This permit, issued on February 23,2017 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification and Renewal authorizes the reconfiguration of the permitted docking facility, all as expressly and specifically set forth in the modification request. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) Any portion of the structure built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 3) This Minor Modification and Renewal does not authorize any new formalized boat slips. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DEQ and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. W�-� Matthew & Jill Robinson Permit# 4-05 Page 2 of 2 ADDITIONAL CONDITIONS 4) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 5) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 6) The authorized project is located within a primary nursery area(PNA). Therefore, in accordance with TI5A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 8) This Minor Modification and Renewal shall be attached to the original permit, which was transferred to the permittee on 1/21/16, and copies of both documents shall be readily available on site when Division personnel inspect the project for compliance. 9) All conditions and stipulations of the active permit remain in force under this Minor Modification and Renewal, unless specifically altered herein. NOTE: This Minor Modification does not eliminate the need to obtain any additional permits or authorizations that may be required. NOTE: A minor modification and renewal application processing fee of$200 was received by DCM for this project. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2016-02539), which was issued on 12/29/16. NOTE: The N.C. It was originally issued to Derek and Sarah Wright on January 11,2005 for the construction of a private pier and docking facility at 7227 NoName Road,adjacent to Hewletts Creek in Wilmington. It was modified on April 3, 2006 and renewed/amended on June 23, 2009. State Permit No. 4-05 expired on December 31, 2010, however was subject to extension by Legislative Session Law 2009-406,the Permit Extension Act,as amended by Session Law 2010-177.It was renewed on August 26,2014 and was transferred to Matthew&Jill Robinson on January 21, 2016. This permit expired on December 31, 2016. Mr. & Pinkston state due to bank financing, construction was delayed, and that it is their intent to use the permit for its originally intended purpose and to conform to the permit conditions. This office has no objections to the renewal of State Permit No. 4-05. Mr. Pinkston has included check(no. 8677) in the total amount of$100.00 for the processing fee, along with a copy of the deed transferring title of property.
