This permit, issued on April 28.2005 , is subject to compliance with the application(where consistent with the permit),all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action;or may cause the permit to be null and void. Upland Development 1) This permit authorizes only the land disturbing activities associated with establishment of the Stanwick Shores Subdivision, as well as the driveways, access road and utilities, all as expressly and specifically set forth in the permit application and depicted on the attached work-plat drawings. Any additional land disturbing activities and/or construction shall be evaluated on a case-by-case basis by a representative of the Division of Coastal Management (DCM) to determine additional permit requirements. Contact a representative of the Division at (910) 395-3900 prior to the commencement of any such activity for this determination. 2) All fill material shall be clean and free of any pollutants except in trace quantities. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty(20) days of the issuing Chairman of the Coastal Resources Commission. date. Signature of Permittee Paul and Susan Magnabosco Permit#60-05 Page 2 of 5 ADDITIONAL CONDITIONS Docking Facilities 3) This permit authorizes only the docks,piers,and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of these docking facilities without permit modification. No non-water dependent uses of structures may be conducted on,in or over public trust waters without permit modification. Likewise,any shift in location of,modification to, or reconfiguration of the structure shall require permit modification to insure that areas of SAVs have been avoided to the maximum extent practicable. 4) Any portion of the permitted access piers and docking facilities built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three(3) feet over the wetland substrate as measured from the bottom of the decking. 5) The authorized structure and associated activity shall not cause an unacceptable interference with navigation,and no attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work,or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard,through regulation or otherwise,on the authorized facilities. At a minimum,permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) The construction and/or operation of the authorized facilities shall not directly result in any closure of any waters that are open to the taking of shellfish. Any such closure directly attributable to the authorized facility, either now or in the future, will require that the permittee undertake remedial actions to remedy the situation. Such actions include,but are not limited to,a removal of any unauthorized slips or mitigative measures to reduce or eliminate the cause(s)of the closure. 10) It is possible that the authorized structures may be damaged by wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee shall not hold the State of North Carolina nor the United States liable for any such damage. 11) This permit authorizes a maximum of ten(10)boat slips. Any proposal to add one or more additional boat slips to the 10-slip facility would require that the docking facility be classified as a marina, and would therefore require a review under the N.C. Environmental Policy Act(NCEPA). ----------------- ------------------- Paul and Susan Magnabosco Permit#60-05 Page 3 of 5 ADDITIONAL CONDITIONS 12) This permit does not authorize any dredging or excavation. Dredging in any manner, including "kicking"with boat propellers is not authorized. 13) The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alterations,of the structure or work herein authorized,or if, in the opinion of the Secretary of the Army or his authorized representative;said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters,the permittee will be required,upon due notice from the Corps of Engineers,to remove,relocate,or alter the structural work or obstructions caused thereby, without expense to the United States or the State of north Carolina. No claim shall be made against the United States or the State of North Carolina on account of any such removal or alteration. 14) No portion of the structure shall be located within 37 feet of the near bottom edge of the federally maintained channel. An as-built survey shall be performed on the piers/docks upon completion of the project and sent to the U.S. Army Corps of Engineers, Wilmington Regulatory Field Office and the Division of Coastal Management, Wilmington office. 15) Should lot 1 or lot 2 be sold prior to the initiation of construction of the docking facilities,the permittee shall be required to contact the Division of Coastal Management to determine whether the platform sizes on each lot remain consistent with the Coastal Resource Commissions policy limiting platform size to a maximum of 4 square feet per linear foot of shoreline. NOTE: Should any adjacent property be sold prior to the initiation of construction,the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. Shoreline Stabilization 16) The alignment of the authorized bulkhead shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction 17) The bulkhead shall be located landward of all wetlands. 18) The bulkhead shall be constructed prior to any backfilling activities. 19) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 20) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap,deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 21) Alf backfill material shall be obtained from a high ground source and confined behind the permitted retaining wall. ---------------- Paul and Susan Magnabosco Permit#60-05 Page 4 of 5 ADDITIONAL CONDTIONS Sedimentation and Erosion Control 22) Appropriate sedimentation and erosion control devices, measures or structures(e.g. silt fence, diversion swales or berms, etc.)shall be implemented to ensure that eroded materials do not enter adjacent wetlands,watercourses and/or properties. 23) The activities shall be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction related discharge. Increases in turbidity of 25 NTU's or less are not considered significant. 24) In order to protect water quality,runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. NOTE: The permittee has received a Sedimentation and Erosion Control Plan for the Stanwick Shores S/D,project(LQS Permit No. Pender-2004-282). Should the permittee choose to modify/amend the existing permit, he or she should contact the Department of Environment and Natural Resources; Land Quality Section, at 127 Cardinal Drive Extension, Wilmington,NC 28405. Stormwater Manamement 25) The Division of Water Quality's approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW8040423, which was issued on 5/17/04. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. General 26) No vegetated wetlands shall be excavated or filled,even temporarily. 27) In issuing this permit,the State of North Carolina and/or the Federal Government does not assume liability for: a.) Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes. b.) Damages to the permitted project or uses thereof as a result of current or future Federal activities initiated on behalf of the general public. c.) Damages to other permitted or unpermitted activities or structures caused by the authorized activity. d.) Design and construction deficiencies associated with the permitted work. e.) PROJECT SUMMARY: The applicant is proposing the construction of a 6-lot subdivision to include the construction of a 6-slip community pier, two private piers providing dockage for 2-slips each, a bulkhead, driveways and utilities. PROJECT DESCRIPTION: The proposed Stanwick Shores Subdivision is located at the far northern end of Bridgers Ave., adjacent to Topsail Sound and Banks Channel, in the town of Topsail Beach, Pender County. To get to the proposed subdivision from Wilmington,head north on US Hwy 17. At the intersection of US Hwy 17 and NC Hwy 210, turn right onto NC Hwy 210 towards Surf City. Cross the AIWW in Surf City and turn right at the stoplight onto NC Hwy 50. Travel approximately 3.5 miles south and turn right onto Rocky Mount Lane. Once on Rocky Mount Lane,take the first right onto Bridges Ave.The property will be located at the terminal end of Bridgers Ave,on both sides of the street.The property is approximately 200'wide x 310'long(as measured from Bridgers Ave.). Existing development on the property includes an existing single-family residence.The applicant has indicated that the existing residence will be demolished and moved off site prior to the construction of the proposed development.Elevation at the tract averages from 2'to 9'above MSL. The property consists of approximately 1.58 acres and contains a small strip of maritime forest(live oaks)along the northern section of the tract. The highground portion of the tract(going from NC Hwy 50 towards the sound)has vegetation that consists of- Live Oaks(Quercus virginiana),Catbriar(Smilaxsp.),a few Red Cedars(Juniperus virginiana),Wax myrtles (Myrica cerifera)and Yaupons(Ilex vomitoria).A section of coastal marsh exists along the western shoreline (approximately 170' wide by 170' long) and consists primarily of Smooth Cordgrass Marsh (Spartina alterniflora)and Black Needle Rush(Juncus roemarianus).Upper coastal wetlands species such as Salt Grass (Distichlis spicata), interspersed with Sea Lavender(Limoium carolinanum), Salt Meadow Hay (Spartina patens)and Sea Ox-eye(Borrichia frutescens)complete the transitional area to the high ground.The coastal and"404 type"wetlands have been delineated and are indicated as a"joint"line on the survey map. The waters of the Topsail Sound and Banks Channel,adjacent to the proposed project area,are classified as "SA" by the Division of Water Quality. This section of Topsail Sound is NOT designated as a Primary Nursery Area by the Division of Marine Fisheries.According to maps provided by Shellfish Sanitation,the area is OPEN to the harvesting of shellfish. PROPOSED PROJECT:The applicant is proposing to develop a 6-lot, 1.58 acre tract for use as a residential subdivision.As proposed, development would include the installation of a driveway/access road that would begin at the entrance of the property,along Bridgers Ave.The driveway would continue straight through the center of the property and terminate between Lots 2 and 3.Individual driveways would extend towards the east and west from the main access road.The applicant has indicated that the future property/lot owners would be applying for individual CAMA Minor Permits to construct the privately owned residential structures associated with the subdivision. In addition to the upland development,the applicant is proposing to construct a bulkhead and community pier for the residents of the subdivision.The bulkhead,as proposed,would be located on the high ground portion of the property landward of the Section 404 wetlands line.The bulkhead would run parallel to the shoreline,just landward of the Section 404 wetland line, and would be approximately 178.5 feet in length. The proposed community pier(which would provide dockage for up to six vessels)would be located between Lots 1 and 2 along the deeded common area corridor. The applicant has deeded a 6' wide by 125' long walkway to the homeowners for future use of the pier and docks. The pier (6' x 194') would begin at the bulkhead and continue west towards Banks Channel. A 10'x 20'platform("T-head")would be located at the terminal end of the pier and would run from north to south.Two-2' x 12' step-down swim platforms would be located on both the northern and southern sides of the platform. Additionally, two 4'x 20' finger piers would be constructed between slips 3 and 5 and slips 4 and 6. The finger piers would be used to access four of the proposed six slips associated with the community pier. Paul and Susan Magnabosco Page Three In addition to the community pier,the applicant is proposing the construction of two private piers for the future owners of Lots I and 2.Both of the proposed private piers(referred to as"Pier 1"and"Pier 2")would provide dockage for up to two vessels,bringing the total number of slips associate with the proposed Stanwick Shores subdivision to 10.Pier 1 (6'x 212')would originate from the proposed bulkhead along Lot 1 and Pier 2(6'x 20l')would originate from the proposed bulkhead along Lot 2. A 12' x 16' "L-shaped"platform would be located at the terminal end of each pier(L-shaped platform for Pier 1 would turn towards the north and L-head for Pier 2 would run towards the south).Two 2'x 12'step-down swim platforms would be located on both the northern and southern sides of the proposed"L-head"platforms.Two additional 2'x 12'step-downs would be located just on the landward side of the proposed platform on each pier.These platforms would provide access to vessels docked at the private piers. 10. ANTICIPATED IMPACTS The construction of the proposed access road into the subdivision, driveway access, and the grading of the property for lot preparation,would result in the disturbance of approximately 58,806 sq ft(1.35 acres)of high ground. The proposed piers and docking facilities would incorporate approximately 1,064 sq ft of estuarine waters and public trust area.The area of disturbance resulting from the construction of the bulkhead would be incorporated as part of the lot preparation area. These two areas overlap, and as such,no calculations were included for bulkhead disturbance.Total impervious surface coverage within the 75'Estuarine Shoreline AEC would be 11.0%.The applicant has applied for a State Stormwater Permit with the Division of Water Quality (Permit No.SW8040423).The permit,once issued under the low-density(30%)option,would restrict the total maximum built-upon area of the subdivision to 0.263 acres per unit. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. A silt fence or berm must be installed and inspected by Division of Coastal Management personnel prior to commencing any dredging work. 2. The permitee must install and maintain, at his expense, any signal lights and signals prescribed by the US Coast Guard through regulations or otherwise,on authorized activities. 3. The alignment of the proposed bulkhead must be staked by a representative of the Division of Coastal Management(DCM)within a maximum of thirty(30)days prior to the start of construction. Failure to initiate construction within thirty(30)days, or erosion of the shoreline by adverse weather conditions will require the alignment to be re-staked by DCM within a maximum of thirty(30) days prior to the new expected start of construction. 4. All unconsolidated material resulting from associated grading shall be retained on site by effective sedimentation and erosion control measures. Prior to any land-disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas,until such time as the area has been properly stabilized with a vegetative cover 5. The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within thirty(30)working days of project completion. 6. Future development on the permittee's property may require a modification of this permit. Contact a representative of this Division at (910) 395-3900 prior to commencement of any such activity for this determination. 7. Any violation of or deviation from the Division of Water Quality's (DWQ) approval for this project under stormwater management rules of the Environmental Management Commission will be considered a violation of this CAMA permit. 8. All work authorized by this permit must be performed in strict compliance_ with the permit plans, which are a part of this permit. 2. Only the requested waters of the United States as depicted by the plans may be excavated. No wetlands may be impacted. 3. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 4. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 5. The Permittee must install and maintain, at its expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on all authorized facilities constructed within navigable waters of the United States. 6. The authorized structure and activity will not cause an unacceptable interference with navigation. 7. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 8.
