This permit, issued on June 01,2005 , is subject to compliance with the application(where consistent with
the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein,this permit authorizes the demolition of the existing Quality Inn— Sea
Oatel Motel and the returning of the site to natural conditions, which includes filling to re-establish the
natural grade, all as depicted in the attached permit application and workplan drawings.
Stormwater Management
2) In order to protect water quality, runoff from the construction shall not visibly increase the amount of
suspended sediments in adjacent waters.

ADDITIONAL CONDITIONS

which was issued on 05/05/2005. Any violation of the permit approved by the DWQ shall be considered
a violation of this CAMA permit.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the The Town of Nags Head, C/O Kim Allen, Post Office Box 99, Nags Head, NC
27959.
4) Appropriate sedimentation and erosion control devices, measures or structures (e.g. silt fence, diversion
swales or berms, sand fences, etc.) shall be implemented to ensure that eroded materials do not enter
adjacent wetlands, watercourses and/or properties.
5) Dune disturbance shall be allowed only to the extent necessary for the authorized project to be carried
out, and if the dune's protective value is not weakened or reduced. All disturbed areas shall be
immediately stabilized with vegetation.
6) Only beach quality sand shall be used for dune rehabilitation purposes. Prior approval from the Division
of Coastal Management shall be required for any material that is to be brought in from off site borrow
areas.
General
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property, including but not limited to the construction of
single-family residences, may require a modification of this permit. Contact a representative of
the Division at(252)264-3901 or(252) 946-6481, or the Town or Nags Head, prior to
commencement of any such activity for this determination.
NOTE: The permittee and/or his/her contractor is urged to meet with a representative of the Division
prior to project initiation.
NOTE: The U.S. Army Corps of Engineers has assigned this project COE Action ID No. 200510936.
NOTE: The Division of Water Quality is currently reviewing the permit application to determine if the
project is in compliance with North Carolina's Water Quality Certification program and has
assigned the proposed project DWQ Project No. 050750. The permittee must receive a Water
Quality Certification from DWQ prior to the initiation of any construction activities.

VDT,LLC,has requested the attached application be processed under the Express Permit Review
Program, for removal of the Quality Inn - Sea Oatel Motel under the name of VDT, LLC—Gary
Hesselbacher.
The project site is located at 7123 South Virginia Dare Trail in the Town of Nags Head,
adjacent NC 12 on the Atlantic Ocean in Dare County,North Carolina. The proposed project site
comprises f4.3 acres and is the old Quality Inn- Sea Oatel Motel site.
The project site is within the Ocean Hazard Area of Environmental Concern (AEC) as
identified in North Carolina Administrative Code 15A NCAC 07H.0304. All development within
this area is subject to authorization by the Division of Coastal Management.
The current site is ±400' wide by ±465' deep, and with the exception of a ±125' wide
reconstructed dune and surf zone; the entire site has been developed with hotel buildings, a
restaurant, swimming pool,and parking lots. The oceanfront portion of the hotel and the restaurant
suffered extreme damage in previous hurricanes and have been gutted. The office is still functioning
and serves the portion of the hotel complex located on the west side of NC 12. The existing hotel on
the west side of NC 12 is a separate parcel of property and is not a part of this permit application.
Vegetation on the site is limited to an area of lawn grass, shrubs and two flower gardens in
three small areas between the parking lots and NC 12. The existing drain fields for the onsite septic
system are below these three vegetated areas. American Beach grass(Ammophila sp.)has recently
been sprigged to re-establish vegetation between the hotel and the Atlantic Ocean on the
reconstructed dune. The project site is bordered on the north(upstream)side by another hotel and on
the south (downstream) side by a Town of Nags Head 50' wide undeveloped right of way.
The Atlantic Ocean is classified as SB by the Environmental Management Commission and
is open to shell fishing.
Project description
The applicant proposes to demolish all structures on the project site and return the site to a
natural state including vegetation. Compatible sand fill will be brought to the site to fill in holes left
by the removal of the footings, parking lots, septic tanks and drain fields, and pool, and to re-
establish the natural grade. Proposed plantings include American Beach grass(Ammophila sp.), Sea
Oats(Uniola paniculata),and Bitter Panicum(Panicum amarum). The tract will be subdivided into
eight - 50' wide by±465' deep lots as per the original plat on record with the Town of Nags Head.
The debris will be hauled to an approved disposal site as per the requirements of the Town of Nags
Head. The applicant is currently pursuing this permit from the Town.

Anticipated impacts
The project as proposed will result in the disturbance of±97,574.4 ft2 of uplands as a result of
the demolition activities. The project as proposed will result in a removal of±97,574.4 ftZ of
impervious surface within the Ocean Hazard AEC. Depending upon weather conditions at the time
of the demolition, there could be short-term localized wind born sand/dust.

CAMA NARRATIVE
SEA OATEL MOTEL DEMOLITION
PROJECT DESCRIPTION:
The purpose of this project is to demolish and remove structures and pavement associated
with the Sea Oatel Motel, which is located on a± 4.3-acre tract with a physical address of
7123 South Virginia Dare Trail in the Town of Nags Head. In addition to demolition of
the motel, a swimming pool will be filled in and a septic system consisting of solids
holding tanks and pump tanks will be removed in a manner that is consistent with local
health regulations and construction guidelines. Compatible material will be used for
disturbed areas requiring fill.
SITE DESCRIPTION:
The site is an oceanfront lot located in Dare County in the Town of Nags Head on the
east side of NC Hwy 12 (Virginia Dare Trail). The ocean front dune has recently been
reestablished and sprigged with American Beach grass (Ammoghila �ip.). The site is
bordered on the North by the Owens Motel and to the South by an ocean access/parking
area owned by the Town of Nags Head.
CONSTRUCTION:
Demolition will restore the site to a pervious surface. All building and pavement
materials will be removed from the site. Grading of the site will be compatible with
adjacent properties and NC Hwy 12.

Consistency Determination: The request is consistent with/not in conflict with the Town of
Nags Head 2000 Land Use Plan certified by the CRC on
September 29, 2000.
Overview: The Quality Inn — Seaoatel Motel is located on a 400 foot wide by 465 foot deep site
that is entirely developed with hotel buildings, a swimming pool, and parking lots. The property
is served by septic tanks. Oceanfront portions of the hotel and restaurant suffered extreme
damage in previous hurricanes and have been gutted. The office is still functioning and
services a portion of the hotel complex located on the west side of NC 12 on a site that is not
included in this application. Existing vegetation on the site is limited to lawn grass, shrubs, and
three small flower gardens. A 125 foot wide reconstructed dune and surf zone are also located
on the site. American Beach grass has recently been sprigged to re-establish vegetation
between the hotel and the Atlantic Ocean on the reconstructed dune.

natural grade with vegetation. Compatible sand fill will be brought in to fill holes left by the
removal of footings, parking lots, septic tanks, drain fields, and the pool. Debris will be hauled
to an approved disposal site. American Beach grass, Sea Oats, and Bitter Panicum will be
planted on the site. The tract will be subdivided into eight 50 foot wide and 465 foot deep lots
per the original plat on record with the Town of Nags Head.
The Atlantic Ocean is classified as SB and is open to shell fishing.
Anticipated Impacts resulting from this project are expected to include: the disturbance of
97,574 sq. ft. (2.24 acres) of uplands resulting in the removal of 97,574 sq. ft. (2.24 acres) of
impervious surface within the Ocean Hazard AEC.

The Town of Nags Head Land Classification Map identifies the site area as "D-2 Developed".
The following LUP policies may be applicable to this request:
Coastal Zone Management Act(CZMA) program and the Coastal Area Management Act
(CAMA) program: Pages 77 and 78
• The CZMA program and the state of North Carolina's CAMA program are designed
to protect the coastline and coastal resources. The Town of Nags Head supports
this principal in the CZMA and CAMA programs.
Dunes: Page 105
• The oceanfront dunes represent the first line of defense in protecting property and
lives from the affects of the ocean. Maintenance and preservation of these dunes
are important for the welfare of the Town and its citizens and visitors. The Town
supports the CAMA rules in oceanfront development.
Density of redevelopment: Page 108
• Redevelopment shall be consistent with existing development that was in place
before the storm event as well as the redevelopment patterns contained in the
Land Classification Map and the zoning ordinance.
• As the amount of available vacant oceanfront land diminishes the Town can expect
redevelopment of existing sites. It is the Town's position that the existing
oceanfront development regulations adequately address concerns such as building
height and density, and that currently allowed and permitted uses adequately
represent the desired uses for the oceanfront. (Also Development constraints—

Preservation of dunes and topography: Page 154
• The Town views the preservation of dunes and topography as an important
component in the Nags Head image and shall strictly enforce the existing
applicable rules and regulations and seek additional measures as needed to
preserve as much of the natural topography as possible.

• The Town recognizes that damaged homes and structures on the oceanfront
represent a nuisance, eyesore and visual blight and the Town shall take
appropriate measures to abate this nuisance.

construction, operation and maintenance of stormwater management systems in compliance with the
provisions of 15A NCAC 2H.1000(hereafter referred to as the "stormwater rules")and the approved
stormwater management plans and specifications, and other supporting data as attached and on file with
and approved by the Division of Water Quality and considered a part of this permit for grassed swales and
buffers to serve the proposed Clearing and Grading project in Dare County.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specific conditions and limitations.
I. DESIGN STANDARDS
1. The total project area included 4.3 acres. No new impervious area is proposed. The
existing motel and all impervious area are to be removed per plans.
2. Approved plans and specifications for projects covered by this permit are incorporated by
reference and are enforceable parts of the permit.
3. Only clearing and grading activities are permitted. The permittee must submit a
modification and receive approval prior to the construction of any built-upon surfaces.
4. No stormwater piping in addition to the proposed piping shall be allowed except:
a. That minimum amount necessary to direct runoff beneath an impervious surface
such as a road.
b. That minimum amount needed under driveways to provide access to lots.
5. The only runoff conveyance systems allowed will be vegetated conveyances such as
swales with minimum side slopes of 3:1 (H:V)as defined in the stormwater rules and
approved by the Division.
II. SCHEDULE OF COMPLIANCE
1. Grasslined swales,vegetated buffers and other Best Management Practices used for
stormwater runoff control shall be adequately maintained throughout the life of the
project.
2. The permittee shall at all times provide adequate erosion control measures in
conformance with the approved Erosion Control Plan.

3. The permittee shall submit all information requested by the Director or his representative
within the time frame specified in the written information request.
III. GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statutes 143-215.6A to 143.215.6C.
2. The permit may be modified,revoked or terminated for cause. The filing of a request for
a permit modification,or termination does not void any permit condition.
3. The issuance of this permit does not prohibit the Director from reopening and modifying
laws,rules, and regulations contained in Title 15A of the North Carolina Administrative
Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et.al.
4. The following items will require a modification to the permit:
a. Any revision to the approved plans,regardless of size
b. Project name change
C. Change of ownership
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision of the project area
f. In addition,the Director may determine that other revisions to the project should
require a modification to the permit.
5. For any additions or modifications of the previously permitted built-upon area,the
permittee shall submit to the Director revised plans and specifications and shall receive
approval prior to construction.
6. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the
notice,the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made.
7. The permit is not transferable to any person except after notice to and approval by the
Director. The Director may require modification or revocation and reissuance of the
permit to change the name and incorporate such other requirements as may be necessary.
A formal permit request must be submitted to the Division of Water Quality accompanied
by the appropriate fee, documentation from both parties involved,and other supporting
materials as may be appropriate. The approval of this request will be considered on its
merits, and may or may not be approved.
8. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies(local, state and federal)which have jurisdiction.

EXPRESS PERMIT REVIEW PROGRAM
The Department of Environment and Natural Resources hereby gives
public notice as required by N.C.G.S. 113A-119(b) that an application for a
development permit in an Area of Environmental Concern as designated
under the Coastal Area Management Act (CAMA) was received on 02 May
2005. According to the said application, VDT, LLC proposes to demolish
the existing Quality Inn — Sea Oatel and return the site to natural conditions,
on NC 12, at 7123 South Virginia Dare Trail, adjacent the Atlantic Ocean, in
the Town of Nags Head, in Dare County, North Carolina.
A copy of the entire application may be examined or copied at the
office of David Moye, 943 Washington Square Mall, Washington, NC
27889, during normal business Hours. Public comments received by 30 May
2005 will be considered. Later comments will be accepted and considered
up to the time of permit decision. Project modifications may occur based on
further review and comments. Notice of the permit decision in this matter

at 7123 Virginia Dare Trail (NC 12) adjacent the Atlantic Ocean within the Town of Nags Head
in Dare County,North Carolina. It was received as complete on 02 May 2005, and appears to be
adequate for processing at this time. You have requested that the application be processed under
the Express Review Permitting Program. Under this expedited process, the projected deadline
for making a decision will be around 1 June 2005.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a '`Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
