Morehead City, as requested in the permittee's application dated 05/06/04 (MP-1) & 05/10/04 (MP-4) , including the attached workplan drawing labeled 3 of 3, dated 05/17/04 and revised 1/4/05 This permit, issued on January 6, 2005 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) In order to protect juvenile shrimp and finfish populations, no excavation shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. 2) Excavation shall not exceed -6 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. 3) No vegetated wetlands shall be excavated or filled. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. General 8) All work authorized by this permit must be performed in strict compliance with the attached work plan drawings, which are a part of this permit. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's rights to free navigation on all navigable waters of the United States. 11) No excavated material shall be placed in any location or in any manner so as to impair surface water flow into or out of any wetland area. 12) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. Paul Stephens Permit#02-05 Page 3 of 3 13) The West Indian manatee (Trichechus manatus), which is listed as a federally endangered species, has been reported in the waters near Beaufort waterfront. In order to protect the West Indian Manatee, if possible, all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" must be followed. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are'not authorized within 30 feet of the normal high water level. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: The permittee's contractor is advised to contact the U.S. Coast Guard at(910) 815-4895, ext. 108 to discuss operations and appropriate lighting,markers, etc. for all excavation equipment. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3400 (DWQ Project No. 041846),which was issued on 12/03/04. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 198000291 (COE Action Id. No. 200500160),which was issued on 12/05/05. PROJECT SUMMARY: The applicant has applied to excavate a basin around his existing docking system within Peletier Creek, waters connecting to Bogue Sound, for private use. Narrative Description: The applicant owns a little over a third of an acre adjacent to Peletier Creek within the Town of Morehead City, Carteret County. The street address is 119 Riverside Drive, which is located just east of Coral Bay Marina off Highway 70. This property is located within a new subdivision in the Mansfield area of Morehead City. The property varies from 5' to 8' above mean sea level in elevation, and is vegetated with typical lawn grasses. A wooden walkway leads from the waterward side of the house to the dock. Current development on the lot includes a single-family residence, shore perpendicular dock with boatlift and wet slip, and a vertical bulkhead. The existing pier is the result of two previous CAMA General Permits, one issued in August 2000 and the last in July of 2003. The shorelines of the neighboring properties are likewise stabilized with vertical bulkheads. The adjacent waterbody is Peletier Creek, a tributary to Bogue Sound, which runs north to south. The waterbody is not designated a primary nursery area by the DMF, and is classified SB by the DWQ. The creek and adjacent waters of Bogue Sound are closed tQ shellfish harvesting. Water depths in the area of the existing dock average -4' at_4=� ow water and reach a depth of-6' + low water approximately 38' offshore. Peletier Creek is approximately 209' across at the project site. The Morehead City Land Use Plan classifies this area as Developed, with all AEC's classified Conservation. There are no shellfish or SAV resources evident at the project location. The applicant is seeking to conduct new excavation under the existing wet slip located off the east side of his dock. The area of excavation measures approximately 20' wide and 39' long. Soundings in the area presently indicate -4' at nlw, with connecting water depths of-6' nlw. The proposal is to deepen the project area by 2' for a final depth of-6' nlw. This will require the disturbance of approximately 780 sf of shallow bottom area, with the ultimate removal of approximately 60 cubic yards of sandy/silty bottom material. The excavation is proposed to be accomplished by bucket to barge, and offloaded to high ground. The spoils are ultimately to be disposed of on Malcolm Ray Willis' property (authorization on file) which has served as a spoil disposal site previously. 10. Anticipated Impacts: The project will involve the loss of 780 sf(60 cubic yards) of shallow bottom habitat within the estuarine waters of Peletier Creek. Usage by a larger vessel should pose no additional impacts, as larger vessels are numerous in this creek at private docks and marinas. Turbidity impacts from the dredging operation can be expected, and should be short term. After reviewing this information, it has been determined that stormwater runoff from your project should not pose any significant threat to the adjacent surface waters. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H. 1000. S. Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated November 23, 2004. The applicant, Paul Stephens, has applied for a Department of the Army(DA)permit to excavate a basin around an existing docking system. The proposed work is being considered under Regional General Permit#198000291, a permit/processing agreement for work that has been approved pursuant to the North Carolina Coastal Area Management Act (CAMA). These comments are submitted in accordance with the Fish and Wildlife Coordination Act(FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review(33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended(16 U.S.C. 1531-1543). Proposed Action and Anticipated Impacts The PN contains the Field Investigation Report (FIR), dated November 12, 2004, of the North Carolina Division of Coastal Management (NCDCM). The FIR states that the applicant proposes to conduct new excavation under the existing wet slip off the east side of the dock. The basin is located in Peletier Creek, a tributary of Bogue Sound. The area is not designated as a primary nursery area. The FIR notes that existing water depths are -4 feet at normal low water(NLW). The proposed dredging would create depths of-6 feet at NLW. The work would remove approximately 60 cubic yards of material and disturb approximately 780 square feet of shallow estuarine bottoms. The excavation would be done by bucket and barge with the material offloaded to high ground. The permit application states that the material to be removed consists of sand. 2 Federally Protected Species The Service has reviewed available information on federally-threatened or endangered species known to occur in Carteret County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on the special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey(USGS). Data from USGS quads provide the most project-specific information on species which should be considered in permitting this project. The project area is in the Mansfield quad. The occurrence data of special status species within this quad can be obtained on the internet at<htlp://www.nenhp.orsz/Pages/heritagedata.html >. Our review indicates that the only federally protected species likely to occur in the project area is the West Indian manatee (Trichechus manatus), a federally-endangered mammal. The species has been reported from Carteret County and occurs as a current record in the Mansfield quad. The shallow, estuarine waters of the project area may provide suitable habitat for manatees that move along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily from June through October. Manatees may occupy waters one to two meters (3.3 -6.6 feet) deep. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular construction site. Based on information in the FIR, water depths at the construction site could allow manatees to be present in the area. To protect manatees in North Carolina, the Service developed guidelines entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina." These guidelines address all types of in-water construction, except blasting,and should produce little, if any, additional expense. The guidelines are intended mainly to ensure that construction personnel are informed that manatees may occur in the work area, that work should cease if a manatee approaches the work area, work should not resume until the manatee leaves the work area, and procedures for reporting the death or injury of a manatee. The risk to manatees could be reduced to an acceptable level by the implementation of the Service's guidelines. The risk would be further reduced by performing the work during the period of November through May. With the inclusion of our manatee conditions,the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. However, the requirement of section 7 would need to be reconsidered if: (1)new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. 3 Service Concerns and Recommendations The only concern of the Service regarding this permit is the potential for harm to areas of submerged aquatic vegetation (SAV). The biological productivity of SAV is very important to a diversity of fish and wildlife resources. Fish inhabiting seagrass beds are abundant and diverse. The project description in the FIR does not address the presence or absence of SAV within the footprint of the sill. However, the application form(DCM-MP-2, Section 1 c) states that the area to be dredged does not include marsh, SAV, or other wetlands. Overall, the Service does not oppose the issuance of a DA permit for the proposed action. If SAV would not be impacted and precautions are undertaken to protect manatees, we do not believe that the proposed activity will have significant adverse and/or irreversible effects on general fish and wildlife resources under our jurisdiction.
