This permit, issued on January 22,2007 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below.Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) As depicted on the attached workplan drawings, this minor modification authorizes an extension in the restoration area to include lots 241 through 250. 2) All work on the authorized project shall be conducted entirely landward of the normal high water line. 3) This minor modification shall be attached to the original of Permit No. 8-05, which was issued on 1/20/05, and modified on 2/22/05, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 4) All conditions and stipulations of the active permit remain in for under this minor modification unless specifically altered herein. This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. An appeal requires resolution prior to work initiation or continuance as the case may be. / This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Please sign both the original (buff- colored form) and the Xerox stamped "Copy". Return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. Please retain the original (buff-colored form),as it must be available on site when the project is inspected for compliance. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A- 121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty(20)days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. If you are having the work done by a contractor, it is to your benefit to be sure that he fully understands all permit requirements. The request for extension of this major permit has been reviewed pursuant to the provisions of reference (b). Reference (a)provided the required signed and dated attestations 2. This office has determined that the original development authorized by MP 8-05 has been completed and the Pine Island POA now wishes to renew the permit in order to have a permitting vehicle available to repair their dunes in response to a storm event. 3. Changes in Coastal Resources Commission's rules and development standards since the date of issuance of this permit are not considered relevant to the permitted development, and do not raise concern for denial or modification of this permit. 4. It is recommended that a Five-year extension of this permit be granted. 5. Also enclosed is a copy of the subject permit, and the Renewal request letter. Minor Modification to Major Permit 1. The Pine Island POA has requested a Minor Modification to Major Permit 8-05, which was issued on January 20, 2005 and expires on December 31, 2008. The current major permit authorizes them to conduct dune rehabilitation efforts along three miles of dunes and then install sand fence along their property in Currituck County. 2. Pine Island POA has requested to modify Major Permit 8-05 to continue dune restoration activities on an additional 4970 feet across lots 170-206, 251-270 and 1-4A thru 44A. 3. John Cece conducted a site visit to review the Minor Modification request pursuant to the provisions of reference (c) and has determined that the request meets the requirements contained in 15A NCAC 07H .0308 USE STANDARDS. Specifically, the request to set up a permitting vehicle to continue the associations program for dune monitoring and maintenance in the event of a storm event will comply with the conditions of 07H.0308 (b). 4. The Elizabeth City District Office received the required fee of $100, paid by check #1208, on June 18, 2008. A copy of this monetary transaction is attached for your records. 5. It is recommended that the Minor Modification request be granted, provided all the Permit Conditions of the original permit issued on January 20, 2005 remain in affect. I am requesting this renewal of the permit in order to continue maintaining the primary dunes in the Pine Island community on a routine basis in accordance with the association's program for dune monitoring and maintenance. All work completed to date has been performed in compliance with the current conditions of Major Permit No.8-05 and Minor Modifications issued for this Permit. Furthermore, I and Pine Island POA, Inc. will abide by all of these current permit conditions for all work performed during the renewal period. I am also, hereby, requesting a minor modification to include the properties listed on attached Exhibit "A" in addition to the properties already covered by the existing permit issued on January 20, 2005 and the minor modification issued on January 22, 2007 (See Exhibit "B" for list). All of these properties are shown on the drawings attached as Exhibit "C". Thank you for your guidance on how to prepare this request. If there are any questions or requirements for additional information, please let me know.
