Docking Facility 1) In accordance with 15A NCAC 07H.0208(b)(6)(J)(iii), which prohibits docking facilities from extending more than one quarter of the width of a waterbody, no portion of the pier and associated structure shall extend waterward more than 300 feet as measured from the waterward edge of the delineated coastal wetlands. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Point Permit#81-05 ., t Page 2 of 3 ADDITIONAL CONDITIONS 3) An as-built survey shall be performed on the docking facility, and copies of the survey shall be provided to the U.S. Army Corp. of Engineers and the Division of Coastal Management, within 60 days of completion of construction. 4) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 5) Any portion of the permitted access pier and docking facilities built over. coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the AIWW channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation'or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) The authorized covered.gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 9) The authorized covered gazebo shall be single story, and shall not be designed to allow for second story use. General 10) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 12) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. Point Permit#81-05 Page 3 of 3 i ADDITIONAL CONDITIONS 13) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee shall not be relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 14) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 15) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or*work authorized by this permit, or if in the .opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation 'of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 16) The permittee is cautioned that this permit does not authorize the placement of tie piles in association with the docking facility. Furthermore, due to the proximity of the AIWW, boats utilizing the docking facility will be subject to frequent wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to project initiation. NOTE: The N.C. Division of Water Quality has assigned the proposed project DWQ Project No. 050406. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 197800056 (COE Action Id. No. 200500690) which was issued on 4/28/05. PROJECT SUMMARY: The applicant proposes to construct a private pier, gazebo, (2) floating docks and (2) boatlifts into the AIWW/Masonboro Sound. Point Page 2 9. PROJECT DESCRIPTION: The project site is located at 194 Tanglewood Dr., adjacent to the AIWW/Masonboro Sound, in New Hanover County. The .66 acre lot is approximately 120 feet in width and 200 feet in depth. The lot averages 4 feet above mean sea level and is vegetated with lawn grasses and landscape shrubs. Upland vegetation is primarily Oak Trees. The applicant maintains an elevated two story single-family residence on property. The shoreline is stabilized by 84 linear feet of bulkhead. Adjacent to the bulkhead, there is a border of coastal marsh approximately 25 feet in width. The marsh vegetation is primarily Smooth Cordgrass (Spartina altemifloral, which is intermixed with Saltwort Salicornia, spp.), Spike Grass (Distichlis spicata), and Sea Lavender (Limonium, spp.). The lot is just north of an estuarine cove that is created by an adjacent peninsula to the south of the property. There is a community boat ramp located on the northwest side of the peninsula. The peninsula is located three properties to the south of the property of interest. The community boat ramp provides water access to the inland property owners of the adjacent Channel Haven subdivision. In the project area, the waters are classified as SA-ORW (Outstanding Resource Waters), by the NC Division of Water Quality, and they are CLOSED to the harvest of shellfish. These waters are designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes to construct a private pier, gazebo, floating dock and (2) boatlifts into the AIWW/Masonboro Sound. The pier would be 386 feet in length by 6 feet in width, and would extend from the existing bulkhead towards the AIWW in an easterly direction. The pier would begin as a 354 feet accessway and would terminate in a 14 feet x 14 feet gazebo. The access pier would then continue through the gazebo towards the AIWW for an additional 32 feet. The applicant proposes to install (2) 13 feet x18 feet boatlifts on the both sides of the terminal end of the proposed pier. The applicant also proposes to have an access ramp from the northern side of the proposed gazebo, leading to a 6 feet x 8 feet floating dock. The entire structure would extend approximately 400 feet waterward of the normal high water (NHW) line. 10. ANTICIPATED IMPACTS The proposed dock would incorporate approximately 712 square feet of Estuarine Waters and Public Trust Area. The proposed structure would shade approximately 150 square feet of coastal wetlands. Minor increases in turbidity should be expected during construction. The proposed pier would extend approximately 400 feet into a waterbody which measures approximately 1,200 feet across, which would be 1/3 of the distance. The proposed pier would extend a distance equal to the adjacent pier to the north. This would not conform with the 1/4 width rule and the established pier lengths. The North Carolina Wildlife Resources Commission has reviewed the project for impacts to wildlife and fishery resources. We regret that time constraints prevented a site visit and delayed our response. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act(G.S. 113A-100 through 113A-128). The applicant proposes to construct a private pier, gazebo, and floating dock with 2 boatlifts accessing Masonboro Sound. A 25-ft. wide margin of coastal wetlands occurs along the shoreline. Coastal wetlands typically provide excellent habitat for wading birds,raccoon, opossum,juvenile fishes, and estuarine invertebrates. Area waters are classified SA-ORW and designated Primary Nursery Area(PNA). According to the workplat, water depth at the end of the pier appears to be shallow, a condition that may prompt future requests to dredge in an ORW and PNA. About 150 sq. ft. of coastal wetlands would be shaded by the pier. Pier construction would disturb approximately 862 sq. ft. of wetlands and shallow bottom in sensitive waters. This could be particularly damaging to wetland vegetation and water quality if done during the warmer months. Pier length also exceeds '/,the water body width and the established pier head line,potentially contributing to a navigational hazard. Based on these concerns,we recommend the following conditions to permit issuance. 1. No dredging shall be allowed.
