Authorizing development in Dare County at adi.to Pamlico Sound, at 27130 NC 12, in
Salvo , as requested in the permittee's letter dated 12/24/22,
including the attached workplan drawing (1) dated "Received DCM-EC 1/3/23".
This permit, issued on March 10,2023 , is subject to compliance with the application(where consistent
with the permit), all applicable regulations,special conditions and notes set forth below.Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization—Bulkhead Return Wall
1) The bulkhead return wall shall be constructed in accordance with the alignment depicted on the
attached workplan drawings.
2) No vegetated wetlands or open water shall be excavated or filled, even temporarily.
3) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet
piles, or other suitable materials approved by Division personnel.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered Braxton C. Davis, Director
hereunder requires further Division approval.

All work must cease when the permit expires on This permit and its conditions are hereby accepted.

ADDITIONAL CONDITIONS
Boat Ramp Expansion
4) Unless specifically altered herein, this permit authorizes the landward extension of the existing concrete
boat ramp, as indicated on the attached workplan drawings.
5) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact
waters of the State or waters that will enter waters of the State.
Groins
6) The groins adjacent to the existing boat ramp shall be constructed in accordance with the alignment
depicted on the attached workplan drawings.
7) The alignment of the authorized groins shall be verified by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction.
8) The groins located immediately adjacent to the authorized boat ramp shall not extend more than 20 feet
waterward of the normal water level at the time of construction.
9) Should the lot to the north of the authorized development be sold prior to the initiation of construction of
the docking facility,the permittee shall obtain a written agreement from the new owner(s)waiving the
minimum setback, and authorization to construct the portion of the groin within the property owner's
riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of
the docking facility.
General
10) In accordance with commitments made by the permittee, the originally authorized"freestanding"
bulkhead and finger pier adjacent to the boat ramp is hereby deleted. Any and all reference to the
originally authorized"freestanding"bulkhead and finger pier is null and void.
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
12) This Minor Modification shall be attached to the original Permit No.No. 68-05, which was issued to the
permittee on 5/06/05, as well as all subsequent modifications, and renewals, and copies of all documents
must be readily available on site when Division personnel inspect the project for compliance.
13) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id.No. SAW-
2005-10623.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 05-0421.
NOTE: A minor modification application processing fee of$100 was received by DCM for this project.

Major Permit (MP) #68-05 was originally issued to Ronald A. Pettit on
06/06/2005 for 40 linear feet (Ift) of riprap adjacent wetlands,
construction of bulkheading to close off an existing boat ramp,
construction of a free-standing bulkhead wall adjacent a new concrete
boat ramp, a new finger pier, and install a 9-slip personal watercraft
dock/platform. The project location is at 27130 NC 12, Salvo, Dare
County, adjacent to the Pamlico Sound and canal. The MP has received 5
renewals (on 0/2/15/2013, 02/16/2015, 02/09/2017, 01/17/2019, and
02/11/2021). The property owner has submitted a request for another 2-
year renewal to extend the permit expiration to 12/31/2024.
Mr. Pettit has requested to modify his major permit to include the
following : 1) a 20' bulkhead extension (upland return wall), 2) 6'x12'
upland concrete extension to boat ramp, and 3) 2-20' vinyl sheet pile
jetties to be sited waterward on each side of the boat ramp. The prior
request for the finger pier and free-standing bulkhead wall would be
voided.

The Minor Modification request is pursuant to the provisions of reference
(a) and the request meets the requirements contained in 15A NCAC
07H .0208 USE STANDARDS.
The required fee of $100, paid by check #1015, was received by the
Elizabeth City District Office on 01/17/2023.
It is recommended that the Minor Modification request be granted,
provided: 1) all the applicable permit conditions of the original permit
issued on 05/06/2005 remain in effect, 2) the property owner obtains a
signed waiver from John Musselman (the northern riparian owner) for
the jetty proposed on the right side of the boat ramp, and 3) there are
no environmental concerns documented by the review agencies.

In order to minimize impacts to SAV, DMF recommends installing a turbidity curtain
during bottom-disturbing portions of this project. The curtain should be left in place for
72 hours after work is completed to allow sediment to re-settle.
