with the permit),all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action;or may cause the permit to be null and void.
1) This renewal shall be attached to the original of Permit No. 156-05, which was issued on 10/26/05,
and copies of both documents shall be readily available on site when Division personnel inspect the
project for compliance.
2) All conditions and stipulations of the active permit remain in force under this renewal.
NOTE: The expiration date of this permit has been extended in accordance with Session Law 2009-
406, and amended by Session Law 2010-177.
This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty(20) days of the issuing Chairman of the Coastal Resources Commission.

Dear Sir or Madam:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,the
State Dredge and Fill Law, for you to proceed with your project proposal.The original (buff-colored form)is retained by
you and it must be available on site when the project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh,NC 27611-6714, (919) 733-2698 within twenty(20)days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty(20)days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications,time extensions,and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review,we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions,environmental safeguards, or problem areas,you may contact Department personnel at any time for assistance.
By working in accordance with the permit, you will be helping to protect our vitally important coastal resources.

This letter of refinement is in reference to your 25 April 2013 correspondence(attached), as agent, requesting a renewal and
modification of Major CAMA Permit No. 156-05. This permit was issued to Marjorie M.N. Tyler and William Powell on 26 October
2005 for the addition of 3 single pile personal watercraft lifts to an existing, shared L-head pier structure with an existing boathouse
and sailboat lift, for a docking facility of five boats. The shared pier structure is located at 446 Batchelor Bay Drive(off NC Hwy 45), in
Batchelor Bay Subdivision, on Batchelor Bay of Albemarle Sound, near the Town of Windsor in Bertie County, North Carolina. This is
the first letter of refinement for the permit, and the renewal was issued on 15 May 2013 with an expiration date of 31 December 2014.
The applicants installed the 3 personal watercraft lifts as authorized, removed the existing sailboat lift, and have recently
removed one of the personal watercraft lifts. Therefore, they currently have a docking facility for 3 boats. Your request to amend the
permit to allow for the construction of two side by side, 20' long by 15' wide, uncovered boat lifts separated by a 42' long by 3'wide L-
shaped catwalk for access off the main pier structure, as shown on your attached plats (2) dated 25 April 2013, is hereby authorized.
This will be accomplished by removal of another personal watercraft lift, resulting in a docking facility for a total of 4 boats on the
shared pier structure. Total shoreline length for both properties is 182', and this modification will result in an increase of 126 ft2
shaded impact(from 565 ft2 to 691 ft2) due to the addition of the L-shaped catwalk. All permit conditions including the 31 December
2014 expiration date still apply and remain unchanged. Your plan view and cross-sectional drawings, both dated 25 April 2013, will
become a permanent part of the file.

Major CAMA Permit No. 156-05 was issued to Marjorie M.N. Tyler and William
Powell on 26 October 2005 for the addition of 3 single pile personal watercraft lifts to an
existing, shared L-head pier structure with an existing boathouse and sailboat lift, for a
total mooring of five boats. The shared pier structure is located at 446 Batchelor Bay
Drive (off NC Hwy 45), in Batchelor Bay Subdivision, on Batchelor Bay of Albemarle
Sound, near the Town of Windsor in Bertie County, North Carolina. This is the first
renewal request for the permit, and the expiration date of 31 December 2008 had been
changed to 31 December 2012 due to Session Law 2010-177. The applicants installed
the 3 personal watercraft lifts as authorized, removed the existing sailboat lift, and have
recently removed one of the personal watercraft lifts. Therefore, they currently have
mooring for 3 boats. The attached cover letter for the project is also a request for a
modification. Based upon your conversation with David Moye, it was agreed that a
Letter of Refinement will be issued for the proposed modification following the renewal
of the permit.
The $100 check covering the cost of the requested renewal was received and
has been deposited in the Department's account. Staff recommends renewal of the

Dear Ms. Hedrick:
My name is W. Reid Clarke, agent of property owners. (See attached
"Authorized Agent Agreement"). We are requesting a renewal and minor
modification of Permit #156-05 that was issued for the construction of 3 single pile
jet ski lifts to an existing pier structure with existing boathouse and sail boat lift, for
an authorized total of 5 boats. Under this permit, one covered boat lift and three jet
ski lifts were built to pier structure. As of today one jet ski lift has been removed
leaving 3 lifts on pier.
If permit is renewed with minor modifications, we will keep one covered boat
lift, one jet ski lift, remove and replace one jet ski lift with two side by side
uncovered 4 pile lifts (Numbers 3 and 4) with a L-shaped catwalk in between them,
both lifts being adjacent to the L-shaped platform on the opposite side of the
existing covered boat lift. This proposal will result in a total of 4 boat lifts for the
shared pier structure, which is one less than originally permitted.
Total shoreline on both properties is f 91' each, for a total of 182'. This
minor modification will result in a 126 S.F. increase in shaded impact by the
addition of the proposed L-shaped cat walk for access to the two new lifts. Current
shaded impact of 565 S.F. in platforms and covered boat lift will increase to 691 S.F.
for this project.
