This permit, issued on March 14, 2008 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) Unless specifically altered herein, this permit authorizes only the extension of previously authorized
docking facility and uses located in or over the water that are expressly and specifically set forth in
the permit application. No other structure, whether floating or stationary, shall become a permanent
part of this docking facility without permit modification. No non-water dependent uses of structures
shall be conducted on, in or over public trust waters without permit modification.
2) No attempt shall be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) This permit authorizes a maximum of five boat slips.
7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor. This corridor is determined
by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.
General
8) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
9) No open water areas or vegetated wetlands shall be excavated or filled, even temporarily.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3274 (DWQ Project No. XXXXXX), which was issued on

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. Please sign both the original (buff-
colored form) and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below. Please retain the original
(buff-colored form),as it must be available on site when the project is inspected for compliance.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty(20)days,the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands
all permit requirements.
From time to time,Department personnel will visit the project site. To facilitate this review,we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas,you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

9.PROJECT DESCRIPTION:
The project site is located at 720 Channel Blvd.,adjacent to Banks Channel/Topsail Sound, in Topsail Beach,Pender
County.According to the permit application this property is 200' x 138' or 27,600 ft.2. There is an existing commercial
structure on this property,know as the Assembly Building,with a 7,200 ft.2gravel parking lot. There is an existing
bulkhead that runs the length of the shoreline at the project site.There is an existing floating dock and pier located at this
site. The pier is 6' x 35' that connects to a ramp which is approximately 12' connecting to a 125' long floating dock the
northern 30' section of the floating dock is 10' wide. The remaining 95' is 6' wide. The normal high water at this site is
located at the base of the existing bulkhead. Banks Channel is approximately 1800' wide at this location. Banks Channel
provides access to properties to the north and south of the project site. The vegetation on the high ground area includes
bermuda grass and other ornamental plants.There are no coastal wetlands located in the project site.
This area of Banks Channel has two defined channels separated by a sand bar.There is the federally maintained section that
is located on the western side of the sandbar and the other channel is located on the eastern side of the sandbar. The project
site is located adjacent to the eastern channel.
CAMA Major Permit# 86-05 was issued on June 1,2005.This permit authorized the replacement of the existing then 6' x
72' floating dock with a 125' long floating dock the northern 30' section of the floating dock would be 10' wide.The
remaining 95' would be 6' wide with six 3-piling clusters for mooring,and one single mooring piling.The dock is
authorized to moor two commercial head boats moored at this location and the remaining 5 slips are for the use of the
members of the Topsail Island Historical Cultural Arts Council. In its current location the water depths measure
approximately—6' @ NLW on the landward side of the floating dock and—7' @ NLW on the waterward side of the
structure.
The Topsail Beach Land Use Plan classifies this area as developed. In the project area,the NC Division of Water Quality
classifies the waters of the Banks Channel/AIWW and Topsail Sound,as SA.This area of Topsail Sound is not
designated as primary nursery area by the NC Division of Marine Fisheries and is open to the harvesting of shellfish.
PROPOSED PROJECT:
The applicant proposes to extend the pier and relocate the dock 16' into Bank's Channel.The proposed relocation of the
structure would have the structure terminating approximately 67' waterward of the bulkhead.The water depths at the end
of the proposed pier would range from—7.5' normal low water(NLW)to—9.5'NLW.Judging by the water depths
provided by the applicant the deepest water is only 20' waterward of the end of the proposed dock.In addition,the pier
would be inline with the pier to the north however,the shoreline makes a shift inland to the south of this pier and there is a
similar shift in the established pier headline.Banks Channel is approximately 1800' wide from edge of bulkhead to edge of
marsh at this location.The proposed dock would have two commercial head boats moored at this location and the
remaining slips would be for the use of the members of the Topsail Island Historical Cultural Arts Council.
10.ANTICIPATED EMPACTS
The proposed development would incorporate 2,578 ft.2 of estuarine waters and public trust area. The applicant is not
proposing any new development above NHW.

Recommendations for State Permit—Historical Society of Topsail Island
There is concern that the extension of this structure 26' into Banks Channel could encroach into the channel portion of the
waterbody. This area of Banks Channel has two defined channels separated by a sand bar.There is the federally maintained
section that is located on the western side of the sandbar and the other channel is located on the eastern side of the sandbar.
The project site is located adjacent to the eastern channel.Judging by the water depths provided by the applicant the
deepest water is only 20' waterward of the end of the proposed dock.In addition,the pier would be in line with the pier to
the north however,the shoreline makes a shift inland to the south of this pier and there is a similar shift in the established
pier heads. Therefore,the end of this structure may extend beyond the established pier head line. In its current location the
water depths measure approximately—6' @ NLW on the landward side of the floating dock and-7' @ NLW on the
waterward side of the structure. Considering the orientation of this dock is parallel to the shoreline and two large
commercial head boats are moored on the outer edge of the floating dock,there may be potential impacts to navigation.
15A NCAC 07H .0208 (b)(6)(J)(i)states that piers shall not extending beyond the established pier length along the same
shoreline for similar use;(This restriction shall not apply to piers 100 feet or less in length unless necessary to avoid
unreasonable interference with navigation or other uses of the waters by the public);
15A NCAC 07H.0208(b)(6)(J)(ii)states that piers shall not extending into the channel portion of the water body.
Considering the potential impacts to navigation and the existing water depths on either side of the existing floating dock
this office would recommend approval of this permit,provided the US Coast Guard and US Army Corps of Engineers have
no concerns about navigational hazards. If approved the following conditions should be applied:
1) The permittee will maintain the authorized work in good condition and in conformance with the terms and
conditions of this permit.
2) The construction of the proposed project shall be in compliance with all local, State and Federal
regulations and associated permit conditions.
3) This permit authorizes only the dock,finger piers,boat lifts and associated pilings necessary for the
docking facility located in or over the waters that are expressly and specifically set forth in the permit
application. No other structures,whether floating or stationary,may become a permanent part of the
structure without a permit modification. No non-water dependent uses of structures may be conducted on,
in or over public trust waters without a permit modification.
4) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of
the structure and the adjacent property owners riparian access corridor,which is determined by drawing a
line parallel to the channel,then drawing a line perpendicular to the channel line that intersects with the
shore at the point where the upland property line meets the water's edge. This requirement shall be void
provided that a written waiver of the 15 feet setback is obtained from the affected adjacent riparian
property owner.
5) The permitee must install and maintain,at his expense,any signal lights and signals prescribed by the US
Coast Guard through regulations or otherwise,on authorized activities.
6) The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
7) No excavation of shallow water bottom or any wetlands is authorized by this permit.

8) This permit authorizes a maximum of five(5)boat slips. At no time shall more than 5 vessels be moored
or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types,
including but not limited to motorboats, sailing vessels and personal watercraft.
9) No sewage,whether treated or untreated,shall be discharged at any time from any boats using the docking
facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for
which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
10)No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters
at or adjacent to the authorized work.
11) This permit does not authorize the interference with any existing or proposed Federal project,and,the
permittee will not be entitled to compensation for damage to the authorized structure or work,or injury which
may be caused from existing or future operations undertaken by the United States in the public interest.
NOTE: Permanent reflectors should be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.
NOTE: The permittee and/or his contractor is urged to meet with a DCM Representative prior to project initiation.
NOTE: Future development on the permittee's property may require a modification of this permit. Contact a

67'0"from the bulkhead. This stay inside the space presently permitted for pier, dock, and tie dolphins, and will line the
most seaward side of the dock with the neighbor(Wallace)on the east side, and will allow the neighbor on west side
(Sundeland)to install a pier and dock without conflicting with the established use of the current pier and dock.

CAMA Request to Extend Commercial Dock
Project Narrative
The Historical Society of Topsail Island owns sound-front property at 720
Channel Blvd in the Town of Topsail Beach, NC.
The property has an existing pier and dock that is leased to commercial
fishing operations, and is used by the public for temporary moorage when
visiting the local business community.
An adjoining property owner, Gary Sunderland, has filed an application to
install a dock and pier on the west side of the Historical Society property
that would materially interfere with the Society's ability to maintain existing
established use of the present dock.
The Historical Society has an existing permit for a 125' wide floating dock
attached to a 35' long fixed pier(application # 86-05). The existing permit
allows the floating dock to project 41 feet from shore, and also allows
dolphins to be placed 67 feet from shore. We are requesting permission to
eliminate the seaward dolphins and move the floating dock seaward to the
line previously established by the seaward dolphins. This would place the
floating dock in line with the most seaward reaches of the Wallace pier in
the east, and would provide room for the Sunderland property to install their
proposed pier and dock on the west without interfering with the operation of
the Society's pier. There are no dolphins proposed seaward of those
anchoring the floating dock.
In addition, the proposed location would allow the Town of Topsail Beach to
arrange for the USACE to use the Society's dock as a refueling location for
dredges that used to maintain Topsail Inlet, Topsail Creek, and Banks
Channel. Presently the dredges have to travel to Sneads Ferry to refuel,
which significantly reduces operating time to maintain the navigable
channel. In times past the Corps refueled at the New Topsail Sound Pier,
which has been converted to private use and is no longer available.
The Society believes that this project is essential to help preserve the
commercial fishing operation that bolsters the economy of Topsail Beach,
and to offer the opportunity for the USACE to save precious dredge dollars
that would to channel maintenance in lieu of costly and time consuming
refueling trips.

Whereas The Historical Society of Topsail Island does own and operate a
commercial dock that supports an important commercial fishing operation
and is used by citizens and transients for temporary moorage when visiting
the Town's business center; and
Whereas the Topsail Island Historical Society wishes to modify and improve
it's commercial dock by moving it 27 feet further seaward into Banks
Channel; and
Whereas the modification of the dock will allow a neighboring property
owner to install a private pier without that pier interfering with the operation
of the Historical Society's dock; and
Whereas the modified dock will create a dock that can be used by the US
Army Corps of Engineers to refuel dredges such The Merritt that, are used
from time to time to maintain Topsail Inlet; and
Whereas allowing the Corps to occasionally refuel at the modified dock will
eliminate lost dredge time and the wasting of precious dredging funds by
having to stop dredging operations and travel to Sneads Ferry when
refueling; and
Whereas the modified dock will contribute to the continued viability of a
commercial fishing operation that is important to the Town, to Pender
County, and to the State of North Carolina;
Be it therefore resolved that the Town of Topsail Beach does hereby endorse
and support the requested modification and does encourage the NC Division
of Coastal Management to approve it.

The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on December 11,2007.
According to said application, the Historical Society of Topsail Beach proposes to extend
existing dock at 720 Carolina Blvd., adjacent to Banks Channel and Topsail Sound, in
Topsail Beach, in Pender County. A copy of the entire application may be examined or copied
at the office of Jon Giles, N.C. Dept. of Environment and Natural Resources, Division of Coastal
Management, 127 Cardinal Drive Extension, Wilmington, North Carolina 28405, (910-796-7215)
during normal business hours.
Comments mailed to James H. Gregson, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to February 12, 2008 will be
considered in making the permit decision. Later comments will be accepted and considered up to
the time of permit decision. Project modification may occur based on review and comment by the
public and state and federal agencies. Notice of the permit decision in this matter will.be provided
upon written request.

The Division of Coastal Management hereby acknowledges that on December 11,2007,we received your
completed application for State approval for the development of property located at 720 Channel Blvd, adjacent to Banks
Channel/Topsail Sound, in Topsail Beach,Pender County. The projected deadline for making a decision on your permit
application is February 26,2008.An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated above,you should
consider the review period extended. Under those circumstances,this letter will serve as your notice of an extended
review. However,an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from December 11,2007,you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project.
Such a meeting will be held within five working days from the receipt of your written request and shall include the property
owner,developer,and project designer/consultant.
NCGS 113A-119(b)requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a"Notice of Permit Filing"postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be:Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments. If additional information is required based on this review,the agencies may contact you
directly.
