Pier 1) Unless specifically altered herein, this minor modification authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the attached permit application and workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this pier without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Page 2 of 3 ADDITIONAL CONDITIONS 2) All portions of the access pier located over Coastal Wetlands shall not exceed a width of 6 ft. and shall be elevated a minimum of 3 feet above the wetland substrate as measured from the bottom of the decking. 3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. This corridor is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 4) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 5) The roof of the covered platform shall not be designed for second story use. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury that may be caused from existing or future operations undertaken by the United States in the public interest. 9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 10) This minor modification does not authorize the creation of any boat slips associated with the authorized pier. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 12) No wetlands shall be excavated or filled, even temporarily, without permit modification. 13) This minor modification shall be attached to the original of Permit No. 52-05, which was issued on 4/11/05, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. 14) All conditions and stipulations of the active permit remain in force under this minor modification unless altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. Signature of Permittee Oceana Marina, LLC Permit 452-05 Page 2 of 3 ADDITIONAL CONDITIONS 4) All excavated materials shall be confined landward of the Normal High Water(NHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 5) This permit only authorizes the excavation activities indicated on the attached workplan drawings. 6) Excavation shall not exceed —6 feet below the elevation of Normal Low Water (NLW). 7) The terminal end of the pipeline from the dredge area into the diked retention area shall be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. 8) A water control structure shall be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. 9) The disposal area effluent shall be contained by pipe, trough, or similar device to a point at or beyond the Mean Low Water (MLW) level to prevent gully erosion and unnecessary siltation. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at, or adjacent to, the authorized work. Use of the permitted activity shall not interfere with the public's right to free navigation on all navigable waters of the United States. 12) No excavated or fill material shall be placed in any location or in any manner so as to impair surface water flow into or out of any wetland area. 13) The activities shall be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction related discharge. Increases in turbidity of 25 NTU's or less are not considered significant. Sedimentation and Erosion Control 14) Appropriate sedimentation and erosion control devices, measures or structures (e.g. silt fence, diversion swales or berms, etc.) shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and/or properties. 15) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. General 16) The permittee is advised that if discharges or fill material from waters closed to the harvest of shellfish are placed in areas adjacent to waters that are open to the harvest of shellfish, a minimum of 24 hours prior notification shall be given to the Shellfish Sanitation and Recreational Water Quality Section so that appropriate temporary closures to the harvest of shellfish may be put in place. State Permit No. 52-05 was issued to Oceana Marina,LLC c/o Vaughn King on April 11,2005 for the maintenance excavation of their existing joining marina facilities through the CAMA Major Development Permit Express Program. State Permit No. 52-05 was modified on November 14,2005 for the shoreline stabilization for the marina facilities. State Permit No. 52-05 is due to expire on December 31,2008. Mr. Brannen is requesting that the permit be modified to allow for the construction of a new pier and a partially covered platform. The new pier and platform would extend towards the AIWW from the existing bulkhead located on the northern end of the Oceana Marina HOA's property,which would be outside of the existing marina's footprint. The pier would be 60' in length by 6' in width,which would then terminate in a 16' in length by 16' in width gazebo. Waterward of the gazebo would be an uncovered platform 8' in length by 16' in width. There are no slips associated for proposed structure. The proposed structure would extent approximately 84' into a waterbody,which measures approximately 775' across. The proposed structure would not exceed the'/4 width rule and would not encroach into the AIWW 80' setback and the 15' adjacent riparian corridor setback requirements. The proposed structure appears to not hinder navigability to the adjacent creek located just north of property. The agent for Oceana Marina HOA has submitted a hydrographic survey and also letters of no objections from the adjacent riparian property owners. The applicant has submitted a check(ck. # 1554)in the amount of$100.00 for the modification request. This Office has no objection to the permit modification request. W by 'S 300?
