Additionally,the applicant is proposing to widen and lengthen the existing boat ramp. David Greer/Sloop Point Boat House Page Two 9. PROJECT DESCRIPTION The project site is located at the end of Lewis Road(SR 1564),adjacent to the Atlantic Intracoastal Waterway (AIWW),near Hampstead,in Pender County.To access the project site,take Hwy 17 north from Wilmington and turn right onto Sloop Point Road just past Hilltop Grocery.Follow Sloop Point Loop Road for approximately 2.6 miles and turn left onto Lewis Road.The project site is located at the far end of Lewis Road on the left hand side. The project site consists of one property,which is adjacent to the AIWW on the east side of Lewis Road. The property has approximately 148' of shoreline and is approximately 250' in depth from the road right-of way.The property has an average elevation of 8 feet above MHW and the highground area consists primarily of lawn grasses.There are however, several large Live Oaks(Quercus sp.)located on the property.There is an existing concrete boat ramp on the property as well as a boathouse,boardwalk, floating dock,bulkhead,tie-pilings and two fixed piers. There are no coastal wetlands located on, or adjacent to the property.The shoreline is stabilized by a vinyl bulkhead. The project site has a CAMA permit history dating back to 1979(LAMA Permit#30-79). There are no records on file that show development prior to that time,however, a boathouse,marine railway and bulkhead were existing prior to the time that the first permit was issued.According to DCM files,the permittee at the time,Vernon Lewis, received a CAMA Major permit for the excavation of material from the area adjacent to the property.The permittee received another CAMA Permit(#89-88)for the construction of several tie-pilings as well as the addition of a floating dock.The permits were never renewed and all maintenance work has previously been approved under CAMA/D&F General Permits.The site currently provides dockage for up to nine vessels and includes one transient dock located within the boat launch area,just east of the boat ramp. The waters of the Atlantic Intracoastal Waterway,adjacent to the proposed project area,are classified SA,by the NC Division of Water Quality. This section of the waterway is NOT designated as a Primary Nursery Area(PNA), by the NC Division of Marine Fisheries. The area is OPEN to the harvest of shellfish. The applicant is proposing to construct three, 3' x 12' finger piers along the eastern side of the existing bulkhead, and construct a 12' x 12' covered gazebo at the terminal end of the existing pier.Additionally,the applicant is proposing to expand the existing boat ramp. As proposed,the boat ramp addition would extend 20' waterward of the existing ramp(or 19' below the Mean Low Water(MLW)contour)and would be 26' in width. Two other sections of ramp(5'6"x 1 l' each)would also be installed on both sides of the existing ramp to make the ramp uniform.The two 5'6"x I sections would span from the Mean High Water(MHW)line down to the MLW line. According to the site drawings,water depth measurements in the areas surrounding the proposed finger piers average-3.7' to—5.0' MHW.Water depth measurements in the area surrounding the proposed boat ramp range from 0' (MHW)to—5.0'. According to the applicant,the Sloop Point Boat House will be used as a launching and docking facility for the residents of the Pecan Grove Subdivision. 10. ANTICIPATED IMPACTS The construction of the proposed gazebo and finger piers would incorporate approximately 252 sq. ft. of Public Trust and Estuarine Waters.The proposed boat ramp would impact approximately 740 sq. ft. of previously dredged and/or disturbed bottom. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans,which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers(USACE)prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal,relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required,upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby,without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY-RM 7316, Silver Spring,MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit,no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project,within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products,organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants,hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste,the permittee shall immediately report it to the N.C. Division of Water Quality at(919) 733-5083, Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 7. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 8. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard,through regulations or otherwise, on authorized facilities. For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at(910) 772-2191. 9. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work,he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 10. Approval of the structure was based on determinations that there would be no obstruction to navigation. Issuance of this permit should not be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash. 11. The permittee shall advise the Corps in writing at least two weeks prior to beginning 2 the work authorized by this permit and again upon completion of the work authorized by this permit. 12. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 13. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include,but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally,the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 15. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management(NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 16. The permittee,upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will,without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct,restore the water or wetland to its pre-proj ect condition. 17. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. 18. The West Indian manatee(Trichechus manatus),which is listed as a federally endangered species,has been reported in the waters in Brunswick County. In order to protect the West Indian manatee all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina"must be followed. 19. The Permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The Permittee is not relieved of this 3 requirement if he abandons the permitted activity without having it transferred to a third party. 20. The concrete boat ramp should be constructed on high ground and completely cured before final placement in waters at the site. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project,within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants,hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste,the permittee shall immediately report it to the N.C. Division of Water Quality at(919) 733-5083, Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 7. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 8. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard,through regulations or otherwise, on authorized facilities. For further information,the permittee should contact the U.S. Coast Guard Marine Safety Office at(910) 772-2191. 9. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work,he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 10. Approval of the structure was based on determinations that there would be no obstruction to navigation. Issuance of this permit should not be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash. 11. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 12. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 13. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 15. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 16. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre-project condition. 17. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. 18. The West Indian manatee (Trichechus manatus), which is listed as a federally endangered species, has been reported in the waters in Brunswick County. In order to protect the West Indian manatee all work should be done during the period from November 1 to May 31. If work must be done during the period from June through October the enclosed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina"must be followed. 19. The Permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The Permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 20. The concrete boat ramp should be constructed on high ground and completely cured before final placement in waters at the site. During initial review of the application, the Division of Environmental Health, Shellfish Sanitation Section,responded with comments to the Division of Coastal Management, concerning the proposed development at the subject property. The comments indicated that the proposed project would not directly cause a shellfish closure,however,the area would have to be closed due to cumulative impacts from-both the subject property and neighboring properties. Additionally, it was noted in the field investigation report,prepared by the Division of Coastal Management,that there are currently nine boat slips associated with the existing docking system on the property.However,after review of the initial permit, and in conversation with Patty Fowler, it was determined that six boat slips were originally permitted. Presently, the site contains dockage for up to seven vessels. The applicant has agreed to remove the existing tie-pilings that make up the seventh slip within the docking system.Additionally,the applicant has provided a copy of the revised site drawing(attached)that illustrates the location of the six boat slips. The drawing shows the elimination of the two outer tie-pilings to the south of the site, or adjacent to Mr. Seabolt's property. Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated January 13, 2005. The applicant, David Greer,has applied for a Department of the Army (DA)permit to renovate two existing dock structures to create a 20-slip marina adjacent to the Atlantic Intracoastal Waterway (AIWW). Our comments are submitted in accordance with the Fish and Wildlife Coordination Act(FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review(33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional comments are provided regarding the District Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act(ESA) of 1973, as amended(16 U.S.C. 1531-1543). By letter dated November 5, 2004, the Service provided comments to the North Carolina Intergovernmental Review Clearinghouse (NCIRC) on an Environmental Assessment(EA), dated July 2004, for the proposed work. You were provided a copy of these comments. The PN contains the Field Investigation Report (FIR), dated December 28, 2004, of the North Carolina Division of Coastal Management(NCDCM). The FIR and the EA state that the applicant proposes to renovate two, existing docks at Sloop Point Plantation. Both docks currently extend into the AIWW and are designated as Dock A and Dock B. The verbal descriptions of these docks do not appear to correspond to the designations given on project maps. For the purposes of these comments, the existing 119-foot Dock A is the northernmost structure and the existing 92-foot Dock B is the southernmost. These designations are consistent with project maps. Dock A would be extended waterward with a fixed dock and five walkways to create 10 boat slips. There would also be a landward extension of Dock A, but it appears that this construction would be along the edge of Wetland Area 1. It appears that no wetlands would be impacted by renovation of Dock A. 2 Dock B would be extended waterward in an identical manner to create 10 boat slips. This dock would be extended landward by constructing a boardwalk approximately 75 feet long by six feet wide across Wetland Area 6. Landward of the boardwalk, a walkway would be constructed on uplands to join a road within the development. No new dredging would be required for the renovations. However, the construction techniques to be used for the renovations are not given. The EA states that the boardwalk would cover approximately 450 square feet(ft) of vegetated wetlands under NCDCM jurisdiction. Based on project drawings and the EA, part of this area appears to be coastal fringe wetlands vegetated primarily with black needlerush (Juncus roemerianus). The EA notes that the boardwalk would be a minimum of three feet above the"ground surface." Sheet 6 of 6 of the EA indicates that the deck would be seven feet above the low water line. The FIR states that 3,152 ft2 of non- vegetated open water would be incorporated by the two docking facilities. As part of our review for the NCIRC the Service considered the federally threatened or endangered species under our jurisdiction. The listed species known to occur in Pender County can be found on our web site at<http://nc-es.fws.gov/es/entylist/pender.html>. Information for a more limited area around the project site is available from the North Carolina Natural Heritage Program(NCNHP)database. This database contains occurrence records for both state and federally protected species within each U. S. Geological Survey quadrangle (quad). The occurrence data of special status species within this quad can be obtained on the internet at< http://ncnhp.org/Pages/heritagedata.html>. The project is located within the Holly Ridge quad. The Carolina diamondback terrapin (Malaclemys terrapin centrata) is listed as a current record for the Holly Ridge quad and may occur in or near the project area. The species has a state status of Special Concern and is found in salt marshes and tidal channels. Our review indicates that the only federally listed species likely to occur in the project area is the West Indian manatee (Trichechus manatus), a federally-endangered mammal. Manatee occurrences are rare in North Carolina,but the species is known to occur in Pender County. However, it has not been reported within the Holly Ridge quad. The shallow, estuarine waters of the project area may provide suitable habitat for manatees that move along the Atlantic Coast during summer months and are seasonal transients in North Carolina, primarily from June through October. Manatees may travel in water as shallow as one to two meters (3.3 -6.6 feet) deep. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular construction site. The EA states (p. 9) that the AIWW provides potential habitat for the manatee. The EA notes (p. 9)that project construction and operation is not expected to have a detrimental effect on the manatee. However, the basis for this conclusion was not given. Our letter of November encouraged the applicant to provide the Corps with sufficient information to make a determination of project impacts on the manatee. Information useful in making this 3 determination would include water depths where construction would occur and the equipment which will be used. Pier construction which requires either jetting and/or pile driving for timber placement can create a risk to manatees. The FIR indicates (Sheet 6 of 6)that the area for dock construction has sufficient depth to be used by manatees. Protection of the species would be enhanced during in-water construction activities by implementing the AGuidelines for Avoiding Impacts to the West Indian Manatee - Precautionary Measures for Construction Activities in North Carolina Waters.@ These guidelines are available on our web site at< http:Hne-es.fws.gov/mammal/manatee guidelines pdfl. The guidelines are intended mainly to ensure that construction personnel are informed that manatees may occur in the work area, that work should cease if a manatee approaches the work area, work should not resume until the manatee leaves the work area, and procedures for reporting the death or injury of a manatee. Protection of the manatee would further enhanced by scheduling construction from November 1 through May 31, a period when the species is least likely to be in North Carolina waters. The EA stated(p. 9) that the applicant"may wish to educate the final users of the docks about the possibility of encountering manatees during the warm summer months," and"signage may provide a means to educate the dock's users." The Service strongly supports such measures to protect this endangered species while it is North Carolina. The presence of this rare and unique species can enhance the enjoyment of coastal living and all efforts to reduce harm to the species will benefit all coastal residents. Service comments to the NCIRC expressed concern that structures built too low over coastal marsh could harm vegetation by blocking sunlight. The EA recognized (p. 7)that structures over wetlands can produce"detrimental shading effects." The Service recommended that the lowest part of any structure build over vegetated wetlands should be least four feet above the substrate. A minimum elevation of four feet is a special condition of the Corps' Regional General Permit#197800056. The NCDCM has recommended(Condition No. 6)that any portion of the pier or dock built over coastal wetlands must not exceed six feet in width and must be elevated a minimum of three feet over the wetland substrate. The Service continues to believe that the natural functioning of the important coastal marsh would be enhanced by elevating any covering structure at least four feet above the substrate. The Service seeks to minimize any adverse impact to submerged aquatic vegetation(SAV). The EA noted(p. 7)that no oyster beds or"other unique habitat" would be impacted by dock coverage over open water. The bottom within this area is described as consisting"primarily of sand with scattered shell debris and other organic matter." The EA did not mention any other habitat types and fails to specifically state that SAV is not present. Service recommended that the permit application contain a statement regarding the presence or absence of SAV both within and immediately adjacent to the construction areas. The current PN does provide additional information regarding the presence of SAV at or near the pier and docking facilities. 4 Overall, the Service does not oppose issuance of a DA permit for the work described in the FIR. If SAV would not be directly or indirectly impacted and coastal marsh under the proposed piers receives adequate sunlight, the work is not likely to produce irreversible or significant adverse impacts on fish and wildlife resources under our jurisdiction. With the inclusion of our manatee guidelines as a permit condition, the Service would concur with a determination by the District Engineer that the action is not likely to adversely affect species designated as threatened, endangered, or their designated critical habitat. However, the requirement of section 7 would need to be reconsidered if (1)new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2)this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action.
