Bulkhead 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally_ tight so as to prevent seepage of backfill materials through the structure. f 7) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. r f 8) The fill material shall be clean and free of any pollutants except in trace quantities. f i J 9) All backfill material shall be obtained from a high ground source and confined behind the permitted f bulkhead. 10) No backfill material is to be placed within 30 feet of the normal high water line, except that which shall f be used to backfill the area behind the permitted bulkhead. 11) The "freestanding" bulkhead shall not extend more than an average of 6 inches above the height of the f adjacent wetland substrate. No backfilling of the freestanding bulkhead is permitted. r :f 1 1. 12) The "freestanding" bulkhead shall be located waterward of any area of coastal wetlands. f 13) The alignment of the "freestanding" bulkhead shall be staked by a representative of the Division of f Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to f initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions shall f require the alignment to be re-staked by DCM within a maximum of 30 days prior to the new expected f start of construction. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. . 19) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 20) Permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 21) This permit authorizes a maximum of 9 boat slips designed as personal watercraft docks. At no time shall more than 9 vessels be moored or docked at the facility. The restriction of the number of vessels Y shall apply to all marine vessel types, including but not limited to motorboats, sailing vessels and personal watercraft. Any modification/reconfiguration of this facility shall require permit modification. NOTE: Any proposal to add two or more additional boat slips to the authorized 9-slip facility shall require that the docking facility be classified as a marina, and shall therefore require a review under the N.C. Environmental Policy Act (NCEPA). NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day r y operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality :r F standards, thereby violating state law. r Sedimentation and Erosion Control 22) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to r ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, fdiversion swales, or berms, etc.). Pettit Permit# 68-05 Page 4 of 4 ADDITIONAL CONDITIONS General 24) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 25) No vegetated wetlands shall be excavated or filled. f 26) At no time shall any construction equipment cross coastal wetlands or adjacent private properties without proper approval and/or permit modification. r f 27) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not fauthorized. y f 28) Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition f shall be applied and enforced throughout the entire existence of the permitted structure. r NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. f r NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-%eater r r dependent activities are not authorized within 30 feet of the normal water level. f r I NOTE: The N.C.
