This permit, issued on OrInher 5, 2005 , is subject to compliance with the application(where consistent
with the permit), all applicable regulations, special conditions and notes set forth below.Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
2) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are, expressly,and sipecifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
4) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
7) This permit authorizes a maximum of 10 boat slips.
General
8) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily.
9) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers,to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
NOTE: Any proposal to add one or more additional slips to the authorized 10-slip facility shall require
that the docking facility be classified as a marina, and will therefore require review under the
N.C. Environmental Policy Act(NCEPA).
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.

Bertie County
Project setting
The project site is adjacent US Highway 17 (Water Street)in the Town of Windsor on the Cashie River
in Bertie County,North Carolina. The Roanoke/Cashie River Center, Partnership for the Sounds, and the US
Fish and Wildlife Service are located on the approximately 6.23 acre site. Including the above referenced
facilities,additional man-made features on the site include asphalt drive and parking area,boardwalk,boat ramp,
amphitheater,bathrooms and created wetlands.All of the above were permitted under CAMA Major Permit No.
146-97 issued to the Town of Windsor on 18 November 1997. Vegetation on the site primarily consists of
upland and wetland grasses, scrub willows, cypress trees, sycamore and maple along the River Shoreline.
The property is bordered on the north(upstream)side by a vacant lot that is vegetated with upland lawn
grasses. Existing structures on this property include boardwalk and some concrete riprap on the shoreline.The
US Highway 17 Bridge over the Cashie River is also located upstream. The south (downstream) side of the
project site is bordered by a developed lot and is vegetated with upland grasses and shrubs.
The Cashie River is classified as B-SW by the Environmental Management Commission. The Cashie
River is Inland Waters and is not open to shell fishing.
Project description
The Town of Windsor proposes to construct two t8' wide by ±32' long docks perpendicular to the
existing boardwalk with a±8'by t20' T-Head platform at the terminal end of both proposed docks. Each dock
and platform will provide side-to mooring for 5 vessels for a total of 10 fixed slips. The docks will be located
immediately upstream of the previously permitted amphitheater.
Anticipated impacts
The piers and platforms to be constructed over the Cashie River will result in some localized short-term
turbidity due to installation of pilings and the shading of±832 ft2 of river bottom.

ARTICLE VI. —USE REQUIRENINTS BY DISTRICTS

The M-I Industrial District is established for those areas of the community where

S_3 Dimensional Requirements
Within the M-1 Industrial District as shown on the zoning map, the

9. R-75 Residential District
The R-75 Residential District is established as a district in which the principal use
of land is for single-family dwellings, including manufactured homes, single wide and/or
double wide. It is intended that single-family manufactured homes meeting specific
standards may be placed on a lot that is zoned R-75 and that the R-75 district shall
provide an opportunity for manufactured homes to be placed in a single-family residential
district as well as to provide on opportunity for alternative, affordable housing, subject to
the requirements set forth herein.
9_1 The following uses are permitted:
9.1-a Single family and two-family dwellings.
Accessory building for residential uses, provided that no accessory building shall
be rented or occupied for gain and provided accessory building shall meet the minimum
yard requirements as defined herein.
9.1-b Manufactured. homes.
9.1-c Modular homes, subject to the same regulations as for other
dwelling houses in this use district. The modular home shall have a
continuous, permanent masonry foundation or masonry curtain wall
around the perimeter of the home, constructed in accordance)A7ith
standards of the North Carolina Building Code and unpierced
except for required ventilation and access.
9.2 The following uses are conditional.uses and may be permitted subject to a

We have reviewed the above permit application concerning the Town of Windsor's proposed plans to
construct two docks. Because of the project's location along Windor's historic water front the area is deemed
likely to hold significant submerged cultural resources, such as vessel remains, from historic activities.
Alerted by this information, staff members of this division inspected the project specifications carefully and
determined that the project constituted a minor bottom disturbing activity.We, therefore,recommend that no
underwater archaeological investigation be conducted in connection with this project.
We would like to notify you that this project should be undertaken with caution. If during construction
submerged archaeological materials are encountered,such as shipwreck remains,it is the responsibility of the
Army Corps of Engineers—Wilmington District to notify us immediately,pursuant to Section 106 of the
National Historic Preservation Act of 1966. In addition,the area is protected by North Carolina legislation
(G.S. 121-22 to 28,Article Isalvage of abandoned shipwrecks and other underwater archaeological materials
on all bottoms from low water to one marine league seaward, and bottoms of other navigable waters).This
law is supported by the Abandoned Shipwreck Act of 1987 (P.L. 100-298)which gives the state jurisdiction
over a broad range of living and nonliving resources in state waters and submerged lands,including certain
abandoned shipwrecks,which have been deserted and to which the owner has relinquished ownership rights
with no retention.
The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the
Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36 CFR
Part 800.

The Washington Regional Office received a copy of your CAMA application for your two proposed
finger piers project on August 10, 2005 Staff review of the plans and specifications has determined that
the project, as proposed, consists of activities that will not pose surface water quality threats from
stormwater runoff since no significant new impervious area is proposed.
The Director has determined that projects that are reviewed and approved by the Division as not posing
water quality threats from stormwater runoff should not be subject to the stormwater management
permitting requirements of 15A NCAC 211.1000. For this reason, we are informing you by way of this
letter that your project will not require a stormwater management permit at this time.
The stormwater rules require the Division to permit the common plan of development, therefore, any
future development on the property, regardless of whether a CAMA Major permit is also required, will
require a Stormwater Management Permit application and permit issuance from the Division of Water
Quality prior to any construction. Any construction on the subject site, prior to receipt of the required
permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement
action by this Office.
Please keep in mind that this determination does not affect your legal requirements to obtain other permits
which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Area
Management Act or any other Federal, State or Local Government.

Enclosed is a Major Permit application received from Mr. David Overton on behalf of the
Town of Windsor for development located off US Highway 17 (Water St.) on the Cashie
River in Bertie County,North Carolina. The Town of Windsor proposes to construct two t8'
wide by±32' long docks perpendicular to the existing boardwalk with a f8' by±20' T-Head
platform at the terminal end of both proposed docks. Each dock and platform will provide
side-to mooring for 5 vessels for a total of 10 fixed slips.
Based on my review of the proposed project with regard to rules found in Subchapter 7H
concerning development in a Public Trust Area, I recommend the following conditions.
1 The authorized structures and associated activity must not cause an unacceptable interference
with navigation,and shall not exceed the permitted 40' in length as shown on plats dated 28
June 2005.
2 No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
3 This permit authorizes only the docks,piers,and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, may become a permanent part of this
marina/docking facility without permit modification. No non-water dependent uses of
structures may be conducted on,in or over public trust waters without permit modification.

3. Water Quality Certification

the Town of Windsor on the Cashie River in Bertie County,North Carolina.
LUP CONSISTENCY DETERMINATION
The proposal is consistent with and not in conflict with the Bertie County CAMA
Land Use Plan Update 1998 certified by the CRC on September 8, 1999.
PROJECT SUMMARY
The project site is adjacent US Highway 17 (Water Street) in the Town of Windsor on the
Cashie River in Bertie County. The Roanoke/Cashie River Center, Partnership for the Sounds,
and the US Fish and Wildlife Service are located on the 6.23-acre site. Additional site features
include an asphalt drive and parking area, boardwalk, boat ramp, amphitheater, restrooms and
created wetlands. All were permitted under CAMA Major Permit No. 146-97 issued to the
Town of Windsor on November 18, 1997. The property is bordered on the north side (upstream)
by a vacant lot that has a boardwalk and concrete riprap on the shoreline. Further upstream is the
US Highway 17 Bridge over the Cashie River. The south side (downstream) of the project site is
bordered by a developed lot.
The Town proposes to construct two 8' x 32' docks perpendicular to the existing boardwalk,
with an 8' by 20' T-head platform at the terminal end of both proposed docks. Each dock and
platform would provide side-to mooring for 5 vessels for a total of 10 fixed slips. The docks
would be located immediately upstream of the amphitheater.
Anticipated impacts:
The project as proposed would result in the shading of 832 ft2 of river bottom.

We are requesting for a CAMA Major Permit application for two (2) boat docks with T-head
platforms in the Cashie River adjacent to an existing boardwalk located at the Roanoke
Cashie River Center.
The Town of Windsor has improved a 6.23 acre tract of land owned by the Town of Windsor
with approximately 580 feet adjacent to the Cashie River. We have constructed a completely
handicap accessible boat ramp adjacent to this site, the public has access to the Cashie River
along the entire 580 feet adjacent to the Cashie River, a Welcome Center or visitors center has
been constructed on this site with in-door classrooms, craft shop, office and an interpretive
area, outdoor restrooms constructed, an outdoor amphitheater constructed, walkways
constructed throughout this site and parking facilities constructed.
There are no public boat docks in Bertie County and this project will make it possible to
accommodate the need for more boating on the Cashie River by improving a place close to
the town for docking. The downtown is only four blocks away, the historic district is only
one block away plus a nearby business for boating,hunting and fishing located across the
Cashie River from the boat docks.
The boat docks will be completely handicap accessible. This entire project serves as a
welcome center or visitor center to serve both year round and seasonal users. The primary
purpose of this project has been to provide on site learning or teaching the importance of our
wetlands and preservation of our environment.

This letter is in reference to your CAMA Major permit application submitted on behalf of the
Town of Windsor and received in this office on 5 July 2005 for development at the Roanoke
Chowan River Center in the Town of Windsor on the Cashie River in Bertie County,North Carolina.
The application is to construct two docks with T-head platforms adjacent the existing boardwalk
into the Cashie River. I have reviewed the application for completeness and have found that several
items need to be addressed prior to accepting the application as complete.

Signed green cards or copies showing receipt of the entire application package by the
adjacent riparian property owners should be included or sent when received by you. You need to
label the proposed slips on your plat work to ensure an accurate slip count since any more than 10
slips will define the project as a marina and will require you to fill out DCM-MP-6. A cover letter is
needed describing the project as proposed for clarity. I suggest you refer to the original project for
the River Center that was permitted as CAMA Major Permit No. 146-97. This permit was issued to
the Town on 18 November 1997 and expired on 31 December 2000. The original permit was
accompanied by an Environmental Assessment document. You need to include a check for $400
made payable to N.C.D.E.N.R.

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on 3 August 2005.
According to the said application, the Town of Windsor proposes to construct two docks with
dockage for 10 vessels in the Town of Windsor - Cashie River Center Public Transient Docks,
located adjacent US 17 (Water Street), on the Cashie River, at Windsor, North Carolina, in Bertie
County, North Carolina. A copy of the entire application may be examined or copied at the office
of Terry Moore, 943 Washington Square Mall, Washington, NC during normal business hours.

DIVISION, NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL
RESOURCES, 400 COMMERCE AVENUE, MOREHEAD CITY, NC 28557 prior to 28 August
2005 will be considered in making the permit decision. Later comments will be accepted and
considered up to the time of permit decision. Project modification may occur based on review and
comment by the public and state and federal agencies. Notice of the permit decision in this matter
will be provided upon written request.

Dear Mr. Overton:
The Division of Coastal Management hereby acknowledges receipt of an application for State
approval for development of property located in Bertie County, adjacent US 17, (Water Street) on the
Cashie River at Windsor, North Carolina. It was received on 3 August 2005 and appears to be adequate
for processing at this time. The projected deadline for making a decision is 17 October 2005. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances,this letter will also serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day. Should there be any questions on
this procedural change, do not hesitate to contact me.
If this agency does not render a permit decision within 70 days from the 3 August 2005, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of your
written request and shall include the property owner, developer, and project designer/consultant.
N.C.G.S. 113A-119(b) requires that notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point along the
property where it can be observed from a public road. Some examples would be: nailing the notice card to
a telephone pole or tree along the road right-of-way fronting the property, or at a point along the road right-
of-way where a private road would lead one into the property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made and if additional information is required, you will be contacted
by the appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
