This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 2) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 4) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) This permit authorizes a maximum of 10 boat slips. General 8) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily. 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers,to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. NOTE: Any proposal to add one or more additional slips to the authorized 10-slip facility shall require that the docking facility be classified as a marina, and will therefore require review under the N.C. Environmental Policy Act(NCEPA). NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. PROJECT SUMMARY: The applicant proposes to construct two docks with dockage for 10 vessels. Town of Windsor—Cashie River Center Public Transient Docks Bertie County Project setting The project site is adjacent US Highway 17 (Water Street)in the Town of Windsor on the Cashie River in Bertie County,North Carolina. The Roanoke/Cashie River Center, Partnership for the Sounds, and the US Fish and Wildlife Service are located on the approximately 6.23 acre site. Including the above referenced facilities,additional man-made features on the site include asphalt drive and parking area,boardwalk,boat ramp, amphitheater,bathrooms and created wetlands.All of the above were permitted under CAMA Major Permit No. 146-97 issued to the Town of Windsor on 18 November 1997. Vegetation on the site primarily consists of upland and wetland grasses, scrub willows, cypress trees, sycamore and maple along the River Shoreline. The property is bordered on the north(upstream)side by a vacant lot that is vegetated with upland lawn grasses. Existing structures on this property include boardwalk and some concrete riprap on the shoreline.The US Highway 17 Bridge over the Cashie River is also located upstream. The south (downstream) side of the project site is bordered by a developed lot and is vegetated with upland grasses and shrubs. The Cashie River is classified as B-SW by the Environmental Management Commission. The Cashie River is Inland Waters and is not open to shell fishing. Project description The Town of Windsor proposes to construct two t8' wide by ±32' long docks perpendicular to the existing boardwalk with a±8'by t20' T-Head platform at the terminal end of both proposed docks. Each dock and platform will provide side-to mooring for 5 vessels for a total of 10 fixed slips. The docks will be located immediately upstream of the previously permitted amphitheater. Anticipated impacts The piers and platforms to be constructed over the Cashie River will result in some localized short-term turbidity due to installation of pilings and the shading of±832 ft2 of river bottom. There are no public boat docks in Bertie County and this project will make it possible to accommodate the need for more boating on the Cashie River by improving a place close to the town for docking. It was received on 3 August 2005 and appears to be adequate for processing at this time. The projected deadline for making a decision is 17 October 2005. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances,this letter will also serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. Should there be any questions on this procedural change, do not hesitate to contact me. If this agency does not render a permit decision within 70 days from the 3 August 2005, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. N.C.G.S. 113A-119(b) requires that notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along the property where it can be observed from a public road. Some examples would be: nailing the notice card to a telephone pole or tree along the road right-of-way fronting the property, or at a point along the road right- of-way where a private road would lead one into the property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made and if additional information is required, you will be contacted by the appropriate State or Federal agency.
