This permit, issued on July 15. 2005 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) The permittee shall maintain the authorized work in good condition and in conformance with the
terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons
the permitted activity without having it transferred to a third party.
2) The permittee is reminded of condition No. 15 of CAMA Permit No. 43-95, which authorized
construction of the existing 10-slip docking facility. This condition, which shall be enforced
throughout the entire existence of the permitted structure(s), reads as follows; "Deed restrictions shall
be placed on owners of all unsold lots on Chadwick Bay, specifically lots 8, 9, 13, 14, 15, 16, and 17
that prohibits them from construction out into Chadwick Bay. The owner of lot 46 shall also have
deed restrictions prohibiting construction waterward of MHW since it will be entitled to a boat slip
within the community pier and dock".

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the

3) TZ permit does not authorize an increase in the number of slips at the previously authorized 10-slip
docking facility.
NOTE: Any proposal to add one or more additional boat slips to the authorized 10-slip facility will
require that the docking facility be classified as a marina, and will therefore require a review
under the N.C. Environmental Policy Act(NCEPA).
4) This permit authorizes only the floating dock, finger piers, and associated pilings necessary for the u:
docking facility located in or over the water that are expressly and specifically set forth in the permit w{
application. No other structure, whether floating or stationary, shall become a permanent part of this w
docking facility without permit modification. No non-water dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.
5) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
8) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
x Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
10 The authorized covered� ) gazebo shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
11) The roof of the covered gazebo shall not be designed for second story use.
12) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resource Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers,
is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.

13) No portion of any structure shall be located within 80 feet of the near bottom edge of the federally
maintained channel. An as-built survey shall be performed on the docking facilities, and copies of the
survey provided to the U.S. Army Corps of Engineers and Division of Coastal Management, within 60
days of completion of construction of these portions of the project.
General
14) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of-the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
15) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily.

16) The construction and/or operation of the authorized facilities shall not directly result in any closure of
any waters that are open to the taking of shellfish. Any such closure directly attributable to the marina
facility will require that the permitee undertake remedial actions to remedy the situation. Such actions
may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce
or eliminate the cause(s) of the closure.
17) The West Indian Manatee (Trichechus manatus), which is listed as a federally endangered species, has
been reported in the waters in Pender County. In order to protect the West Indian manatee all work
should be done during the period from November 1 through May 31. If work must be done during the
period from June through October the enclosed guidelines, entitled "Precautions for General
Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" must be
followed.
NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day
operation of the facility to prevent facility waste from entering the adjacent waters. Such
discharge, either directly or indirectly, to adjacent waters could contravene state water quality
standards, thereby violating state law.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.

9. PROJECT DESCRIPTION:
The project site is located at 138 & 140 Big Hammock Point Rd, adjacent to the AIWW, near Stump Sound, in
Sneads Ferry, Onslow County. The property is bordered on the east side by the AIWW. According to the permit
application the lots are 76' x 358' and 76' x 331' respectively or approximately 52,360sf.2. The only
development at the project site is an existing 10 slip docking facility with a 6' x 374' access walk over coastal
marsh. These lots are mostly coastal wetlands. Coastal wetland species present on this site in the upper marsh
are giant cordgrass (Spartina cynocoroides), cattail (Typha, spp.),black needlerush(Juncus roemarianus), sea
lavender(Limonium, spp.), spike grass (Distichlis spicata), salt meadow grass (Spartina patens), salt marsh
cordgrass (Spartina alterniflora) and glasswort(Salicornia spp). There are some high ground hummocks in this
are that contain some wax myrtles and red cedars.The normal high water(NHW) at this site is located
approximately 60' landward of the existing docking facility. There is an eight-foot boarder of salt marsh
cordgrass (Spartina alterniflora) low marsh fringe at the waters edge. CAMA Major Permit#43-95 was issued
to Scarfoni Associates Inc. on April 24, 1995 for Pelican Point Subdivision and construction of the community
dock with the following deed restrictions; "Deed restrictions shall be placed on the owners of all unsold lots on
Chadwick Bay, specifically lots 8, 9, 13, 14, 15, 16, and 17 that prohibits them from construction out into
Chadwick Bay. The owner of lot 46 shall also have deed restrictions prohibiting construction waterward of
MHW since it will be entitled to a boat slip within the community pier and dock."A CAMA General Permit
was issued on December 8, 1998 to reconfigure the docking facility. The existing facility has a 6' x 374' pier, of
which approximately 60' is waterward of Normal High Water(NHW). There is a 6' x 150' T-head with six 3' x
24' and one 2' x 24' finger piers. There are currently five boatlifts in the existing slips. The existing docking
facility crosses the riparian corridor on the northern side of the project site. The applicant has written permission
for the property owner to the north to encroach onto his riparian corridor.
The Onslow County Land Use Plan classifies the upland areas of this project as other. The waters of the project
site are classified as SA by the NC Division of Water Quality. The NC Division of Marine Fisheries has
designated this area of Stump Sound as a Primary Nursery Area, and the waters adjacent to the proposed
project are open to the harvesting of shellfish.
PROPOSED PROJECT:
The applicant proposes to expand the existing docking facility 6' waterward, install 17 bumper pilings, install
five new boat lifts and enlarge one, and install a 14' x 14' Gazebo. The waterward expansion includes extending
the existing finger piers 6' waterward and the installation of four new 3' x 30' finger piers. The applicant also
proposes to install 17 bumpers pilings at the end of the finger piers. The water depth at the end of the dock
ranges from—3.3' @ MLW on the north side and-5.2'@ MLW on the south side,the water depths were
measured at low tide. The proposed location of the gazebo would be on the southern portion of the T-head. The
waterward edge of the proposed structure would be setback a minimum of 88' from the near bottom edge of the
Federal channel. The total docking facility is a total of 2,086 ft.2.
10. ANTICIPATED IMPACTS
The proposed dock expansion would result in the incorporation of an additional 466 ft.2 of Public Trust Area
and Estuarine Waters. The existing facility currently occupies 1620 ft.2 for a total incorporation of 2,086 ft.2 of
Public Trust Area and Estuarine Waters.

Recommendations for State Permit— Pelican Point Dock Owners Association,Inc.
The proposed additions exceed the 4 ft.Z per one linear foot of shoreline for the proposed project site. However,
there are deed restrictions imposed on the lots that are allotted slips that prohibits any piers or docks. The total
shoreline length for all the lots with the deed restrictions is 909'. This would allow for 3,636 ft.2 of docking area
and the applicant is proposing 2,086ft.2.
In the event this permit is approved,this office would recommend that permit for the proposed development
should include the following conditions:
1. The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
project without having the permit transferred to a third-parry.
= 2. This permit authorizes only the floating dock, finger piers and associated pilings necessary for the
docking facility located in or over the waters that are expressly and specifically set forth in the permit
application. No other structures, whether floating or stationary,may become a permanent part of the
structure without a permit modification. No non-water dependent uses of structures may be conducted
on, in or over public trust waters without a permit modification.
3. The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of
the structure and the adjacent property owners riparian access corridor, which is determined by drawing
a line parallel to the channel,then drawing a line perpendicular to the channel line that intersects with
the shore at the point where the upland property line meets the water's edge. This requirement shall be
void provided that a written waiver of the 15 feet setback is obtained from the affected adjacent riparian
property owner.
4. In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
5. The permiee must install and maintain, at his expense, any signal lights and signals prescribed by the US
Coast Guard through regulations or otherwise,on authorized activities.
6. Future development on the permittee's property may require a modification of this permit. Contact a
representative of this Division at(910) 395-3900 prior to commencement of any such activity for this
determination.
. 7. The construction of the proposed project shall be in compliance with all local, State and Federal
regulations and associated permit conditions.
8. The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
9. No excavation of shallow water bottom or any wetlands is authorized by this permit.
10. This permit authorizes a maximum of ten(10)boat slips. At no time shall more than 10 vessels be
moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel
types, including but not limited to motorboats, sailing vessels and personal watercraft.

install a 14' x 14' Gazebo at 138 &140 Big Hammock Point Road, adjacent to the Atlantic
Intracoastal Waterway,near Stumps Sound, Sneads Ferry, Onslow County,North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans,which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE)prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters,the
permittee will be required,upon due notice from the U.S. Army Corps of Engineers,to remove,
relocate, or alter the structural work or obstructions caused thereby,without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY-RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.

3. Except as specified in the plans attached to this permit,no excavation, fill or
mechanized land-clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit,no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project,within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants,hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste,the
permittee shall immediately report it to the N.C. Division of Water Quality at(919) 733-5083,
Ext. 526 or(800)662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
6. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
7. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard,through regulations or otherwise, on authorized facilities.
For further information,the permittee should contact the U.S. Coast Guard Marine Safety Office
at(910) 772-2191.
8. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
9. The Permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The Permittee is not relieved of this requirement if
he abandons the permitted activity without having it transferred to a third party.
10. Approval of the structure was based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.

11. The permittee shall advise the Corps in writing at least two weeks prior to beginning
the work authorized by this permit and again upon completion of the work authorized by this
permit.
12. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
13. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include,but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally,the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
14. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management(NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
15. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will,without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre-project condition.
16. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

17. The West Indian manatee (Trichechus manatus), which is listed as a federally
endangered species, has been reported in the waters in Brunswick County. In order to protect the
West Indian manatee all work should be done during the period from November 1 to May 31. If
work must be done during the period from June through October the enclosed guidelines, entitled
"Precautions for General Construction in Areas Which May Be Used by the West Indian
Manatee in North Carolina"must be followed.
18. No portion of any structure will be located within 80 feet of the near bottom edge
federally maintained channel. An as-built survey will be performed on the pier/docks upon
completion of the project and sent to the Wilmington Regulatory Field Office.

I have reviewed the proposals for consistency with the Onslow County Land Use Plan
and offer the following comments.
In general, Onslow County allows development in Conservation classified AECs which is
consistent with the State's minimum use standards. The Onslow County Land Use Plan
contains some policies which exceed the State's minimum use standards. However, none
of these policies appear to be applicable to these projects.
Provided all local,state and federal requirements can be met,this project appears to
be consistent with the Onslow County Land Use Plan Update.

install a 14' x 14' Gazebo at 138 &140 Big Hammock Point Road, adjacent to the Atlantic
Intracoastal Waterway, near Stumps Sound, Sneads Ferry, Onslow County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE)prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal,relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY-RM 7316, Silver Spring,MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit,no excavation, fill or

mechanized land-clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at [phone],
Ext. 526 or [phone] and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
6. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
7. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at [phone].
8. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work,he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
9. The Permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The Permittee is not relieved of this requirement if
he abandons the permitted activity without having it transferred to a third party.
10. Approval of the structure was based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.
11. The permittee shall advise the Corps in writing at least two weeks prior to beginning
the work authorized by this permit and again upon completion of the work authorized by this

permit.
12. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
13. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
14. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
15. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre-project condition.
16. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

17. The West Indian manatee (Trichechus manatus), which is listed as a federally
endangered species, has been reported in the waters in Brunswick County. In order to protect the
West Indian manatee all work should be done during the period from November 1 to May 31. If
work must be done during the period from June through October the enclosed guidelines, entitled
"Precautions for General Construction in Areas Which May Be Used by the West Indian
Manatee in North Carolina"must be followed.
18. No portion of any structure will be located within 80 feet of the near bottom edge
federally maintained channel. An as-built survey will be performed on the pier/docks upon
completion of the project and sent to the Wilmington Regulatory Field Office.

The Wilmington Regional Office of the Division of Water Quality received a copy of the CAMA Major
Permit Application for Pelican Point Dock Expansion project on May 3, 2005. Staff review of the plans
and specifications has determined that the development activities proposed at this time will not pose a
threat to surface water quality from stormwater runoff. The Director has determined that projects that
are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff
should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000.
By copy of this letter, we are informing you that your project will not require a stormwater management
permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff,
then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater
discharge requirements. You are required to have an NPDES permit for stormwater discharge from
projects meeting these criteria. The stormwater rules require the Division to permit the common plan of
development, therefore, any future development on the property, regardless of whether a CAMA Major
permit is also required, will require a Stormwater Management Permit application and permit issuance
from the Division of Water Quality prior to any construction.

On December 2,2004,we received your CAMA Major Permit Application for authorization to lengthen existing finger piers
and install new finger piers to access boat lifts,to install a 14' x 14'gazebo and to install six new boat lifts and relocate one boat lift,
located at 138& 140 Big Hammock Point Rd,adjacent to Stump Sound and the AIWW,in Sneads Ferry,in Onslow County.However,
your application lacks information necessary for complete processing.The attached checklist indicates the deficiencies of your
application. If you respond within three working days from the date of this fax or E-mail,or within five days from the receipt of this
letter with the required additional information,processing of your application will promptly continue and will not be placed on hold.
If you are not able to respond within three or five days,your application will not be accepted as complete for processing. Additional
information may be required pending further review by the fifteen(15)review agencies.
After further review,the existing dock permitted in 1995 under permit#43-95 with approximately 1,200 sq.ft.of decking in
the dock system does not meet the current regulations.The current requirements approved August 1, 1998 only permit 4 sq.ft.per
linear foot of shoreline,616 sq.ft. in this case.The proposed additions to the finger piers would not meet the current regulations and
would receive an unfavorable review from the Division of Coastal Management.In addition,the information provided on the
application is inconsistent with the information shown on figure one of the application package.Please make the necessary changes so
the requests on the application are consistent with the submitted plans.

boatlifts in the existing slips, install 17 bumper pilings and install a 14' x 14' Gazebo, at 138 &
140 Big Hammock Point Road, adjacent to the AIWW, near Stump Sound, in Sneads Ferry,
Onslow County.
A copy of the entire application may be examined or copied at the office of Jon Giles at
N.C. Environment and Natural Resources, Division of Coastal Management, 127 Cardinal Drive
Extension, Wilmington, North Carolina 28405, (910-395-3900) during normal business hours.
Comments mailed to Charles S. Jones, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to May 26, 2005, will be considered

The Division of Coastal Management hereby acknowledges that on April 12,2005,we received your
completed application for State approval for the development of property located at 138& 140 Big Hammock
Point Rd,adjacent to the AIWW, near Stump Sound, in Sneads Ferry, Onslow County. The projected deadline for
making a decision on your permit application is June 26,2005.An additional 75-day review period is provided by
law when such time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above,you should consider the review period extended. Under those circumstances,this,
letter will serve as your notice of an extended review. However,an additional letter will be provided on or about
the 75th day.
If this agency does not render a permit decision within 70 days from April 12,2005,you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and shall
include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b)requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a"Notice of Permit Filing" postcard which must be posted at the property of
your proposed development. You should post this notice at a conspicuous point along your property where it can
be observed from a public road. Some examples would be:Nailing the notice card to a telephone pole or tree along
the road right-of-way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal
review agencies for their comments. If additional information is required based on this review,the agencies may
contact you directly.

WITNESSETH:
That the GRANTOR, for a valuable consideration paid by the GRANTEE, the receipt of
which is hereby acknowledged,has and by these presents does grant, bargain, sell and convey unto
the GRANTEE in fee simple, all that certain lot, tract or parcel of land situated in Onslow County,
North Carolina and more particularly described as follows:
Being all of Lots 47 and 48, Pelican Point Subdivision as
shown and described on that map recorded in Map Book 30,page
23, Slide G-211, Onslow County Registry, together with the
walkway and pier located thereon saving and excepting and
reserving unto Grantor however, Boatslips Nos. 1 through 10 as
shown on that survey by Brent A. Lanier entitled "Pelican Point
Dock Owners'Association,Lots 47&48,Pelican Point"of record
as Exhibit A on that Declaration of Protective Covenants of
Pelican Point Dock of record in Book ,Page , Onslow
County Registry.

In addition to those Protective Covenants �iql&§T&6MANAGEMENT
Book 1145, Page 445, Onslow County Registry and those of
record in Book ,Page ,Onslow County Registry,Lots
47 and 48 are subject to the specific covenant that said lots may
not be used for parking by automobiles, trucks, other motor
vehicles, or other self-propelled vehicles,whether or not they are
licensed to be operated on the highways of the State of North
Carolina and that said vehicles may remain on the above
referenced lots for a period of time not to exceed fifteen (15)
minutes while unloading or loading equipment and other items
that would be used in conjunction with a boat moored at the dock
adjacent to the above referenced lots. Vehicles left in excess of
fifteen(15) minutes may be towed at the vehicle owner's expense
and there shall be no recourse by the owner against any party or
parties that cause said vehicle to be towed. Any deletion of this
Protective Covenant or modification or amendment thereto shall
be required to be in writing and must be consented to and signed
by the then owners of Lots Nos. 3, 5, and 46 of Pelican Point
Subdivision.
TO HAVE AND TO HOLD the aforesaid lot, tract or parcel of land and all privileges and
appurtenances thereto belonging to the GRANTEE in fee simple.
And the GRANTOR covenants with the GRANTEE, that GRANTOR is seized of the
premises in fee simple, has the right to convey the same in fee simple, that title is marketable and
free and clear of all encumbrances,and that GRANTOR will warrant and defend the title against the
