Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this minor modification authorizes the rehabilitation of the dune at Lot 23, Lots 86-133 and lots 210, 212, 256, 257, 259 and 260, all as expressly and specifically set forth in the attached work plan drawing. 2) All work on the authorized project shall be conducted entirely landward of the normal high water line. 3) This minor modification shall be attached to the original of Permit No. 8-05, which was issued on 1/20/05, the modification issued on 2/22/05, the modification/renewal issued on 7/7/08 and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastat Resources Commission. date. An appeal requires resolution prior to work initiation or continuance as the case may be. Jeff Shields of Seaside Management, property manager for the Pine Island POA, has requested a Minor Modification to Major Permit#08-05, which was issued on January 20, 2005 and expires on June 25, 2015. The original major permit authorized the applicant to conduct dune rehabilitation to be conducted from and on the landward side of the dune crest along approximately 3 miles of dunes and then install sand fencing seaward of the dune crest. Subsequent modifications permitted sand to be spilled over the dune crest onto the seaward side of the dune, expanded the project area to approximately 3.5 miles and allowed for continued maintenance for an additional 5 year period. 2. Pine Island POA has requested to modify Major Permit#08-05 to: a. Conduct dune rehabilitation work to Lot 24, Lots 86-133 and Lots 210, 212, 256, 257, 259, and 260 (Approximately 2,584'). b. Stage the dune rehabilitation on the seaward side of the dune line as follows: Haul sand to the Currituck Beach Access and unload the sand onto the beach. The sand will then be reloaded into an off-road dump truck and hauled down the beach where it will be dumped seaward of the dune at the appropriate Lots. I conducted a site visit on December 12, 2013 to review the Minor Modification request pursuant to the provisions of reference (a) and have determined that the request meets the requirements contained in 15A NCAC 07H .0308 USE STANDARDS. Specifically, the request to stage the dune rehabilitation seaward of the dunes will comply with 07H.0308(b)(3) by reducing overall damage to existing dune vegetation. 4. The required fee of$100, paid by Check #1336, was received by the Elizabeth City District Office on December 10, 2013. A copy of this monetary transaction is attached for your records. 5. It is recommended that the Minor Modification request be granted, provided all the Permit Conditions of the original permit issued on January 20, 2005 as well as the Permit Conditions of subsequent Minor Modifications issued on February 22, 2005, January 22, 2� and July 7, 2008 remain in effect. Our plan is to haul sand to the Currituck Beach Access were it will be dumped and reloaded into an off-road dump truck and hauled down the beach and dumped in front of the identified lots. An excavator will then move the sand to the west side of the dune crest were a small bob cat/dozer will move into place. The project calls for approximately 12,500 CY of sand with our goal to obtain approximately a 10 ft elevation from the beach to the crest of the dune (which we already have) and a 25ft width from the crest westward. This 25-10 rule will provide us with a standard to withstand a 50 year storm and provide additional protection for our property owners. We have 27 lots that have a dune width of 14 feet or less and we want to increase to 25ft in width Next year we will be looking at possibly 80 lots that have a dune width of 15 ft to 24 ft that we will be increasing to the 25 ft goal. (2015) We would like to get started January 2014 with a finish date of mid April. Also attached please see a sketch plan as well as our Dune measurement guidelines we have implemented that provides a color code to each lot in Pine Island. Best Regards, Jeff PS: The east side approach to a west side project will eliminate the need for multiple access points, the disruption and damage to property and beach access structures and real damage to the vegetated dune system. This approach will also help from an economic perspective as well.
