HomeMy WebLinkAbout54-24 Hill, Mark & Stephanie 7/10/2024 Exemption Number – 54-24 Mark and Stephanie Hill C/O Future Homes 2700 Carey Road Kinston, NC 28504 RE: EXEMPTED PROJECT - SINGLE FAMILY RESIDENCES WITHIN THE ORW ESTUARINE SHORELINE AREA OF ENVIRONMENTAL CONCERN (15A NCAC 07K .0208) PROJECT LOCATION/ADDRESS – 211 Bogue Sound Drive, Cape Carteret Dear Mr./Mrs. Hill: I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. After the Town of Cape Carteret made a site inspection on 7/9/2024, it was determined that the activity you proposed is exempt from needing a minor development permit as long as it remains consistent with your updated site drawing submitted on 7/3/2024 and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. SINGLE FAMILY RESIDENCES WITHIN THE ESTAURINE SHORELINE AREA OF ENVIRONMENTAL CONCERN EXEMPTED 1. All development shall be located at least 40 feet of the normal high-water mark or normal water level from waters classified as ORW. 2. No ground disturbance or land disturbing activity shall occur within 40 feet of the normal high-water mark or normal water level from waters classified as ORW. 3. The development may not exceed a 25% built upon area within 575 feet of the normal high-water mark or normal water level of waters classified as ORW, and shall not include any stormwater collection system. 4. The development shall be consistent with all other applicable CAMA permit standards, North Carolina Building Code standards, local ordinances and local land use plans in effect at the time the exemption is granted. 5. This exemption does not allow for any development within any wetlands or open water areas. Any proposal to modify or alter the development plan as proposed will require additional authorization from the Division of Coastal Management. 6. The Permittee and/or the Permittee’s Agent shall be responsible for obtaining any and all necessary authorizations, approvals, or zoning and building permits from the local government having jurisdiction (Town of Cape Carteret and /or Carteret County) prior to commencing work. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization.
