposit site will also change from the Fred
Graham island to the Aqua Vista Farms location which is located at 100 Aqua Vista
Farms Drive. This property is adjacent to the AIWW near Myrtle Grove. A dike
exists on the property but the spoil will be deposited in an area that is enclosed
with silt fencing. The spoil deposit area will be outside of the 30' CAMA
setback. Thank you for your help on this matter. We are ready to begin the
excavation process.

Areas of Environmental Concern(AEC's) impacted by the proposal are EW and PT. The
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Carolina Beach Land Use Plan and
offer the following comments.
The AECs impacted by the work are classified as Conservation.
In general, the Town of Carolina Beach allows development in Conservation classified
AECs which is consistent with the State's minimum use standards. The Town of
Carolina Beach Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the Town of Carolina Beach Land Use Plan.

The following comments by the North Carolina Division of Marine Fisheries(DMF)on the
subject permit are offered pursuant to G.S. 113-131. The DMF has concerns regarding aspects of this
project and offer the following comments.
The applicant proposes to construct four additional floating docks/finger piers.within the existing
marina. This would create an additional 10 slips. The area is not a PNA and is closed to shellfishing.
The concern is the shallow water depths where they are attempting to cram in 10 more slips,
particularly slips 171-178 where water depths are from-0.5 to—2.0 ft MLW. These shallow depths and the
adjacent marshes provide an important nursery area for a variety of estuarine fishes and invertebrates that
in turn provide forage for many wildlife species. With the increased boating activity in these shallow
depths,propeller kicking would create a continual source of elevated turbidity and sedimentation that
would degrade the habitat.
Thus,DMF recommends that the project be modified to eliminate those slips that are in water of
2.0 ft MLW or less.

Biologists with the North Carolina Wildlife Resources Commission(NCWRC)reviewed the permit
application with regard to impacts on fish and wildlife resources.Our comments are provided in
accordance with provisions of the Coastal Area Management Act(G.S. 113A-100 through 113A-128), as
amended,and the Fish and Wildlife Coordination Act(48 Stat.401,as amended; 16 U.S.C. 661 et seq.).
The project site is located at the end of Spencer Farlow Drive,adjacent to the AIWW and Carolina Beach
Yacht Basin, in Carolina Beach. The waters of the area are classified as SB by the NC Division of Water
Quality(NCDWQ),are not designated as Primary Nursery Area(PNA)by the NC Division of Marine
Fisheries(NCDMF),and are closed to shellfishing.
The applicants propose to construct four additional floating docks/finger piers within the marina. The
additional docks/piers would create 10 new slips. Existing water depths in the proposed project area
range from-0.5 ft to-4.7 ft mean low water(MLW).
NCWRC has several concerns with the project as proposed.
• The water depths in the area of slips 171-178 are from-0.5 to-2.0 ft MLW. The marshes
adjacent to the project site provide an important rearing area for a variety of estuarine fishes and
invertebrates that serve as forage for many wildlife species,particularly marsh birds. Boating
activity in the northern-most portion would create a continual source of chronic sediment
disruption and elevated turbidity associated with propeller kicking due to the shallow nature of
the project area.Erosion of the adjacent marsh, sediment disruption,turbidity,and contamination
collectively will degrade habitat and forage for wildlife and fishery resources. Therefore,we

recommend modification of the project for motorized vessels to utilize only areas with depths of
-2 ft MLW or greater.
• We are concerned with the ability to control the use of slips 171, 172, 174, 175,and 176. The
applicants state that they are"...envisioned as slips for smaller watercraft such asion boats,or
personal watercraft."
The NCWRC does not object to the project,provided our recommendations and concerns are addressed
sufficiently in subsequent modifications to the application or are included as permit conditions. We

The Wilmington Regional Office of the Division of Water Quality received a copy of the CAMA Major
Permit Application for the above subject on February 2, 2006. Staff review of the plans and
specifications has determined that the development activities proposed at this time will not pose a threat
to surface water quality from stormwater runoff. The Director has determined that projects that are
reviewed and approved by the Division as not posing a water quality threat from stormwater runoff
should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000.
By copy of this letter, we are informing you that your project will not require a stormwater management
permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff,
then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater
discharge requirements. You are required to have an NPDES permit for stormwater discharge from
projects meeting these criteria. The stormwater rules require the Division to permit the common plan of
development, therefore, any future development on the property, regardless of whether a CAMA Major
permit is also required, will require a Stormwater Management Permit application and permit issuance
from the Division of Water Quality prior to any construction.

If an authorized agent has been retained to obtain your CAMA permit, you must provide a letter granting your agent
the right to apply on your behalf.
5. Project Narrative
A narrative description of the proposed project should also be provided. This narrative should discuss the
character and purpose of the proposed development, construction methodologies and any other special or

DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on January 17, 2006.
According to said application, Waterfronte Development, LLC proposes to construct
additional docks within the marina at the end of Spencer Farlow Drive, adjacent to the Carolina
Beach Yacht Basin, in Carolina Beach, New Hanover County. A copy of the entire application
may be examined or copied at the office of Robb Mairs, N.C. Environment and Natural
Resources, Division of Coastal Management, 127 Cardinal Drive Extension, Wilmington, North
Carolina 28405, 910-796-7215 during normal business hours.
Comments mailed to Charles S. Jones, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to February 25, 2006, will be
considered in making the permit decision. Later comments will be accepted and considered up to
the time of permit decision. Project modification may occur based on review and comment by the

Dear Mr. Pittman:
The Division of Coastal Management hereby acknowledges receipt of your application for State approval for
development of your property located at 100 B Spencer Farlow Drive,Carolina Beach, in New Hanover County. It was
received complete on 01/17/06, and appears to be adequate for processing at this time. The projected deadline for making a
decision is 4/02/06.An additional 75-day review period is provided by law when such time is necessary to complete the
review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances,this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 01/17/06,you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will

NCGS 113A-119(b)requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a"Notice of Permit Filing"postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be:Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made,and if additional information is required,you will be contacted by the appropriate
