Dune Rehabilitation Activities 1) Prior to the initiation of any dune rehabilitation activities on any individual lot, easements or similar legal instruments shall be obtained from all affected property.owners. 2) All dune rehabilitation activities shall be carried out on the west side of the existing dune crest.' 3) Only beach quality sand shall be used for dune rehabilitation purposes. Prior approval from the Division of Coastal Management shall be required for any material that is to be brought in from off site borrow areas. Any request to carry out additional activities within an area where dune rehabilitation activities have been completed will require a modification of this permit. 5) All material must have a minimum sand content of 90%. 6) All dune rehabilitation material shall be clean and free of pollutants and highly erodible finer material, except in trace quantities. 7) All dunes created by the authorized project shall be stabilized with appropriate vegetation as soon as possible after project completion. 8) Should the work result in any damage to existing beach access areas, the accesses must be restored to pre-project conditions immediately upon project completion in that specific area. 9) All disturbed dune areas must be restored and revegetated immediately following project completion in that specific area. 10) All work shall be accomplished in such a manner that damage to existing vegetation is minimized. 11) Should the permittee wish to carry out work waterward of the crest of dune, a modification to this permit shall be required prior to undertaking any such activity. Sand Fence Installation 12) Sand fencing shall not impede existing public access to the beach, recreational use of the beach, or emergency access. Sand fencing shall not be installed in a manner that impedes or restricts established common law and statutory public access and use of public trust lands and waters. 13) Sand fencing shall not be installed in a manner that impedes, traps or otherwise endangers sea turtles, or sea turtle hatchlings. 14) Non-functioning, damaged, or unsecured sand fencing shall be immediately removed by permittee. 15) Sand fencing shall not be placed on the wet sand beach area. General 16) No vegetated wetlands may be excavated or filled. 17) This permit does not authorize any permanent or long-term interference with the public's right of access and/or usage of all State lands and waters. NOTE: The permittee should make every effort possible to minimize any negative impacts of trucks and construction equipment on roadway and pedestrian traffic. The permittee should also ensure that the ability of individuals to access and enjoy the beach is not impeded outside of the construction limits. PROJECT SUMMARY: This project involves the rehabilitation construction of 3.5-miles of oceanfront dune located in the Pine Island Subdivision in Currituck County. Work will include filling and grading of eroded or damaged west side dune areas, as well as the installation of sand fencing and dune planting along the entire 3.5-mile dune alignment. Pine Island Property Owners Association Pine Island Dune Restoration and Maintenance, Currituck County FIELD INVESTIGATION REPORT Page 2 Project Setting The Pine Island Subdivision is located along the oceanfront of the Atlantic Ocean east of NC 12 in Currituck County. The subdivision is the first development north of the Dare County-Currituck County line and is divided into two areas. The first is located directly north of the Dare County- Currituck County line. This section is separated from the second area to the north by three properties that are owned by the Audubon Society, Hampton Inn, and Turnpike Properties, Inc. The second area extends north to the Currituck Shooting Club and the Spindrift Subdivision. The 247-lot subdivision includes 146-oceanfront lots and a majority of the subdivision lots are developed with large single-family residences and well-manicured, landscaped yards. Most of the oceanfront lots have been developed. Properties are accessible from paved streets that connect to NC 12. Many of the residences also include swimming pools between the residence and the dune system and have private dune crossover, beach access walkways. Several community beach access crossovers are also located along the oceanfront. A common area associated with the subdivision is located between mean high water (MHW) and the rear property line of the existing subdivision lots, and extends the entire length of the subdivision shoreline (minus that area between the two sections described above). The subdivision ranges in elevation from 6 to over 12 feet above the MHW. A frontal dune system extends from north to south along the oceanfront and is vegetated in predominately Uniola paniculata,Ammophila breviligulata, Cakile edentula, Spartina patens and Myrica cerifera. These dunes were initially constructed several decades ago and range in height between 8 and 12 feet above the beach. The dune base width ranges between approximately 20 and 38 feet. The North Carolina Environmental Management Commission has designated the waters of the Atlantic Ocean as `SB' waters (suitable for swimming) and these waters are closed to the harvesting of shellfish. The Coastal Resources Commission (CRC) has also designated these waters as Public Trust Area and Estuarine Water Areas of Environmental Concern (AEC). In addition, under the designation of the CRC, the land areas 145 feet west of the shoreline have been designated as part of the Ocean Hazard AEC. Project Description This project involves the rehabilitation construction of 3.5-miles of the existing oceanfront dune. Work will include filling, grading, and re-shaping of eroded or damaged west side dune areas, as well as the installation of sand fencing and dune planting along the entire 3.5-mile dune alignment. The additional sand will be hauled in from an upland source, and it is the project goal to provide a minimum dune crest width of 20 feet. Pine Island is a residential subdivision of 274 lots of which 146 are oceanfront properties. The primary dune line, which according to our research was constructed during the 1930's, has been subject or natural erosion forces and up to the present time there has been little or no effort made to maintain or protect the dune structure. This dune structure is the primary defense against wind driven storm tides and provides the protection for the residences, the roads and the public utilities. The purpose of the project is to add sand to the badly eroded areas of the dune to provide a minimum of 20 feet of dune width at the crest of the dune. This work is proposed to be done 4 a , on the west side of the existing dune crest. The east side of the entire 3.5 miles of dune will have sand fencing placed in accordance with the enclosed detail. The sand fence will accrete sand on the east face of the dune to add to the work being done on the west side of the crest. After the placement and grading of the sand on the west face of the dune the disturbed areas will be re-vegetated with beach grass and sea oats to stabilize these areas against erosion. All of the work to be undertaken will be accomplished by access from the west side of the properties so as not to disturb the beach or the fragile east side of the dune. From specifically selected access points at vacant lots or between existing houses with minimal landscaping, sand will be transported by front end loader out to the west side of the dune crest. The sand will then be spread along the existing dune line to the north approximately 400 feet from the access point and then to the south approximately 400 feet. By working the project in this manner from numerous access points only the portion of the dune to receive additional sand and the access points will be disturbed which will minimize damage to the habitat and vegetation. After the sand has been placed and once the seasonal climate conditions are right for planting, the disturbed areas will be re-vegetated with beach grass and sea oats. The overall objective of this project is to not only repair the current damaged and deficient portions of the dune line but to establish a long term maintenance program to address storm erosion damage and insure the health and integrity of the dune structure. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff since no significant new impervious area is proposed. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. DATE: January 11, 2005 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 1990 Land Use Plan (LUP) certified by the CRC at their July 25, 1991 meeting. Overview: Pine Island Subdivision is located along the oceanfront of the Atlantic Ocean east of NC 12 in Currituck County, just north of the Dare County-Currituck County line. The 247-lot subdivision includes 146 oceanfront lots. Most of the oceanfront lots have been developed. A common area associated with the subdivision is located between the mean high water (MHW) line and the rear property lines of oceanfront lots. A vegetated frontal dune system constructed in the 1930's extends from north to south along the oceanfront and is located within the common area. The dunes range in height between 8 and 12 feet above the beach. The dune base width ranges between approximately 20 and 38 feet. There has been little to no maintenance of the dune structure. The west side of the dune system is eroded and damaged in areas. Private dune crossovers/beach access walkways and several community beach access crossovers are located along the dune system. Rehabilitation of 3.5 miles of the existing oceanfront dune is proposed with the goal of providing a minimum dune crest of 20 feet. Work will include filling, grading, and re-shaping of eroded or damaged west side dune areas, as well as the installation of sand fencing and dune planting along the entire 3.5 mile dune alignment. Additional sand will be hauled in from an upland source. All work will be undertaken-on the west side of the dune and will be accomplished from access points between existing homes in order to minimize disturbance to the existing dune and vegetation. After the sand has been placed and seasonal climate conditions are right for planting, the disturbed areas will be re-vegetated with beach grass and sea oats. The waters of the Atlantic Ocean are classified as SB (suitable for swimming) and are closed to shellfish harvesting. No sand is to be removed from the lot(s). • No development shall involve the significant relocation or removal of primary or frontal dune sand or vegetation thereon. Adding to dunes shall be accomplished in such a manner that the damage to existing vegetation is minimized. The filled areas will be immediately stabilized vegetatively. • No bulldozing shall occur between the time period of May 01 through November 15 of any year without prior approval of the Division of Coastal Management in coordination with the Wildlife Resources Commission, the U.S. Army Corps of Engineers(USACOE), and the U.S. Fish and Wildlife Service. • Sand fencing shall not impede existing public access to the beach, recreational use of the beach, or emergency vehicle access. Sand fencing shall not be installed in a manner that impedes or restricts established common law and statutory rights of public access and use of public trust lands and waters. • Sand fencing shall not be installed in a manner that impedes, traps or otherwise endangers sea turtles, sea turtle nests or sea turtle hatchlings. CAMA permit applications for sand fencing shall be subject to review by the Wildlife Resources Commission and the U.S. Fish and Wildlife Service in order to determine whether or not the proposed design or installation will have an adverse impact on sea turtles or other threatened or endangered species. The Association is a non-profit corporation organized pursuant to Chapter 55A of the General Statutes of North Carolina. As a non-profit corporation,the Association has broad authority and power including the ability to own property, make contracts and to "do all things necessary or convenient, not inconsistent with law,to further the activities and affairs of the corporation." [See N.C. Gen. Stat. §55A-3-02]. As stated in the preamble to the Association's Declaration of Covenants, Conditions and Restrictions, the Association is the owner of common property within Pine Island Subdivision including streets, roads, footways, open spaces, recreation facilities and areas as well as other common areas. To the extent that the Association seeks to protect the value and integrity of Association property,and the property of its members located adjacent to or within the Association's property, the Association is entitled to apply for and receive a CAMA general permit. In addition to the Association's general statutory authority to apply for and receive the general permit,the Association membership has voted to amend the Association's Declaration of Covenants to authorize use of special assessments on property within Pine Island Subdivision for the restoration, monitoring, and maintenance of oceanfront primary dunes and beach. Recitals The Recitals set forth above are incorporated herein by reference. 2. Ccrostruction The Association agrees to construct on the Property a dune having substantially the characteristics of the Specifications for the dune (the "Dune"). The Association will complete the construction in a good and workmanlike fashion. The Association will use good faith efforts to constnuct the dune on or before , but shall not be under an obligation to dry so. Factors such as, but not limited to, securing; consent from all affected property owners in order to make efficient and economic use of its contractor, the contractor's workload, the availability of materials and storms occurring prior to or during the construction and other weather conditions may affect the tittle of completion (the "Completion Factors"). 3, Ini.tal Stabilization Plantings to secure initial stabilization of the dune, as constructed, shall be the responsibility of the Association, and shall be. included as part of its construction activities. Such stabilization efforts shall be limited to proper grading and planting in accordance with the Specifications (Fh:xhibit A) (the construction of the Dune and its initial stabilization are collectively the "Construction"). 4. Maintenance and.Repair Following Constniction, the Association shall not have the duty to maintain and repair tiie Dune. The Association may, but shall not be obligated to make re.cotntnendat.ions to the Owner and niake.repairs to the tune, as circumstances warrant. 5. Unforrseen Events The dune construction program contemplated by this Agreement may be affected by unforeseen conditions such as, but not limited to the Completion Factors. In such event, the Association agrees to undertake reasonable efforts under the circuttustanccs to complete tile, Construction, but shall not be obligated to do so. if the completion of Construction would substantially increase the contract amount or would, in the reasonable opinion of the Association, as evidenced by a vote of its Board of Directors, be unable to fulfill the original purpose and intent of the resolution and this Agreement, then the Association shall notify the Owner that this Agreement is terminated, and neither party shall have further liability hereunder, 6. Ttight of Fntry The Association, through its authorized representatives and contractors, shall have the right to enter upon the Property of Owner for the purposes authorizcd by this Agreement. The Association and its authorized representatives and contractors shall exercise ordinary care and pnidence to avoid damage to the Owner's property and/or structures, with the Owner recognizing and specifically acknowledging;that existing planting, shrubbery and landscaping, will remain and be preserved only to the extent not inconsistent with Construction of the Dune and the construction activities which must occur immediately adjacent to Construction of the Dune. Release of[AW'i'ty, Owner releases the Association arid its agents and contractors of and from any and all claims, deands,judgments, liabilities, or obligations (the "Liabilities")which Owner may have against the Association in conjunction with Construction of the 1)une other than those Liabilities specifically undertaken by the Association and its agents and contractors in this Agreement. Without limiting the generality of the foregoing, such release of liability shall include any 1,iability bayed upon the design specification of the Dunc, the performance of the Dune in withstanding the effects of the ocean and the weather, the perrormance of the dtlne in protecting any structures located on the Owner's Property, the failure of the contractor to constnict the Dune exactly in accordance with the Specifications, the inability and/or failure of the Association to construct the Dune within the contemplated time period, and enacts on the Property or structures of the Owner as a consequence of constnicting the rune, or similar dunes, in Pine Island. Owner also releases and holds harmless the Association and its agents and contractors for any personal injuries, property damage and consequential damage, including but not limited to diminution in property value, etc. 8. Effect of Non-Payment of Assessment: The Personal Obligation of the Owner; The Lien Remedies of Asso cation If the assessments are not paid op4 on the date due (being the dates referred to in Section 8 of this Article), then ( /�,� such assessment shall become delinquent and shall, together with such interest ��Yy�� thereon and cost of collection thereof as hereinafter provided, thereupon become a continuing lien on the Lot or Lots, or Dwelling Unit or Dwelling Units, which shall bind such Lot or Lots, or Dwelling Unit or Dwelling Units, in the hands of the then-Owner, his heirs, devisees, personal representatives, successors and assigns. The personal obligation of the then-Owner to pay such assessment shall remain his personal obligation for the statutory period; and, in addition, shall pass to his successors in title (as an encumbrance or lien against the Lot or Dwelling Unit) unless expressly waived by the Board of Directors. If the assessment or assessments is not paid within thirty (30) days after the delinquency date, the assessment or assessments shall bear interest from the date of delinquency at the rate of interest set by the Board, not to exceed the maximum rate permitted by law, and the Board acting on behalf of the Association, may authorize its officers to bring appropriate civil action against the Owner personally obligated to pay the same or to foreclose the lien against any such Lot or Lots, or Dwelling Unit or Dwelling Units, and there shall be added to the amount of such assessment, the costs of such action and reasonable attorneys' fee or other cost incurred by the officers of the Association pursuant to authority of the Board. In the event a judgment is obtained against any Owner for such assessments, such judgment shall include interest on the assessment as above provided and a reasonable attorney's fee to be fixed by the Court, together with the cost of the action. Section il. Subordination of the Lien to Mortgages or D gcls of Trust The lien of the assessments provided for herein shall be absolutely subordinate to the lien of any first mortgage or deed of trust now or hereafter placed upon any Lot or Lots, or Dwelling Unit or Dwelling Units, subject to assessment. The subordination shall not relieve any Lot or Lots, or Dwelling Unit or Dwelling Units, from liability for any assessments now or hereafter due and payable, but the lien thereby created shall be secondary and subordinate to any first mortgage or deed of trust as if said lien were a second mortgage or deed of trust, irrespective of when such first mortgage or deed of trust was executed and recorded. Section 12. Exempt Property. The following property subject to this Declaration shall be exempted from the assessments, charges and liens created herein: (a) all Common Properties as defined in Article Two hereof; and (b) all properties exempted from taxation by the laws of the State of North Carolina, upon the terms and to the extent of such legal exemption. Homestead exemptions shall not be considered an exemption. Notwithstanding any provisions of this Section 12, no Lot or any Dwelling Unit shall be exempt from said assessments, charges or liens. Section 13. peclaran.t's Obligations for Assessments, The Declarant's obligation for assessments on unsold Lots or Dwelling Units subject to this Declaration will be limited to the difference between the actual operating costs of the Association, excluding reserves on the Common Properties, and the assessments levied on Owners who have closed title on their Lots or Dwelling Units. In no event, however, will the Declarant be required to make a deficiency contribution in any amount greater than it would otherwise be liable for if it were paying assessments on unsold Lots or Dwelling Units. After December 31, 2002, Declarant shall pay assessments as would any other Owner for each Lot or Dwelling Unit owned by the Declarant. ARTICLE EIGHT EXTERIOR MAINTENANCE AND INSURANCE Section 1. Exterior Maintenance In addition to maintenance on the Common roperties and after thirty (30) days written notice to any Owner which shall specify the required maintenance, the Association shall have the right but not the obligation to provide (a) maintenance upon any Lot and (b) maintenance upon any Dwelling Unit, which is subject to assessment under Article Seven hereof. Such maintenance includes (but is not limited to) painting, repairing, replacing and care of roofs, gutters, downspouts, removal of signs in violation of this Declaration, and exterior improvements on any Dwelling Unit. Such maintenance as to a vacant Lot may include the mowing of grass and weeds, the trimming of shrubs, or the removal of trash and litter. Section 2. Rssessme.n.t of Cost on Exterior Maintenance, The cost of any such maintenance shall be assessed against the Lot or Dwelling Unit upon which such maintenance is done and shall be added to and become part of the regular annual assessment or charge to which such Lot or Dwelling Unit is subject and, 11 BOOK as part of such regular annual assessment or cha g E iC U be a lien against any such Lot or Lots, or Dwelling Unit or Dwelling Units, as heretofore defined and limited, and a personal obligation of the Owner and shall become due and payable in all respects as-provided herein. Section 3. Insurance on Dwelling Units Each Owner of any Dwelling Unit within The Properties, by acceptance of a deed therefor, whether or not it shall be expressed in said deed or by exercise of any act of ownership, is deemed to covenant: (a) To keep each Dwelling Unit insured against loss by fire or other casualty, with extended coverage insurance, in an amount equal to at least 90i of the replacement cost of such Dwelling Unit; (b) To name the Association as an insured "as its interest may appear", so that the Association shall be entitled to receive notice of cancellation of such insurance policy; (c) To build or restore such Dwelling Unit in the event of damage thereof and to apply the full amount, to the extent necessary, of any insurance proceeds to the restoration or repair of such Dwelling Unit; and (d) To keep the Dwelling Unit in good repair as required by this Declaration or by the Bylaws. In the event of non-payment of any premium for insurance required under this Article Eight, the Association is authorized, but not obligated or required, to pay such premium and the sum so paid shall become a lien upon the Dwelling Unit enforceable in the same manner and to the same extent as provided for enforcement of liens for assessments hereunder. ARTICLE NINE AMENDMENT TO DECLARATION An amendment to this Declaration may be proposed by the Board of Directors acting upon a vote of a majority of the Directors, or by the Members of the Association owning a majority of the voting interests in all of the Lots and Dwelling Units, whether meeting as Members or by instrument in writing signed by them. Upon any Amendment to this Declaration being proposed by the Board of Directors or Members, such proposed Amendment shall be transmitted in writing to the President of the Association, or other officer of the Association in the absence of the President, who shall thereupon call a Special Meeting of the Members of the Association for a date not sooner than ten (10) days nor later than fifty (50) days from receipt by him of the proposed Amendment. It shall be the duty of the Secretary to give to each Member written notice of such Special Meeting, stating the time and place, and reciting the proposed Amendment in reasonably detailed form, which notice, if mailed, shall be mailed not less than ten (10) days nor more than fifty (50) days before the date set for such Special Meeting. If mailed, such notice shall be deemed to be properly given when deposited in the United States Mail, Certified with Return Receipt Requested, addressed to the Member at his Post Office address as it appears on the records of the Association, the postage thereon prepaid. Any Member may, by written waiver of notice signed by such Member, waive such notice, and such waiver, when filed in the records of the Association, whether before or after the holding of the meeting, shall be deemed equivalent to the giving of notice to such Member. At the meeting, the Amendment proposed must be approved by an affirmative vote of sixty-six percent (66's) of the votes of Members (including the Declarant) entitled to vote in order for such Amendment to become effective. At any.meeting held to consider such Amendment, the written vote of any Member of the Association shall be recognized and counted if such Member is not in attendance at such meeting or represented thereat by proxy, provided such written vote is delivered to the Secretary of the Association prior to or at such meeting. In order for such Amendment to be binding upon all the holders of mortgages or deeds of trust against any Lot or Dwelling Unit in The Properties, written consent must be obtained from the then existing (as of the date of the meeting of Members which approved such Amendment) holders of First Lien Mortgages or Deeds of Trust encumbering fifty-one percent (51's) of the Lots and Dwelling Units in The Properties. If such consent is so obtained, the Amendment shall be binding on all the holders of mortgages or deeds of trust encumbering Lots and Dwelling Units in The Properties. If so approved, such Amendment of this Declaration shall be transcribed and certified by the President and Secretary of the Association as having been duly adopted and approved by the requisite percentages of-Members and lenders. The original or an executed copy of such Amendment so certified and executed by said officers with the same formalities as a deed, shall be recorded in the Currituck County Public Registry, and no such Amendment to this Declaration shall be effective until so recorded. DEC 3 02004 Morehead C�� DCM FIRST AMENDMENT TO THE BYLAWS Based on the results of the February 1999 Member Opinion Survey, and discussion with property owners, the Pine Island POA Board of Directors recommends the following amendment to the BYLAWS in order to change the date for the Association's Annual Meeting from October to March. ARTICLE SIB MEMBERS_ Section 4, Annual Meetings is hereby amended to read as follows: Section 4. Annnal Meetings Annual meetings shall be held on the third Saturday in March each year. At each annual meeting, there shall be elected by ballot of the Owners, a Board of Directors in accordance with the provisions of ARTICLE VU Section 1 herein, and Members may also transact such other business as may properly come before them. ----------------------------------------------------------------------------- Note: All changes are indicated in italics. Currently, Article Six, Section 4, states that "Annual Meetings shall be held on the Saturday, closest to the day that the date Columbus Day is officially observed each year." Minutes of Special Meeting November 15, 2003 Written notice having been duly mailed on October 13, 2003 by Certified Mail, Return Receipt Requested, to all members of record as of that date, the Special Meeting of Pine Island POA, Inc. was called to order by Maun Sardi, President of th,e Association at 1-10PM in the Corolla Chapel. Following the introductions, Tom Christopher, PIPOA Secretary certified that an adequate number of owners were present or had sent in proxies to provide a quorum. Mr. Sardi reminded those present that no business would be transacted at the Special Meeting except as stated in the notice for the meeting. Mr. Sardi outlined the agenda and goals for the meeting and then introduced, in turn, three individuals who gave presentations: 1. John Fisher, PH.D., talked about coastal processes, erosion and dune restoration methods 2. Bill Pitt, Kill Devil Hills Town Commissioner and member of Dare County Beach Nourishment Committee provided information on the history of dunes on the Outer Banks in general and Kill Devil Hills specifically. He also reported on the historical municipal approach to coastal management. 3. Jack Hughes, PIPOA Manager, provided examples of the post Isabel dune condition in Pine Island and made a presentation on how he has managed the Dune Restoration and Maintenance Program for Sanderling. Detailed questions were entertained by the various expert presenters, both germane to their presentations and more specifically about the proposal itself. Jack Hughes' presentation was abbreviated, due to the President's concern over his deadline of 4:00 PM for concluding the meeting. Following the expert testimony, President Sardi extensively entertained questions and comments from the floor on the proposal. At the conclusion of the presentations and discussion it was determined that even if everyone present at the meeting voted to approve the "First Amendment" to the Declaration and, that number added to the proxy votes, the number of total votes approving would be less than the required 66% of total properties. Mr. Cresswell rose to make the point that everyone present should either fill out a proxy or cast a paper ballot (for or against the measure) to preserve the votes present, as the �^ DECRIC 3 members are almost entirely non-local residents. (PIPOA) has been restoring the sections of our primary dune system that were seriously eroded by hurricane Isabelle. The method used thus far has been to; a) truck in sand and place it on the west side of the remaining dune in order to create a primary dune that is approximately 25 feet measured east to west at an elevation of 10 feet above the beach at the east toe of the dune, b) install sand fence on the beach near the east toe of the dune and c) plant grass on the refurbished dune. The area adjacent to your home was initially designated by our engineer as not being suitable for that methodology. Even though erosion had occurred, the resulting topography, a relatively short distance from pool walls to the beach and Coastal Management Agency regulations posed severe limitations. As stated in the last "Dune Briefing", the Ocean Dune Board committed to reassessing dune conditions throughout the community, particularly near Lots 241 — 250. Fencing was installed on your property several times and is doing a good job trapping sand. It appears that the beach elevation in your area has risen approximately 4 feet since Isabelle and a new primary dune is beginning to reestablish near its former location (see enclosed photo labeled Exhibit "A"). This is likely due to a significant near- shore sandbar as well as the sand fence. I am pleased to advise you that the Ocean Dune Board (ODB) proposes to augment the primary dune by placing additional sand between the newly forming eastern portion of the dune and the remnant of the pre- Isabelle dune. Exhibit "B" shows where the new sand will be placed. The work will be conducted adjacent to Lots 241 — 250 and will result in a primary dune that will approximate that which we created in other sections of Pine Island. The work proposed will necessitate the removal of most beach stairs on the east side of the dune. The PIPOA will remove the stairs and homeowners will be responsible for their replacement as was the case in areas previously completed.
