Docking Facility
1) Unless specifically altered herein, this permit authorizes the relocation the two 11.5 ft. x 12 ft. boadifts,
the addition of the 6 ft. x 25 ft. floating dock creating two additional docking spaces, the reduction in
length of the existing pier from 115 ft. to 90 ft., the relocation and dimensional changes of the gazebo
and the creation of the associated deck, and the removal of the 6 ft. x 18 ft. floating dock, all as
expressly and specifically set forth in the permit application and attached workplan drawings. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility without
permit modification. No non-water dependent uses of structures shall be conducted on, in or over public
trust waters without permit modification.

permit for which the permittee is responsible. This prohibition shall be applied. and enforced throughout
the entire existence of the permitted structure.

The docking facility and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the property owner's riparian access corridor located to the northeast,
which is determined by drawing a line parallel to the channel, or deep water, then drawing a line
perpendicular to the channel line that intersects with the shore at the point where the upland property
line meets the water's edge.
4) No portion of the authorized structure shall extend beyond the town of Wrightsville Beach pierhead line.
5) Because of the proximity to the northeastern most property owner and to ensure compliance with
Conditions No. 3 and 4, an as-built survey shall be performed of the docking facilities, and a copy of the
survey provided to the Division of Coastal Management, within 60 days of completion of construction
of these portions of the project.
6) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are
permitted. Lattice is specifically excluded from being used under this authorization.
7) The roof of the gazebo shall not be designed for second story use.
8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
9) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
10) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.

ADDITIONAL CONDITIONS
NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in
association with the new floating dock and associated boat slips. Furthermore, due to the
proximity of Banks Channel, boats utilizing the docking facility shall be subject to frequent
wavewash from passing vessels. The issuance of this permit does not relieve the permittee from
taking all proper steps to ensure the integrity of the structure and the safety of moored boats.
The permittee shall not hold the State of North Carolina or the United States liable for any
damage to the structure or moored boats. The addition of tie piles shall require modification of
this permit.
General
13) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
14) No vegetated wetlands or open waters shall be excavated or filled, even temporarily, without permit
modification.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: Should the adjacent property to the southwest be sold prior to the initiation of construction, the
permittee shall be required to obtain a signed riparian corridor waiver from the new property
owner prior to the placement of any structures within the 15 foot riparian corridor.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No.
197800056 (COE Action Id. No. 200600042) which was issued on 10/21/05.

lifts to allow the construction of an additional floating dock.

9. PROJECT DESCRIPTION:
The project site is located at 202 Waynick Blvd.,adjacent to Banks Channel located at the southern end of
Wrightsville Beach,between the Atlantic Ocean and Greenville Sound. The site is located in the Town of
Wrightsville Beach, in New Hanover County. The lot is approximately 0.06 acre with 50'of shoreline frontage.
The lot averages 3'-5'above mean sea level and the shoreline is stabilized by a retaining wall. Waterward of the
retaining wall is an intertidal beach area approximately 10' wide. The applicant maintains a single-family
residence on the property and vegetation consists of lawn grasses and landscape shrubs. There is an existing private
pier(6'x 115%with an associated gazebo,floating docks and boatlifts located at the subject property,which
extends into Banks Channel in a westerly direction. The pier terminates in a gazebo(16' x 20'),which then leads
to a floating dock(6'x 30)accessed by a gangway. The floating dock is in alignment with the pier and runs from
east to west,perpendicular to the shoreline. There are two existing boatlifts(12' x 12')located on each side of the
floating dock. There is also an existing floating dock(8' x 16')located on the northern side of the fixed pier,just
landward of the gazebo. The pier and floating docks currently provide docking space for three(3)vessels,and are
landward of the established Wrightsville Beach Pier head Line.
The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground
portion of the project area as Developed.The waters of the Banks Channel,which are included in the Wrightsville
Recreational Area,are classified SB#by the N.C. Division of Water Quality. They are NOT designated as a
Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish.
The applicant proposes to reconfigure an existing pier,gazebo,floating dock and boatlifts to allow the construction
of an additional floating dock. The existing pier would be reduced by 25' to a final project dimension of 6' x 90'.
The existing gazebo would be then be relocated at the terminal end of the reduced pier. The gazebo would provide
access to the new floating dock(6' x 25'),which would be constructed between the gazebo and the existing 6'x
30' floating dock. The existing 6' x 30' floating dock would remain within its existing location and alignment.
The existing two boatlifts(12' x 12')would be relocated approximately 12' towards the west on each side and at
the terminal end of existing floating dock. The applicant states that the existing 8' x 16' floating dock located at
the northern side of pier would be removed and not incorporated into the new configuration. The proposed
docking system would provide dockage/storage space for up to boRr vessels.
According to the work plat drawings and application forms provided by the applicant's agent,the proposed
structure would be located within the applicant's established area of riparian access,and would not extend beyond
the established pier head line. The agent states that the existing water depth at the location of the proposed floating
docks is—6' at mean low water(MLW).
10. ANTICIPATED UAPACTS
The proposed pier,gazebo and floating dock would incorporate an additional 1478 sq. ft. of Estuarine Waters and
Public Trust Area. The proposed structure would be consistent with the Town of Wrightsville Beach Pier Head
Line and can be built with in the applicant's area of riparian access. The Applicant has received a waiver from the
adjacent riparian property owner to the south to allow encroachment into the riparian corridor 15' setback. Minor
increases in turbidity can be expected during construction.

Recommendations for State Permit—O.H.Parrish
The total square footage of platform and docks were calculated as follows:
Shoreline length=50 ft.x 4 sq. ft=200 sq. ft. allowable.
Gazebos=320 sq. ft. (120 sq. ft. not counted due to width and alignment)
Floating docks-not counted due to width and alignment.
Total=200 sq.ft.
The construction would provide docking space for the total up to four(4)vessels. I have no objections to the proposed
project.Any permit issued should include the following conditions:
l. This permit authorizes only the docks,piers, and other structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structures,whether floating or stationary,
may become a permanent part of the structure without permit modification. No non-water dependent uses of
structures may be conducted on; in,or over public trust waters without permit modification.

from existing or future operations undertaken by the United States in the public interest.
7. The permittee will maintain the authorized work in good condition and in conformance with the terms and
conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without
having the permit transferred to a third-party.
8. This permit authorizes a maximum of(4)boat slips. At no time shall more than(4)vessels be moored or docked at
the facility. The restriction of the number of vessels shall apply to all marine vessel types, including but not limited
to motorboats, sailing vessels and personal watercraft.

The applicant proposes to reconfigure an existing pier,gazebo, floating dock and boat
lifts to allow the construction of an additional floating dock. The property is located at
202 Waynick Blvd,between Banks Channel and the Atlantic Ocean in Wrightsville
Beach.
Areas of Environmental Concern(AEC's) impacted by the proposal are EW and PT. The
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1996 Town of Wrightsville Beach
Land Use Plan and offer the following comments.
The general area of the project is classified Developed,while the AECs impacted by the
work are classified as Conservation.
In general, the Town of Wrightsville Beach allows development in Conservation
classified AECs which is consistent with the State's minimum use standards. The Town
of Wrightsville Beach Land Use Plan contains some policies which exceed the State's
minimum use standards including those for piers and marinas. However,none of these
more restrictive policies seem to be applicable to this project.
Provided all local,state and federal requirements can be met,this project appears to
be consistent with the 1996 Town of Wrightsville Beach Land Use Plan.

Dear Mr. Parrish:
The Division of Coastal Management through a cooperative agreement with the Division of Water Quality
has reviewed your CAMA major permit application to determine if a stormwater management permit
would be required from the Division of Water Quality. The review of the plans and specifications has
determined that the development activities proposed at this time will not pose a threat to surface water
quality from stormwater runoff. The Director of the Division of Water Quality has determined that projects
that are reviewed and approved by the Division of Water Quality as not posing a water quality threat from
stormwater runoff should not be subject to the stormwater management permitting requirements of 15A
NCAC 2H.1000. By copy of this letter, we are informing you that your project will not require a stormwater
management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff,
then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater
discharge requirements. You are required to have an NPDES permit for stormwater discharge from
projects meeting these criteria. The stormwater rules require the Division of Water Quality to permit the
common plan of development, therefore, any future development on the property, regardless of whether a
CAMA Major permit is also required, may require a Stormwater Management Permit application and
permit issuance from the Division of Water Quality prior to any construction.
Please be advised that this determination is for stormwater management requirements only. Your
request for authorization of development under the Coastal Area Management Act is still in process.

The Department of Environment and Natural Resources hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an Area of
Environmental Concern as designated under the CAMA was received on September 27, 2005.
According to said application, O. H. Parrish proposes to reconfigure an existing pier,
gazebo, floating dock and boat lifts to allow the construction of an additional floating dock at 202
Waynick Blvd., between Banks Channel and the Atlantic Ocean, in Wrightsville Beach, New
Hanover County.
A copy of the entire application may be examined or copied at the office Robb Mairs of
N.C. Environment and Natural Resources, Division of Coastal Management, 127 Cardinal Drive
Extension, Wilmington, North Carolina 28405, 910-796-7215 during normal business hours.
Comments mailed to Charles S. Jones, Director, Division of Coastal Management, 1638
Mail Service Center, Raleigh, NC 27699-1638, prior to November 6, 2005, will be considered in
making the permit decision. Later comments will be accepted and considered up to the time of
permit decision. Project modification may occur based on review and comment by the public and
state and federal agencies. Notice of the permit decision in this matter will be provided upon

Dear Mr.Parrish:
The Division of Coastal Management hereby acknowledges receipt of your application for State approval for
development of your property located at 202 Waynick Blvd., Wrightsville Beach, in New Hanover County. It was received
complete on 9/27/05,and appears to be adequate for processing at this time. The projected deadline for making a decision
is 12/11/05. An additional 75-day review period is provided by law when such time is necessary to complete the review. If
you have not been notified of a final action by the initial deadline stated above,you should consider the review period
extended. Under those circumstances,this letter will serve as your notice of an extended review. However,an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 9/27/05,you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will
be held within five working days from the receipt of your written request and shall include the property owner, developer,
and project designer/consultant.
NCGS 113A-119(b)requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a"Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be:Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required,you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy
of my field report and/or comments from reviewing agencies.

UNITOWNE+RS ASSOCIATION,INC.(.the"Association").Bradshaw hereby agrees as follows•

WTI'NESSETH:
WHEREAS,Bradshaw is the owner of the real property located at 204 Waynick
I'I Boulevard.Wrightsville Beach,NC together with the riparian rights associated therewith;and
WHEREAS,Bradshaw heretofore executed a waiver for the encroachment of piers,
idocks,boat lifts and pilings(the"Facilities')consulting a part of the cotnmon aria or elements
or 202 South Lumina Condominiums onto the 15'setback from his area of riparian access,said 4
condominiums being located at 202 South Lumina Avenue,Wrightsville Beach,NC;and

` WHEREAS,the Facilities as actually constructed encroach onto the setback from
li Bradshaw's area of riparian access to a greater extent than shown on the plans submitted to
C.AMA for a permit for the Facilities;and
NOW,THEREFORE,in consideration of the sum of$10.00 and other good and valuable
consideration,the receipt of which is hereby acknowledged by Bradshaw,for himself,his heirs,
successors and assigns,waives encroachment of the Facilities,as built,into the 15'setback from y
his area of ripahan access and further waives any deviation from the plans for the Facilities
submitted to him in conjunction with his previous waiver executed on August 29,2000,for
CAMA and DREDGE AND FILL GENERAL PERMIT No.25281-D.
This agreement shall man with the land and shall inure to and be for the benefit of the
owners of the condominiums referred to above and for the benefit of the 202 South Lumina
i ondominiums Unitowners Association,Inc.
