Bulkhead 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally_ tight so as to prevent seepage of backfill materials through the structure. 7) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. 8) The fill material shall be clean and free of any pollutants except in trace quantities. 9) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. f 10) No backfill material is to be placed within 30 feet of the normal high water line, except that which shall be used to backfill the area behind the permitted bulkhead. 11) The "freestanding" bulkhead shall not extend more than an average of 6 inches above the height of the adjacent wetland substrate. No backfilling of the freestanding bulkhead is permitted. 4 Y •r v :i F 12) The "freestanding" bulkhead shall be located waterward of any area of coastal wetlands. S 13) The alignment of the "freestanding" bulkhead shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to { initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions shall require the alignment to be re-staked by DCM within a maximum of 30 days prior to the new expected r start of construction. r •r •r •r Boat Ramp f 14) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or r poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact r waters of the State or waters that will enter waters of the State. f f Docking Facility 15) This permit authorizes only the docks, piers, and other structures and uses located in or over the water t that are expressly and specifically set forth in the permit application. No other structure, whether ffloating or stationary, shall become a permanent part of this docking facility without permit modification. Permit# 68-05 Page 3 of 4 ADDITIONAL CONDITIONS l be made by the permittee to prevent the full and free use by the public of all navigable cent to the authorized work. 17) The authorized structure and associated activity shall not cause an unacceptable interference with navigation. 18) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the s, permitted activity without having it transferred to a third party. . 19) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public F interest. 20) Permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 21) This permit authorizes a maximum of 9 boat slips designed as personal watercraft docks. At no time shall more than 9 vessels be moored or docked at the facility. The restriction of the number of vessels g shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and }� kpersonal watercraft. Any modification/reconfiguration of this facility shall require permit modification. r NOTE: Any proposal to add two or more additional boat slips to the authorized 9-slip facility shall require that the docking facility be classified as a marina, and shall therefore require a review t under the N.C. Environmental Policy Act (NCEPA). :f VOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day roperation of the facility to prevent facility waste from entering the adjacent waters. Such r discharge, either directly or indirectly, to adjacent waters could contravene state water quality r fstandards, thereby violating state law. tSedimentation and Erosion Control I 22) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to r ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, f diversion swales, or berms, etc.). Pettit Permit# 68-05 Page 4 of 4 ADDITIONAL CONDITIONS General 24) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 25) No vegetated wetlands shall be excavated or filled. 26) At no time shall any construction equipment cross coastal wetlands or adjacent private properties without proper approval and/or permit modification. 27) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 28) Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Y NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, r approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal water level. MOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water f } Quality Certification No. 3490 (DWQ Project No. 05-0421), which was issued on 4/19/05. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 198200277 (COE Action Id. PROJECT SUMMARY: This project is located at Hatteras Watersports in Salvo, Dare County. PROJECT SETTING This project is located at 27130 NC 12, a 2.503-acre tract owned by Ronald A. Pettit along the Pamlico Sound in Salvo, Dare County. The elevated tract includes approximately 155 linear feet(If) of bulkheaded shoreline, a 12 foot wide boat ramp located in the northwest corner of the lot, and a man-made canal approximately 160 feet long located on a portion of the northern boundary of the lot. The man-made canal is bulkheaded on its south and east sides. The north side of the canal is comprised of coastal wetlands located on adjacent property and is vegetated in Spartina alterniflora and Juncus roemerianus. The north side of the canal has not been stabilized with any hardened structures. The far northwest corner of the Pettit property is comprised of a small spit of contiguous coastal wetlands that continues from the adjacent property. The small spit is vegetated in Spartina alterniflora. The south side of the property is bordered by a retaining wall separating the Petitt property from coastal wetlands located on the adjacent property that is also vegetated in Spartina alterniflora and Juncus roemerianus. Neither of the adjacent properties' shorelines have been stabilized with hardened structures. The Petit property, which is elevated approximately 4.3 ft above NWL, includes a small sound-front watersports office with elevated observation deck, a three-story observation tower, a residence, and a gravel driveway and parking area. The residence provides sanitary facilities and outdoor showers for patrons and employees. An onsite septic drain field treats wastewater. The water classification of the adjacent waters is SA, and they are open to commercial shellfish harvests. There did not appear to be any submerged aquatic vegetation (SAV) where the applicant has proposed installing either the boat ramp or the watercraft docks. PROJECT DESCRIPTION The applicant proposes to 1) remove the existing boat ramp, place bulkhead across the existing boat ramp opening and place fill behind the new bulkhead; 2) install a new boat ramp with return wall and freestanding bulkhead and fill behind the new bulkhead; 3) install a "courtesy pier" along-side the new boat ramp; 3)construct a nine slip watercraft dock, and 4) install rip-rap to protect existing coastal wetland. The existing concrete boat ramp located in the northwest corner of the lot will be removed. The concrete debris will be used to backfill the approximately 12 if of new bulkhead that will be installed across the existing boat ramp. Installation of this section of bulkhead will be on the NWL and will not require the placement of fill below NWL. A new concrete boat ramp will be constructed at the east end of the existing man-made canal. A return wall and approximately 10 if of new bulkhead will be installed north of the new boat ramp. Material excavated during this construction, as well as material delivered from off-site upland sources, will be used for bulkhead backfill material at the new boat ramp and at the existing boat ramp. Installation of the new boat ramp and the associated section of bulkhead will require the placement of approximately 3 cy of fill below NWL. The water depth at the end of the proposed boat ramp will be 2.5 ft. FIELD INVESTIGATION REPORT: Ronald A. Pettit, Dare County Page 3 of 4 A 10 ft by 2 ft "courtesy pier" will be installed immediately south of the new bolt;lamp that will result in the shading of 20 square feet of Estuarine Waters. The water depth along the length of the proposed pier4s 2.5 ft. A 15 if section of freestanding bulkhead (no backfill proposed) will be placed along the northern shoreline adjacent to the new boat ramp. This project will also include the installation of a piling anchored floating access dock attached to manufactured docks for nine personal watercraft. The 3.4 ft by 45 ft access dock and the nine docks (each 4.92 ft by 12.58 ft) will be installed along existing sound front bulkhead in approximately 2 ft of water and will result in the shading of 710 square feet of Public Trust Area and Estuarine Waters. The proposed dock will extend into Estuarine Waters approximately the same distance as the coastal wetland spit located in the far northwest corner of the property. The three adjacent properties located north of the Pettit property are currently undeveloped and do not contain any docks or peirs. The adjacent southern property contains an elevated walkway over coastal wetlands terminating at an approximately 12 ft by 12 ft observation platform extending over Estuarine Shoreline and Estuarine Waters. Finally, the applicants propose to install approximately 401f of clean granite riprap around the coastal wetlands spit located at the far northwest corner of the property. ANTICIPATED IMPACTS It is anticipated that the proposed project will cause the following impacts: • The piling placement, boat ramp demolition, bulkhead installation, and construction of a new boat ramp will result in temporary elevated turbidity levels of Public Trust Areas (PTA) and Estuarine Waters (EW) Areas of Environmental Concern (AEC). • The demolition and removal of the submerged portion of the existing boat ramp and the installation of the submerged portion of the new boat ramp will result in the localized disturbance of 120 sf of PTA and EW AECs. • The installation of the new boat ramp and associated bulkhead and the installation of the bulkhead across the old boat ramp will result in the disturbance of 408 sf of Estuarine Shoreline (ES) AEC. • The installation of the watercraft docks and "courtesy pier" will result in the shading of approximately 730 sf of PTA and EW AECs in Pamlico Sound. • The construction of the proposed boat ramp will result in the placement of approximately 3 cy of fill material within the PTA and EW AECs, but this ramp will provide additional boat-launching access to the Pamlico Sound. The 3 cy of fill will not impact any SAV or Coastal Wetland (CW) AEC. • The placement of the 401f of rip rap around the spit of CW will probably protect this small portion of the wetlands, but may exacerbate the erosion of the contiguous wetlands located on the adjacent property which are not protected by any hardened structures. • Preliminary review indicates that no archaeological resources are known to be located in the vicinity of this proposal. Pettit, Dare County r Page 4 of 4 • Impervious area within the ES AEC will neither increase nor decrease because the new 12 ft by 20 ft concrete boat ramp replaces an existing concrete boat ramp of approximately the same size. • Installation of the proposed watercraft dock will not directly impact local navigation, but the potential increase in watercraft activity may negatively impact local water traffic by increasing the potential for accidents/collisions. • Installation of the proposed watercraft dock will facilitate a marked increase in localized, seasonal watercraft use and increase the possibility of fuel spills/releases associated with watercraft fueling and bilge draining. • The marked increase in seasonal watercraft use may decrease the aesthetic value associated with local properties due to the presence of the watercraft and the increase in noise levels. Pettit along the Pamlico Sound in Salvo, Dare County. The elevated tract includes approximately 155 linear feet (If) of bulkheaded shoreline, a 12 foot wide boat ramp located in the northwest corner of the lot, and a man-made canal approximately 160 feet long located on a portion of the northern boundary of the lot. The man- made canal is bulkheaded on its south and east sides. The north side of the canal is comprised of coastal wetlands located on adjacent property and is vegetated in Spartina alterniflora and Juncus roemerianus. The north side of the canal has not been stabilized with any hardened structures. The far northwest corner of the Pettit property is comprised of a small spit of contiguous coastal wetlands that continues from the adjacent property. The small spit is vegetated in Spartina alterniflora. The south side of the property is bordered by a retaining wall separating the Pettit property from coastal wetlands located on the adjacent property that is also vegetated in Spartina alterniflora and Juncus roemerianus. Neither of the adjacent properties' shorelines have been stabilized with hardened structures. The applicant proposes to 1) remove the existing boat ramp, place bulkhead across the existing boat ramp opening and place fill behind the new bulkhead; 2) install a new boat ramp with return wall and freestanding bulkhead; 3) install a "courtesy pier" along-side the new boat ramp; 3) construct a nine slip, 710 square foot personal watercraft dock, and 4) install approximately 401f of clean granite riprap around the coastal wetlands spit located at the far northwest corner of the property. The general and specific use standards of the Coastal Resources Commission (CRC), as codified in 15A NCAC 07H.0208(a) and (b) which are applicable to this project have been reviewed. The project appears to be consistent with the CRC's Rules, and I recommend that a Permit be issued for the proposed development, provided that the following Notes and/or Permit Conditions are incorporated within the Permit: J 1. No vegetated wetlands/marsh grass will be excavated or filled. /2. The back fill material and disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. /3. The riprap will not extend waterward more than 5 feet from the normal water level at any point along its alignment at the time of construction. /4. The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. J5. The riprap material must consist of clean rock or masonry materials such as but not limited to granite or broken concrete. / 6. The bulkhead must be constructed prior to any backfilling activities. /7. The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. J8. The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. J9. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 10. All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. /11. No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. / 12. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. /13. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 14. The authorized structure and associated activity must not cause an unacceptable interference with navigation. 115. Anticipated Impacts resulting from this project are expected to include: the excavation of approximately 48 sq. ft. of Public Trust/Estuarine Waters AEC and 288 square feet of Estuarine Shoreline AEC; the filling of approximately 72 square feet of Public Trust/Estuarine Waters AEC and 240 square feet of Estuarine Shoreline AEC; and the shading of approximately 730 square feet of Public Trust/Estuarine Waters AEC. The project will not directly impact local navigation, however in increase in watercraft activity is anticipated. Basis for Determination: The Dare County Land Classification Map identifies the site area as "Limited Transition". The site is within Areas of Environmental Concern (AECs) therefore the "Conservation" classification also applies. If the bulkhead is adjacent to wetlands,the bulkhead height should be at the same elevation as the wetland substrate.No cross section was provided to give this information.We request this section of the proposed project be clarified prior to permit issuance.
