Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures may be conducted on, in or over public trust
waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
.} permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.

ADDITIONAL CONllITIONS
3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
4) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
And conditions of this permit. The permittee is not.relieved of this requirement if he/she abandons the
permitted activity without having it transferred to a third party.
6) This permit shall not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
Shoreline Stabilization
8) The bulkhead alignment shall be constructed along a straight line form the existing corners on the east
and west side of the project property.
9) The bulkhead shall be constructed prior to any backfilling activities.
10) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
11) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation or other land disturbing activities
is permitted except for that which may be required for the construction of the bulkhead wall, riprap,
headmen cables, etc. This pe,:rit does not authorize any excavation %vater yard of the approved
alignment.
12) The backfill material shall be clean and free of any pollutants except in trace quantities.
13) The riprap shall not extend waterward more than 10 feet from the authorized bulkhead alignment at any
point along its alignment at the time of construction.
14) The riprap material shall be free from loose dirt or any pollutant. It shall be of a size sufficient to
prevent its movement from the site by wave or current action.
15) The riprap material shall consist of clean rock or masonry materials such as but not limited to granite,
marl, or broken concrete.

ppropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.)
17) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
General
18) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
19) All highground grading and construction shall be done in accordance with the attached workplan
drawings.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that the rules of the
Environmental Management Commission prohibit many non-water dependent activities within
50 feet of the normal water level.
NOTE: The permittee and/or his contractor is urged to meet with a representative of the Division prior to
project initiation.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3490 (DWQ Project No. 050575), which was issued on 515105.

8. PROJECT SUMMARY:The applicant proposes to construct a bulkhead and place riprap on the waterward side of
the bulkhead. The bulkhead will be constructed from the corners of existing bulkheads on neighboring properties,
in a straight line,with an average alignment±25'waterward of the normal water level(NWL). The proposed riprap
will be placed with a 2:1 slope with the waterward toe averaging 10'from the proposed bulkhead. Applicant also
proposes to construct a 6'x 200'pier with a 16'x 20'platform and a Tx 36'finger pier around a 16'x 16'boat lift.

Project Setting
The project site is located off SR 1722 on the west side of the Pungo River below Belhaven
at the residential subdivision locally referred to as Ellis Cove in Beaufort County,North Carolina.
The project site is a wooded undeveloped 0.39 -acre residential lot with±120' of natural shoreline
with no man made shoreline stabilization i.e. bulkhead or rip rap. The lot is vegetated primarily
with various large oaks,loblolly pines and red maple trees. The under story consist of various vines
and shrubs. There is a±5' high erosion escarpment that transitions to a sandy estuarine beach at the
normal water level (NWL). Both adjacent waterfront properties are developed with single-family
residences. The developed property downstream of the project site has a ±150' long pier. The
shorelines on adjacent properties are stabilized with bulkheads. The bulkhead return wall on the
downstream side is 30' long while the bulkhead return wall on the upstream side is 20' long. Water
depths offshore are shallow with a sandy bottom substrate. Water depths are approximately 2.5'
200' offshore the NWL and 8"to 12"between the bulkheads on adjoining lots. The presence of
submerged aquatic vegetation (SAV) was not observed at or near the project area although this
observation was made recently during a dormant period for SAVgrowth. The Pungo River at this
location is designated as SB NSW by the Environmental Commission, Coastal Waters by the
Division of Marine fisheries and is open to shell fishing.
Project Description
The applicant proposes to construct a bulkhead from the corners of existing bulkheads
on neighboring properties,in a straight line,with an average alignment±25'waterward of the NWL.
The maximum distance between the proposed bulkhead and the NWL is ±30'. The proposed
bulkhead will be backfilled to the±5'high erosion escarpment. The proposed riprap will be placed
with a 2:1 slope with the waterward toe averaging 10' from the proposed bulkhead. The applicant
also proposes to construct a 6' x 200' pier with a 16' x 20' T-head platform, and a 4' x 36' finger
pier around a 16' x 16' boat lift.
Project Impacts
The project as proposed will result in the filling of±3,000 ft2of shallow water habitat in the
Pungo River. The There will be some short-term localized turbidity associated with the construction
activities.

Enclosed is an application received from Jerol Selby,agent for Victoria E.Paul,for bulkhead,
riprap and pier construction onsite her property located on the west side of the Pungo River below
Belhaven at the residential subdivision locally referred to as Ellis Cove in Beaufort County,North
Carolina. The applicant is applying for a bulkhead alignment that averages±25' offshore the NWL.
The bulkhead is to be constructed from corner to corner, in a straight line, from bulkheads on
adjoining properties on the east and west side. The subject property is a natural shoreline with no
man made shoreline stabilization i.e. bulkhead or riprap. I have reviewed the proposed shoreline
stabilization work in regards to the use standards in NCAC 71-1, specifically.0208(7)(D)(ii)and have
determined that the applicant's proposal is consistent with those standards. I have also determined
the proposed pier work to be consistent with the use standards in NCAC 7H. Absent of any strong
objections from the commenting agencies,I recommend that the permit be issued and along with the
standard conditions for bulkhead, riprap and pier work, I recommend the following condition:
(1) The proposed bulkhead is to be constructed per the application drawings dated
1/26/05. The bulkhead alignment is to be accomplished in a straight line from the
existing corners on the east and west side of the project property.

Subject: Major Permit Application,Requested by Victoria Paul. The applicant proposes to
construct a bulkhead, place riprap on the waterward side of the bulkhead, and
construct a pier and finger pier around a boat lift. The project site is located in a
residential subdivision off SR 1722 in Bath on the west side of the Pungo River
below Belhaven in Beaufort County, North Carolina.
LUP Consistency Determination: The proposal is Consistent With &Not In Conflict with
the Beaufort County, NC 1997 Land Use Plan certified by the CRC on November 20,
1998.
Overview:
The project area is located in a subdivision off SR 1722 in Bath on the west side of the Pungo
River below Belhaven in Beaufort County. The site is undeveloped with no existing man-made
shoreline stabilization devices. A 5'-high erosion escarpment transitions to a sandy estuarine
beach at the normal water level. Both adjacent waterfront properties are developed with single-
family residences. The shorelines at the adjacent properties are stabilized with bulkheads.
The applicant proposes to construct a bulkhead from the corners of existing bulkheads on the
neighboring properties. The proposed bulkhead would be backfilled to the 5'-high erosion
escarpment. The proposed riprap would be placed on the waterward side of the bulkhead on a
2:1 slope. The applicant also proposes to construct a 6' x 200' pier with a 16' x 20' T-head
platform, and a 4' x 36',finger pier around a 16' x 16' boat lift.
Anticipated impacts:
The project as proposed would result in the filling of 3000 ft2 of shallow habitat in the Pungo
River.

Areas of Environmental Concern (AEC):
AECs impacted by the proposal include Public Trust Area, Public Trust Shoreline, Estuarine
Water and Estuarine Shoreline. The water classification is SB-NSW and is open to the
harvesting of shellfish. The area is not a Primary Nursery Area.
The Beaufort County Land Classification Map designates the subject property as `Limited
Transition' and the AECs as "Conservation". Development within the designated AECs is
limited by CAMA regulations and development guidelines. Applicable or related policy
includes the following:
"Beaufort County supports the construction of bulkheads which fulfill the use
standards set forth in 1 SA NCAC 7H" (Bulkhead Construction,pg. IV-10)
"Beaufort County supports the use standards for estuarine waters and public trust
areas as specified in 15A NCAC 7H.0207" (Marine Resource Areas (a), pg. IV-18)

Reference the application of Victoria Paul for a Department of the Army permit to
construct a bulkhead and a pier, and place riprap material waterward of the bulkhead, on property
located off State Road 1722, adjacent to the Pungo River,near Belhaven, in Beaufort County,
North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE)prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE

Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as authorized by this permit or any USACE approved modification to this permit,
no excavation, fill or mechanized land-clearing activities shall take place at any time in the
construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.

You have our approval, in accordance with the attached conditions,to dredge,place fill material within or
otherwise impact by shading 0.10 acres of waters and/or wetlands to construct a bulkhead with riprap,
pier and boatlift as described in your application received by the Division of Water Quality(DWQ)
Wetlands/401 Unit on April 6, 2005. After reviewing your application,we have determined that the
Division of Water Quality(DWQ)General Water Quality Certification Number 3490 covers these water
impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army
Corps of Engineers(USACE). In addition,you should get or otherwise comply with any other federal,
state and local requirements before you go ahead with your project including(but not limited to) erosion
and sediment control regulations and CAMA. Also,this approval to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project,you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project(now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 21-1 .0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.

2. Certificate of Completion

Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit,North Carolina Division of Water Quality,

3. Water Quality Certification
The proposed project must comply with all of the conditions of General Water Quality
Certification(GC)3490.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depleted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification(associated with the approved water
impacts),you may ask for an adjudicatory hearing. You must act within 60 days of the date that you
receive this letter. To ask for a hearing, send a written petition,which conforms to Chapter 150B of the

Raleigh,N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.

The Washington Regional Office received a copy of your CAMA application for a proposed bulkhead and pier
project at lots 5 &6 Woodstock Point Subdivision on April 4, 2005. Staff review of the plans and specifications
has determined that the project, as proposed, consists of activities that will not pose surface water quality
threats from stormwater runoff since no significant new impervious area is proposed. The Director has
determined that projects that are reviewed and approved by the Division as not posing water quality threats
from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A
NCAC 2H.1000. For this reason, we are informing you by way of this letter that your project will not require a
stormwater management permit.
Please keep in mind that this determination does not affect your legal requirements to obtain other permits
which may be required by the Division of Water Quality, the Division of Land Resources, Coastal Area
Management Act or any other Federal, State or Local Government. In addition, any future modifications to
the project will require additional review from this office to assure that stormwater impacts are not an issue.

Dear Mr. Trowell:
Enclosed is a Major CAMA Dredge and Fill Permit Application for the construction of a
wooden bulkhead and rip rap on site on an undeveloped residential lot owed by Victoria
E. Paul located off SR 1722 at Woodstock Pt. Sub-Division on the Pungo River near
Belhaven in Beaufort County,North Carolina.
The bulkhead project will be to construct the proposed bulkhead in a straight line from
the corners of bulkhead on adjoining properties. The bulkhead alignment will average + -
25 ft. waterward of the normal water level. Dragline mats will be used to facilitate the
movement of a trac hoe while driving the bulkhead sheets. The rip rap is to be placed
once the bulkhead is constructed. Rip rap is proposed to be placed at a 2'/1' slope with
an average alignment of 10 ft. waterward of proposed bulkhead.
The area landward of the proposed bulkhead will be backfilled to the +- 5 ft. high
erosion escarpement. The area will then be planted with typical yard grass such as
Centipede and or St. Augustine.
Also proposed is a 6 ft. x 200 ft. pier with a 20 ft. x 16 ft. T-Head platform, 4 ft. x 36 ft.
finger pier around a 13 ft. x 13 ft. boat lift.
The application package has been sent certified mail return receipt requested to the
adjacent landowners. The required signed green cards will be submitted to your office
when received by me.

The Department of Environment and Natural Resources hereby gives public notice as required by
N.C.G.S. 113A-119(b)that an application for a development permit in an Area of Environmental
Concern as designated under the CAMA was received on 23 March 2005. According to the said
application,Victoria E. Paul, Applicant, by Jerol Selby, Selby Land Concepts, proposes to
construct a bulkhead and place riprap on the waterward side of the bulkhead. The bulkhead will be
constructed from the corners of existing bulkheads on neighboring properties, in a straight line,with an
average alignment±25'waterward of the normal water level(NWL). The proposed riprap will be placed
with a 2:1 slope with the waterward toe averaging 10' from the proposed bulkhead. Applicant also
proposes to construct a 6'x 200'pier with a 16'x 20'platform and a 4'x 36'finger pier around a 16'x 16'
boat lift, at property located off SR 1722,on the west side of the Pungo River, below Belhaven, at
the residential subdivision locally referred to as Ellis Cove, in Beaufort County,North Carolina. A

The Division of Coastal Management hereby acknowledges receipt of an application for State
approval for development of the property of Victoria E. Paul, located off SR 1722, on the west side of the
Pungo River, below Belhaven, at the residential subdivision, locally referred to as Ellis Cove, in Beaufort
County, North Carolina. It was received on 23 March 2005 and appears to be adequate for processing at
this time. The projected deadline for making a decision is 6 June 2005. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will also serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day. Should there be any questions on
this procedural change, do not hesitate to contact me.
If this agency does not render a permit decision within 70 days from 23 March 2005, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of your
written request and shall include the property owner, developer, and project designer/consultant.
N.C.G.S. 113A-119(b) requires that notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point along
the property where it can be observed from a public road. Some examples would be: nailing the notice
card to a telephone pole or tree along the road right-of-way fronting the property, or at a point along the
road right-of-way where a private road would lead one into the property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made and if additional information is required,you will be contacted
by the appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

described as follows!
Bounded on the North by Pungo River, on the South by Stephe
Be Sparrow and wife, on the West by Stephen 0. Sparrow and wife and on the East
by Howard Smith land, beginning at an iron stake in the East sideline of the
lands of Stephen Be Sparrow and wife as described in deed of record in Book 463
at Page 367, and on map in Map Book 6 at Page 96, all in Beaufort County Regis-
try, said iron stake being located in their line 5475 feet on a course of North
42+ East from the Southeast corner of said tract and being also 300 feet from
the South edge of Pungo River, and running from said beginning point North 53°
451 West 550 feet to another iron stake; thence North 42° East: 300 feet to Pungo
River; thence down said river in a Southeastwordly direction 550 feet to the
(line of Howard Smith land; thence with the Smith line South 42° West 300 feet
Ito an iron stake, the point of beginnings
There is also hereby conveyed a right of way from the Loop
Road as shown on map in Map Book 6 at Page 96, to the land herein conveyed and
above described. Said right of way shall be 20 feet in width odjoining the line
shown on the map herein referred to as adjoining the land of J- T. Smith and
being South 42° West 5775 feet and being the same right of way reserved by

of land, together with all privileges and appurtenances thereunto belonging,
for in anywise appertaining unto them, the said parties of the second part,
