This permit,issued on October 26, 2005 , is subject to compliance with the application(where consistent
with the permit),all applicable regulations, special conditions and notes set forth below.Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
2) All material resulting from the removal of the existing piers shall be placed in an approved upland
disposal site.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

3) No e h Bated or untreated, shall be discharged at any time from any boats using the

permit for whic the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
6) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
7) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
9) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
10) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor to the north. Should the
adjacent property to the south be sold prior to the initiation of construction, the permittee shall be
required to obtain a signed riparian corridor waiver from the new property owner prior to the placement
of any structures within the 15-foot riparian corridor.
11) An as-built survey shall be performed on the docking facility, and copies of the survey shall be provided
to the U.S. Army Corp. of Engineers and the Division of Coastal Management, within 60 days of
completion of construction.
12) The construction and/or operation of the authorized facilities shall not directly result in any closure of
any waters that are open to the taking of shellfish. Any such closure directly attributable to the
authorized facility may require that the permittee undertake remedial actions to remedy the situation.
Such actions may include, but are not limited to, the removal of any unauthorized slips or mitigative
measures to reduce or eliminate the cause(s) of the closure.
13) This permit authorizes a maximum of(6) six boat slips.

Highp,round Deck
14) No more than 200 square feet of the permitted highground deck shall be located within 30 feet of the
normal high water line(NHWL). Those portions of the deck that are located within 30 feet of the
NHWL shall be slatted, wooden, elevated and unroofed.
15) No portion of the authorized 20' X 20' highground deck shall be constructed over any vegetated
wetlands.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan shall be required for this project. This plan shall be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Land Quality Section, 127
Cardinal Drive Extension,Wilmington, NC 28405
16) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands,watercourses and property(e.g. silt fence,
diversion swales or berms, etc.)
Upland Development
17) This permit authorizes only the land disturbing activities associated with the development of the (3)
three condominium units, all as expressly and specifically set forth in the attached permit application
and workplan drawings. Any additional land disturbing activities and/or construction shall require a
modification of this permit.
Stormwater Management
18) The N.C. Division of Water Quality approved this project under stormwater management rules of the
Environmental Management Commission under Stormwater Permit No. SW8050616 on 7/13/05. Any
violation of the permit approved by the DWQ will be considered a violation of this CAMA permit.
General
19) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit
modification.
20) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.

NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day
operation of the facility to prevent facility waste from entering the adjacent waters. Such
discharge, either directly or indirectly, to adjacent waters could contravene state water quality
standards, thereby violating state law.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.

the permit and proceeding means you have waived your right of appeal described below.Please retain the original

construction of three (3) condominium units, elevated platform (pergola) and to convert an existing pier facility
into a 6 vessel community dock.

9. PROJECT DESCRIPTION: y�
The project site is located at 172 Shannon Dr., adjacent to the AIWW/Masonboro Sound, in New Hanover County. To
locate the property traveling south from US HWY 421, turn left onto Piner Road and continue for approximately 1
mile until you come to Myrtle Grove Road. Turn right on Myrtle Grove Road and continue heading south
approximately 1.5 miles. Turn left onto Shannon Dr. and head east approximately 1.3 miles until the road dead ends.
The property of interest will be on the right. There is a hard surface road located on the northern boundary of the
property and an existing unimproved private road along the southern boundary. The 1.14 acre (approximately 49,767
sq. ft.) lot averages 6 feet above mean sea level and the linear dimension of the shoreline is approximately 115 feet. At
present there is an existing residence with pier located on the property and also a detached 3-car garage. The applicant
has recently relocated a two story dwelling off of the property to an adjacent property through a CAMA Minor
Development Permit with New Hanover County. The dimensions of the existing residence is approximately 81' x 40'
and the detached garage is approximately 30' x 40' (1297.8 sq.ft.). The existing fixed pier is approximately 150' in
length and has an approximately 20' x 20' platform at the terminus. There is a floating dock on the south side of the
platform and a boatlift on the north side of the fixed pier. Two boat slips are provided by these two features. Upland
vegetation is primarily Oak Trees with lawn grasses and landscape shrubs. Waterward of the upland vegetation, the
property transitions into an area of high marsh, vegetated predominately with Spike Grass (Distichlis s ip cats) on the
south end of the property. Further waterward the marsh becomes intermixed with other high marsh species including
Sea Oxeye (,Borrichia frutescens), Salt Meadow Grass (Spartina patens), Black Needle Rush Quncus roemarianus),
Marsh Elder (Iva frutescens) and Fragmites spp. The high marsh transitions into low marsh primarily consisting of
Smooth Cordgrass (Spartina alterniflora), in a band approximately 50 feet in width.
In the project area, the waters are classified as SA-ORW (Outstanding Resource Waters), by the NC Division of Water
Quality, and they are OPEN to the harvest of shellfish. These waters are designated as Primary Nursery Area (PNA),
by the NC Division of Marine Fisheries. New Hanover County also requires a 75' Conservation Overlay District
(COD) for this property.
PROPOSED PROJECT:
The applicant proposes to recombine the property into a small subdivision with construction of three (3) single family
elevated condominiums units, elevated platform (pergola) and to covert an existing pier facility into a 6 vessel
community dock into the AIWW/Masonboro Sound. The applicant proposes to construct three single family, single
story, elevated new condominiums: Building 3 (Unit A) and Buildings 1 and 2 (Units "C" and "B"). Unit "A" would
be constructed on the existing footprint of the house that was recently relocated off the property, located approximately
250' landward of Normal High Water (NHW). Units "C" and "B" would be constructed between Unit "A" and the
75' Conservation Overlay setback on the eastern boundary of the property, approximately 100' landward of Normal
High Water (NHW). Unit "A" dimensions would be approximately 50' x 60' (3015.37 sq. ft.). Units "B" and "C"
dimensions would each be approximately 32' x 50' (1797.6 sq. ft.). The three proposed buildings would not exceed
the New Hanover County Zoning 35' height limitation. Associated parking for the three units would be provided
adjacent to each of the units. Unit "A" would have a parking pad dimension of approximately 20' x 45'
(900 sq. ft.). Units "B" and "C" would have parking pad dimensions of approximately 20' x 20' (400 sq. ft.) each.
Driveways to these proposed parking pads would accessed from Shannon Dr. on the north and from the existing
unimproved private road along the southern boundary. Additional parking would also be provided underneath the
proposed units. The applicant states that the existing 3-car garage would remain as is. The area to be disturbed for the
three units and the associated driveways and parking pads would be 12,451.7 sq. ft., according to the applicant's
stormwater plan through the N.C. Division of Water Quality. The total built upon area within 575' Coastal Shoreline
Outstanding Resource Water Area of Environmental Concern(AEC) would be 24.3 %.

The applicant states that the proposed units would tie into the existing county's sewer disposal system. Water would be
provided by individual wells. A proposed elevated 20' x 20' pergola(uncovered deck)would be constructed
approximately 80' waterward of Units`B"and"C",which 10' x 20' (200 sq. ft.)of the structure would encroach into the
Coastal Shoreline 30' setback.
The applicant also proposes to convert the existing pier from a 2-slip water access facility to a 6-slip facility with boatlifts.
The existing 20' x 20' L-head platform and floating dock with access ramp would be removed from the pier facility. The
150' access pier would remain and access would be connected to each of 6 boatlifts by a series of an access pier and finger
piers. The proposed 5' x 60' access pier would be located on the south side of the existing access pier, approximately 24'
landward of the terminus end of the pier. The access pier would run parallel to the shoreline. Two(2)3' x 24' finger piers
would extend in an eastern direction from the access pier,which would be constructed 26.5' apart. These finger piers
would accommodate five(5)boatlifts,two(2)between each finger pier and one(1)on the outside of the most southern
finger pier. The applicant states that the existing boatlift(13.5' x 13.5')on the northern end of fixed pier would remain in
place, creating a total of 6 boat slips for the proposed facility.
10. ANTICIPATED IMPACTS
The proposed condominiums with associated structures built upon area would be approximately 12,451.7 sq. ft. (.28 acres)
of highground. Total impervious surface coverage within the 575'Estuarine Shoreline AEC would be 24.3 %.The
proposed dock would incorporate approximately 1,538 square feet of Estuarine Waters and Public Trust Area. The
applicant has received a State Stormwater Permit#SW8050616, from the Division of Water Quality for the proposed
upland development. Minor increases in turbidity should be expected during construction. The waterward end of these
structures would be slightly landward of the alignment of the existing platform. This proposed distance would conform to
the 1/4 width rule. As proposed,the applicant's proposal would not encroach into the 80 foot setback from the AIWW.

Recommendations for State Permit—Wright Smith(Shannon Pointe)
have no objections to the proposed project. Any permit issued should include the following conditions:
1. This permit authorizes only the docks,piers,and other structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structures,whether floating or stationary,
may become a permanent part of the structure without permit modification. No non-water dependent uses of
structures may be conducted on, in,or over public trust waters without permit modification.

5. In order to protect water quality,runoff from the construction must not visibly increase the amount of suspended
sediments in adjacent waters.
6. This permit does not authorize the interference with any existing or proposed Federal project,and,the permittee
will not be entitled to compensation for damage to the authorized structure or work,or injury which may be caused
from existing or future operations undertaken by the United States in the public interest.
7. The permittee will maintain the authorized work in good condition and in conformance with the terms and
conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without
having the permit transferred to a third-party.
8. Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands,watercourses and property(e.g. silt fence,
diversion swales or berms, etc.).
9. A ground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30
calendar days of completion of any phase of grading on cut or filled slopes.
10.Any development or land disturbing activity that is considered non-water dependent is not authorized within
30 feet of the normal high water level unless specifically exempted by Coastal Resource Commission(CRC)
regulations in place at the time of such development.

This is with reference to the request submitted by your agent, Mr. C Robert Stroud, to modify State
Permit #162-05, which was issued on 10/26/05 and expires on 12/31/08 to Wright Smith dba/WD-42,
LLC. The action proposed in your submittal consists of modifying the 5'x 60' "L-head" platform by
shifting it's location approximately 6' landward of the permitted location along with the shift in the
two finger piers with this feature. The agent states that there would be no change in the total platform
square footage dimensions as a result of this modification request and that all other aspects of the
project would remain as permitted.
Upon review of the proposed plat submittal, I, in conjunction with Doug Huggett with the Division of
Coastal Management Permitting Section, have determined that the proposed action is consistent with
existing State rules and regulations and is in keeping with the original purpose and intent of the
permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit #162-
05, as described in your transmittal letter and plans dated 11110105, which was received in our office
on 11/14/05.

Dear Mr. Mairs:
My client, Mr. Wright Smith, has asked me to submit a request for a Letter of Refinement to
State Permit #162-05 issued on October 26, 2005 and expiring on December 31, 2008. The
permit was issued to Wright Smith dba/WD-42, LLC.
The proposed change in the existing project involves the shifting of the 5' x 60"'L" approxi-
mately 6' landward of the permitted location along with the shift in the two finger piers asso-
ciated with this feature. I am enclosing a modification to the Pier and Lift Plan (sheet 4 of 5)

Areas of Environmental Concern (AEC's)impacted by the proposal are ES, OR, EW, and
PT. The Waters at the project site are classified as SA-ORW and are open to the
harvesting of shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1999 Wilmington-New Hanover
County CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Resource Protection.
In general, Wilmington-New Hanover County allows development in Resource
Protection classified AECs which is consistent with the State's minimum use standards.
The Wilmington-New Hanover County Land Use Plan contains some policies which
exceed the State's minimum use standards, including those for marinas.
The Wilmington-New Hanover Land Use Plan states that"Marinas shall not be allowed
in Primary Nursery Areas (PNA's), Outstanding Resource Waters (ORW), or open
Shellfishing Waters (SA), except within the unincorporated County where this limitation
only applies to commercial Marinas." This project is located in the unincorporated
County.
Provided all local, state and federal requirements can be met,and provided no
commercial activity takes place as defined as a commercial marina on page 90 of the
1999 Wilmington-New Hanover County Land Use Plan,this project appears to be
consistent with the 1999 Wilmington-New Hanover County Land Use Plan Update

I am submitting clarifying information as well as re-submitting modified material based on
your initial review and comments with regard to the subject project. I have modified what I
trust are the appropriate portions of the written application portion of the submittal. I have
also had new plans prepared that reflect the pocket of Distic/is spicata as well as an ex-
panded upper limit of coastal wetlands from those indicated on the original survey plats
(erroneously labeled "404" wetlands). These were identified and flagged in the field by you
and Mr. Jim Gregson, District Manager. [See sheets 1 of 5 and 2 of 5]. The pier/boatlift por-
tion of the project has been revised [ see sheet 4 of 5 ]. A deck with a pergola structure
has been added on highground to replace the deck over the public trust area. [See sheet 1
of 5 and sheet 2 of 5 ].
In reviewing the two different views of the new proposed pier/boatlifts graphics I have no-
tice a slight difference in the dimensions shown for the length of the platform portion. I at-
tribute this to the difference in accuracy between analogue and digital drafting techniques.
Hopefully this will not be a problem and the final length can be set as a condition of the per-
mit.
I am also enclosing the reduced plats for sheets 1 & 2 of 5 for the US Army Corps of Engi-
neers package. A copy of a letter indicating the lack of'1404" wetlands on-site is also in-
cluded. This was submitted to Brad Shaver today and he indicated during a telecommunica-
tion last week that he would in all likelihood concur with the determination made by the
Clark Group Wetland Specialists.

The purpose of this correspondence is to document the findings of an on-site investigation of approximately
1.14 acres of land located at 262 Shannon Drive, adjacent to the Intracoastal Waterway. During the site
visit, I also met with Mr. Bob Stroud to discuss the location of the CAMA Coastal Wetland line as
delineated on July 25, 2005 by members of the Division of Coastal Management field staff.
Throughout the investigation numerous auger holes were examined for indicators of hydric soils and
wetland hydrology that might suggest the presence of wetland areas that would be subject to jurisdiction
under Section 404 of the Clean Water Act. Neither of these parameters were met in any area above, or
independent of,those areas previously delineated as Coastal Wetlands. Furthermore, observations of the
dominant vegetation types revealed that the majority of the herbaceous vegetation on this parcel is
consistent with that found in coastal wetlands and often extends well above the hydric soil break.
In conclusion, it is our opinion that there are no Section 404 wetlands on this site. If you have any further

Dear Sirs:
Please find enclosed an application package that I am submitting on behalf of my client,
Wright Smith, dba WD-42, LLC. for a project located in New Hanover County. The develop-
ment will be known as Shannon Pointe and is located at 272 Shannon Drive. Please consider
this application as a FAST TRACK submittal. I am requesting that the current restriction
limiting piers under the FAST TRACK process to 4(four) be waived due to my earlier contact
with Jason Dail with respect to this project.
EXISTING CONDITIONS:
At present there is an existing residence with pier located on the property and also an exist-
ing detached 3-car garage. The dimensions of the residence are approximately 81'x 40' and
the garage is approximately 30' x 40'. The existing pier is approximately 150' in length and
has an approximately 20' x 20' platform at the terminus. There is a floating dock on the
south side of the platform and a boat lift on the north side. Two boat slips are provided by
these two features. The linear dimension of the shoreline is approximately 115 feet. The
area of the lot is approximately 1.14 acres or approximately 49,767 square feet. The lot has
sewer service provided by New Hanover County and also has county water. There is a hard
surface road located on the northern boundary of the property and an existing unimproved
private road along the southern boundary. This location is adjacent to SA outstanding Re-

quires a 75' Conservation Overlay District for this property.
PROPOSED DEVELOPMENT
A brief description of the proposed development activities follows:
The property will be recombined as a small subdivision with three condominium units.

• Two additional condominium structures will be constructed between the existing/proposed
building and the Conservation Overlay District setback on the eastern boundary of the property.
These structures will each be approximately 32' x 50" in size.
• The existing 3-car garage will remain as is.
• The existing pier will be converted from a 2-slip water access facility to a 6-slip facility. The plat-
form will be removed and access will be provided to each of 6 boat lifts by a series of"cat-walk"
features. The waterward end of these structures will be at or slightly landward of the same
alignment as the existing platform. This structure (platform) will be relocated landward of the
slips and will be reduced in size to approximately 16' x 16'.
In my contacts with various agencies concerning this project I have had the following responses:
NC Division of Land Quality - no submittal is required as the total proposed disturbance is less
than One Acre.
NC Division of Water Quality - a low density Storm Water Authorization is required and one has
been submitted for approval.
New Hanover County Planning - The proposal is consistent with current zoning for the project
area.
U S Army Corps of Engineers - The project is consistent with current guidelines.
N C Division of Coastal Management - The proposal is consistent with the New Hanover County
Land Use Plan.

The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Shannon Pointe on July 12, 2005. Staff review of the plans and specifications
has determined that the project, as proposed, will comply with the Stormwater Regulations set
forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 050616, dated July 13,
2005, for the construction of the subject project.
This permit shall be effective from the date of issuance until rescinded and shall be subject to
the conditions and limitations as specified therein, and does not supercede any other agency
permit that may be required.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of

compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the
"stormwater rules') and the approved stormwater management plans and
specifications, and other supporting data as attached and on file with and approved by
the Division of Water Quality and considered a part of this permit.
The Permit shall be effective from the date of issuance until rescinded and shall be
subject to the following specific conditions and limitations:
I. DESIGN STANDARDS
1. The site is limited to a maximum of 12,451.7 square feet of built-upon area, as
indicated in the approved plans. CAMA regulations may reduce the allowable
built-upon area for those lots within the AEC.
2. The overall tract built-upon area percentage for the project must be maintained
at 25% per the requirements of Section .1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit.
4. ProJ'ects covered by this permit will maintain a minimum 30 foot wide vegetative
buffer between all impervious areas and surface waters.
5. The only runoff conveyance systems allowed will be vegetated conveyances
such as swales with minimum side slopes of 3:1 (H:V) as defined in the
stormwater rules and approved by the Division.
6. All roof drains must terminate at least 30' from the mean high water mark.

II. SCHEDULE OF COMPLIANCE
1. Swales and other vegetated conveyances shall be constructed in their entirety,
vegetated, and be operational for their intended use prior to the construction of
any built-upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the swales or other vegetated conveyances will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to operate the permitted stormwater management systems at
optimum efficiency to include:
a. Inspections
b. Sediment removal.
C. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
4. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any of the items shown on the approved plans, including
the stormwater management system, design concept, built-upon area,
details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area or to the
drainage area.
e. Further subdivision, acquisition, or selling of the project area.
f. Filling in, altering or piping any vegetative conveyance shown on the
approved plan.
5. The Director may determine that other revisions to the project should require a
modification to the permit.
6. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
7. No piping shall be allowed except that minimum amount necessary to direct
runoff beneath an impervious surface such as a road and that minimum amount
needed under driveways to provide access to lots.
8. Unless specified elsewhere, permanent seeding requirements for the swales
must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. The permittee is responsible for verifying that the proposed built-upon area does
not exceed the allowable built-upon area. Once the lot transfer is complete, the
built-upon area may not be revised without approval from the Division of Water
Quality, and responsibility for meeting the built-upon area limit is transferred to
the individual property owner, provided that the permittee complies with the
requirements of Section 11.11 of this permit.

10. Within 30 days of completion of the project, the permittee must certify in writing
that the project's stormwater controls, and impervious surfaces have been
constructed within substantial intent of the approved plans and specifications.
Any deviation from the approved plans must be noted on the Certification.
11. Deed restrictions are incorporated into this permit by reference and must be
recorded with the Office of the Register of Deeds prior to the sale of any lot.
Recorded deed restrictions must include, as a minimum, the following
statements related to stormwater management:
a. The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW8 050616, as issued
by the Division of Water Quality under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater
Management Permit.
C. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina,
Division of Water Quality.
e. Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Water Quality.
f. The maximum built-upon area is 12,451.7 square feet. This allotted
amount includes any built-upon area constructed within the lot property
boundaries, and that portion of the right-of-way between the front lot line
and the edge of the pavement. Built upon area includes, but is not limited
to, structures, asphalt, concrete, gravel, brick, stone, slate, and coquina,
but does not include raised, open wood decking, or the water surface of
swimming pools.
g. Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with the development except for average driveway crossings,
is strictly prohibited by any persons.
h. Lots within CAMA's Area VIE Concern may have the
permitted built-upon area reduced due to CAMA jurisdiction within the
AEC.
i. Each lot will maintain a 30' wide vegetated buffer between all impervious
areas and surface waters.
j. All roof drains shall terminate at least 30' from the mean high water mark.
12. The permittee shall submit a copy of the recorded deed restrictions within 30
days of the date of recording.
13. If the permittee sets up an Architectural Review Committee (ARC) to review
plans for compliance with the restrictions, the plans reviewed must include all
proposed built-upon area (BUA). Any approvals given by the ARC do not relieve
the lot owner of the responsibility to maintain compliance with the permitted BUA
limit.
14. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
15. Stormwater conveyances will be located in either dedicated right-of-way (public
or private), recorded common areas or recorded drainage easements. The final
plats for the project will be recorded showing all such required easements, in
accordance with the approved plans.

III. GENERAL CONDITIONS
1 . Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division of Water Qualityy,
in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance, or
termination does not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules, and regulations contained in Title 15A of the North
Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General
Statute 143-215.1 et. al.
5. The permit is not transferable to any person or entity except after notice to and
approval by the Director. The Director may require modification or revocation and
reissuance of the permit to change the name and incorporate such other
requirements as may be necessary. A formal permit request must be submitted
to the Division of Water Quality accompanied by the appropriate fee,
documentation from both parties involved, and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits, and
may or may not be approved.
6. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the permit transfer request. Transfers to third
parties by the permittee where the required documentation has not been
submitted to the Division does not relieve the permittee of responsibility for
transferring the permit.
7. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state and federal) which have jurisdiction. If
any of those permits result in revisions to the plans, a permit modification must
be submitted.
8. The permittee grants permission to DENR Staff to enter the property during
business hours for the purposes of inspecting the stormwater management
system and it's components.
9. The permittee shall notify the Division of Water Quality of any name, ownership
or mailing address changes within 30 days.

The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on August 3, 2005.

property to create a small subdivision with construction of three (3)condominium units, elevated
platform (pergola) and to convert an existing pier facility into a 6 vessel community dock, at 272
Shannon Drive, adjacent to the AIWW, in Myrtle Grove Sound, New Hanover County.

N.C. Environment and Natural Resources, Division of Coastal Management, 127 Cardinal Drive

The Division of Coastal Management hereby acknowledges receipt of your application for State approval for
development of your property located at 272 Shannon Dr., in New Hanover County. It was received complete on
8/3/05, and appears to be adequate for processing at this time. The projected deadline for making a decision is
10/17/05. An additional 75-day review period is provided by law when such time is necessary to complete the review.
If you have not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 8/3/05, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of
your proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one
into your property. Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments. If additional information is required based on this review, the agencies may contact you
directly.
