If you are having the work done by a contractor,it would be to your benefit to be sure that he fully understands all permit requirements. State Permit #38-05 was issued March 16, 2005 and then renewed on February 17, 2009 for channel excavation, shoreline stabilization, and the extension of existing finger piers at the marina within Pierce Creek in Oriental, Pamlico County. The permit expires on December 31, 2010. The applicant is requesting to extend the permit expiration date. In accordance with "The Permit Extension Act of 2009," this permit's time period requirement was suspended. Therefore, this permit has already been extended as a result of that legislation. I would recommend issuing a letter to Mr. Winstead notifying him of the new expiration date of State Permit #38-05. This permit is valid until December 31, 2010. Due to the changes in our channel on Pierce Creek in Pamlico County, we possibly would need to maintenance dredge our channel as early as January 2011. We have discovered that the entrance channel is filling in more quickly than in the past. I would like to request a 2 year extension of our existing permit#38-05 to give us the flexibility to dredge either in 2011 or in the early months of 2012. We have continued to pursue additional projects as granted under the existing permit as funds have become available. As a not-for-profit corporation, this additional time enables us to maintain the existing channel not only for our 86 slips but for the over 200 neighbors on Pierce Creek who also use the channel. State Permit#38-05 was issued on March 16, 2005 for the construction of a new sill, marina expansion, and dredging on Pierce Creek near Oriental, Pamlico County. The permit expires on December 31, 2014. The request is to renew this permit. The applicant wishes to continue to maintain the dredged channel depths authorized by this permit. The Morehead City District staff would recommend that State Permit#38-05 be renewed for a period of five additional years. A check in the amount of$100 (#3827) has been received in order to process the request.
